Abstract: This data layer identifies those Known Contaminated Sites (KCS) or sites on Site Remediation Programs' (SRP) Comprehensive Site List (CSL) that have been assigned a Deed Notice. A deed notice is described by NJ State
Legislature (NJSA 58:10B-13a) as a "...notice to inform prospective holders of an interest in the property that contamination exists on the property at a level that may statutorily restrict certain uses of, or access to,
all or part of that property, a delineation of those restrictions, a description of all specific engineering or institutional controls at the property that exist and that shall be maintained in order to prevent exposure
to contaminants remaining on the property, and the written consent to the notice by the owner of the property".
Purpose: The deed notice boundary (polygon) was developed to provide information regarding the spatial extent of soil contamination, as well as information regarding engineering controls (eg. cap or fence) and contamination found
in the soils above the appropriate standard. This is aimed to help preserve adequate protection of these areas of contaminated soil and helps to minimize any chance of exposure.
Supplemental Information: The spatial extent of each deed notice is provided by the responsible entity and reviewed by SRP staff.

Process Step:
Process Description: Starting in 2009, the NJDEP incorporated vector data obtained as electronic files from responsible entities or their environmental consultants. These files are based upon survey coordinates obtained by licensed
surveyors who achieve horizontal accuracy of less than 1 foot. The Site Remediation Program has required that electronic submissions not vary from the position of control points found in the orthorectified 2012 aerial
images by more than +/- 5 feet. It should be noted that some of the records in this layer were created based on NJDEP review of paper maps supplied by the party responsible for the site. The confidence as to the
accuracy tends to be high but is limited to the quality of the maps provided by the responsible entities. Upon request, NJDEP can supply information about which records are digital submissions versus which were created
from review of paper maps. Submissions are then reviewed by the appropriate SRP staff using a customized version of Arc Explorer at which time the deed notice boundary can be linked to the correct deed notice subject
item and activity and approved for addition into the deed notice GIS layer.
