The Green Acres Program

The Green Acres Program was created in 1961 to meet New Jersey's growing recreation and conservation needs. The program serves to preserve and enhance New Jersey's natural environment as well as its historic, scenic and recreational resources for public use and enjoyment.

Together with public and nonprofit partners, the Program protects open space and has provided hundreds of public parks and outdoor recreational facilities throughout the State of New Jersey.

The Division of Land Use Regulation (DLUR) may coordinate with the Green Acres Program in situations where mitigation is required for permitted disturbance to State-protected natural resources, as defined at N.J.A.C. 7:7A-15.4; and, for projects within the coastal zone area, when an applicant must demonstrate compliance with the public trust rights rule, as defined at N.J.A.C. 7:7E-8.11.

DLUR decisions may be influenced in both circumstances where proposed compliance measures do not meet the terms of Green Acres Program Rules (N.J.A.C. 7:36).  For example, a proposed mitigation offer, for DLUR-permitted disturbance to freshwater wetlands, may be dismissed by DLUR if the offered mitigation site is encumbered by Green Acres (i.e., if its acquisition was funded through Green Acres). 

In addition, application requests to permit activities within areas encumbered by Green Acres, such as a bike path or other structure within regulated areas, require approval from Green Acres before we can approve any request.
