Abstract:
This is a representation of the geographical extents of the 12 County/Areawide Water Quality Management Planning Areas (WQMPA). A County or Areawide Water Quality Management Plan (WQMP) was prepared, respectively, by a County or NJDEP pursuant to Section 5 of the Water Quality Planning Act (WQPA), N.J.S.A. 58:11A-1 et seq for each of these areas. A WQMP is used in conjunction with the Statewide WQM Plan, which together constitute the Continuing Planning Process conducted pursuant to the WQPA, the Water Pollution Control Act, N.J.S.A. 58:10A-1 et seq., and N.J.S.A. 13:1D-1 et seq., and as required by Sections 303(e) and 208 of the Federal Clean Water Act (33 U.S.C. 1251 et seq.) to make consistency determinations under the Water Quality Management (WQM) Planning rules, N.J.A.C. 7:15.
Purpose:
The Department of Environmental Protection (DEP) administers the WQM Planning rules, N.J.A.C. 7:15, in conjunction with the Statewide WQM Plan, which together constitute the Continuing Planning Process conducted pursuant to the Water Quality Planning Act, N.J.S.A. 58:11A-1 et seq., the Water Pollution Control Act, N.J.S.A. 58:10A-1 et seq., and N.J.S.A. 13:1D-1 et seq., and as required by Sections 303(e) and 208 of the Federal Clean Water Act (33 U.S.C. 1251 et seq.). According to these regulations, the Commissioner of the DEP shall not undertake, or authorize through the issuance of a permit, any project or activity that conflict with the applicable sections of adopted WQM Plans or the WQM Planning rules. The existing rules establish a mechanism for the determination of consistency between proposed projects or activities requiring Departmentally issued permits and the WQM Plans.
Supplemental_Information:
In 1975, the Governor made the first designations of areawide WQM planning agencies by designating: Middlesex County Freeholders for the Lower Raritan/Middlesex County Area; Ocean County Freeholders for Ocean County; Delaware Valley Regional Planning Commission (DVRPC) for Mercer County and the Tri-County areas.
In 1976, the Governor designated three more WQM planning Agencies: Atlantic County Freeholders for Atlantic County; Cape May Freeholders for Cape May County; and Sussex County Freeholders for Sussex County. Also in 1976, since the remaining county governments declined to participate so the Governor designated NJDEP to prepare the areawide plans for the remaining areas: Northeast, Monmouth County, Upper Delaware, Lower Delaware and Upper Raritan.
In 1980, all twelve WQM Plans were adopted in whole or in part and the Governor designated Mercer County Freeholders to replace DVRPC as the designated planning agency for Mercer County.
In 1997, the Governor designated the Monmouth County Freeholders to replace NJDEP as the designated planning agency for Monmouth County.

Users shall require any independent contractor, hired to undertake work that will utilize digital data obtained from the NJDEP, to agree not to use, reproduce, or redistribute NJDEP GIS data for any purpose other than the specified contractual work. All copies of NJDEP GIS data utilized by an independent contractor will be required to be returned to the original user at the close of such contractual work. Users hereby agree to abide by the use and reproduction conditions specified above and agree to hold any independent contractor to the same terms. By using data provided herein, the user acknowledges that terms and conditions have been read and that the user is bound by these criteria.

The WQMPAs were designated by the Governor in 1977 pursuant to Section 4 of the WQPA 58:11A-4, which required that said designation should to the maximum extent practicable conform to county boundaries, with appropriate modifications made to take account of the major watersheds, as for example by including the south branch of the Raritan in a Hunterdon county designation and the north branch of the Raritan in a Somerset county designation. DWM staff originally used the Department's County boundaries and Watershed Management Area GIS coverages as the reference boundaries to develop this layer along the County and Watershed boundaries designated in 1977. The boundaries have been adjusted to conform with the revised boundaries of the "Municipalities clipped to Coast" layer, January 2009; the watershed boundaries of the "Watershed Management Areas" layer, January, 2009; and the "Sewer Service Areas" November 2008.
