Manufacturer Registration for New Jersey's Recycled Content Law

On January 18th, 2022, Governor Murphy signed P.L. 2021, c. 391 [N.J.S.A. 13:1E-99.135-157], "an Act concerning the use of postconsumer recycled content in certain containers and packaging products". The Law is intended to stimulate recycling markets by requiring manufacturers to meet minimum recycled content standards for regulated containers and packaging products sold or offered for sale in New Jersey. Manufacturers of regulated containers and packaging products are required to register with the New Jersey Department of Environmental Protection (NJDEP) beginning July 18, 2022, and annually thereafter. In 2023, the Department will be accepting registrations on a rolling basis through the end of the year. A registration fee is also required upon registration. Manufacturers are exempt from the registration fee if they:

  1. generate less than $5,000,000 in gross revenue; or
  2. produce or generate only products that are exempt.

Furthermore, manufacturers that produce or generate only products that are exempt are required to register only once. Through 2023 registration, manufacturers will be able to demonstrate eligibility for a one-time registration by listing all regulated containers and packaging products and assigning exemptions as applicable.

PLEASE NOTE: A $2,000 registration fee will be charged for 2023. This fee combines the $1,000 registration fee for 2023 with the $1,000 registration fee for 2022, which was not collected by the Department in calendar year 2022. The NJDEP assumes that if a manufacturer is required to pay a registration fee in 2023, the same fee would have applied in 2022. Likewise, those that are fee exempt in 2023 would have also been fee exempt in 2022. If you wish to dispute the $2,000 charge, please reach out to recycledcontent@dep.nj.gov to explain why the manufacturer should not be charged for both 2022 and 2023. Please be sure to include any applicable backup documentation (e.g., a Schedule C IRS 1040 Form, etc.). Beginning in 2024, all annual renewals will be charged a $1,000 registration fee, unless registration fees are modified when rules are promulgated.

2023 Registration

To register for 2023, please follow the prompts below to complete the Regulated Containers and Packaging Products Spreadsheet and create an account with NJDEP Online. The Department developed a walk-through of the registration process to further assist manufacturers with registration. The recording of the walk-through along with the accompanying presentation can be viewed in the table below.

In order to identify products that are regulated under this Act, the Department is requiring manufacturers to complete a spreadsheet listing all products that are required to achieve compliance or are otherwise exempt from the requirements. Completing the spreadsheet is the first step in registration. Instructions can be found in the first tab of the spreadsheet.

After completing the Regulated Containers and Packaging Products Spreadsheet, manufacturers may proceed to accessing NJDEP Online by registering for an account. Click the link below and follow the registration instructions in the blue "New User?" box in the righthand corner. You must have a valid email address to register an account and gain access to NJDEP Online.

Once an account has been created, enter the registered services portal, and configure services to add Recycled Content Manufacturer Registration under the Solid and Hazardous Waste section to your Service Selection. Proceed with registration by clicking the link for manufacturer registration and follow the prompts on the screens to follow.

After submitting registration, you will receive a confirmation email that the registration was submitted successfully. You will receive a follow-up confirmation email once the Department has reviewed and accepted the registration. If there are any issues or questions with the registration, Department staff will follow up with the manufacturer directly.
