Description:

Abstract:: This data set is a spatial representation of Areas in Need of Redevelopment/Rehabilitation. Areas in Need are defined and mapped through the redevelopment process as defined and governed by constitutional, statutory, and regulatory requirements. These requirements are in turn molded by court decisions that affect the way the laws are applied.
Purpose:: To provide users with the ability to identify these areas thougout the state.
Supplemental_Information:: Spatially referenced data were derived from the following GIS layers: digital parcel data as compiled from county sources by the New Jersey Dept. of Treasury, Office of Information Technology, Division of Geographic Information Systems. Source files were mapped by county.Municipalities are required to notify the NJ Dept. of Community Affairs of any areas that they have designated by submitting a copy of their resolution. The resolutions usually identify the parcel block and lot.The primary way we maintain this database is through municipal submissions pursuant to the Local Housing Redevelopment Law. Section six [40A:12A-6] of the Local Housing Redevelopment Law as amended in 2003 states that "Upon the adoption of a resolution, the clerk of the municipality shall, forthwith, transmit a copy of the resolution to the Commissioner of Community Affairs for review." The area is then reviewed by the Commissioner of the Department of Community Affairs pursuant to the law and a letter is sent to the sending municipality approving or dissapproving the area.While every attempt has been made to compile a complete redevelopment data set, incomplete, faulty or non submissions as well as input errors may result in data set limitiations.A community's authority to pursue redevelopment is based on the NJ Constitiution and laws that have been enacted by the state legislature in accordance with the state's constitution. The constitution presents three key concepts related to redevelopment. It: establishes redevelopment as a public purpose; permits the acquisition of private property and conveyance of such property to a public or private redeveloper for redevelopment; allows the granting of tax exemptions and abatements to private corporations or partnerships for the purpose of redevelopment, as long as their profits are limited by law.Based on constitutional provisions, New Jersey's state legislature has enacted a variety of laws relating to redevelopment, such as:The Local Redevelopment and Housing Law (LRHL) P.L. 1992, c.79 (N.J.S.A. 40A:12A-1 et seq.)Long Term Tax Exemption Law P.L. 1991, c. 431 (N.J.S.A. 40A:21-1seq.)Five Year Exemption and Abatement Law, P.L. 1991, c.441 (N.J.S.A. 40A:21-1 et seq.)

Process_Description:: Municipal resolutions adoped by municipalities declaring 'Areas in Need of Redevelopment' or 'Areas in Need of Rehabilitation' are submitted and maintained on file at the NJ Dept. of Community Affairs. Each resolution either contains the parcel Block & Lot designations or a description or a map of the area. Using the OGIS NJ Composite of Parcels mapping as a snapping base, each area was digitized. Groups of parcels or entire Blocks tend to be designated as well as single parcels. Parcels and Blocks that shared boundaries were merged when they were part of the same resolution.
