Public Notice of Substantial Change on Adoption to Proposed Amendments

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection is proposing substantial changes on adoption to the public access rules at N.J.A.C. 7:7 and 7:7E, published on April 4, 2011. A statement of the substance of the proposed changes on adoption follows: The proposed substantial changes include several changes to provide clarity and ensure consistent application of procedures and standards, and to reflect public comment on the proposal.  Some of these proposed changes include providing increased transparency and public participation in both the Department and the municipal review process of Municipal Public Access Plans; restoring to the rule provisions requiring that public access incorporate, to the maximum extent practicable, fishing access and associated amenities; providing a paragraph to address public access requirements for public highways; specifying a standard formula to calculate a payment amount for linear projects when a Municipal Public Access Plan requires a monetary contribution to be used to provide new or enhanced public access; and establishing a process by which the Department can revoke a Municipal Public Access plan for good cause. 

The public notice of substantial change on adoption is scheduled to be published in the March 19, 2012 New Jersey Register.  A copy of the public notice of substantial change on adoption is available from: the Department’s website at www.nj.gov/dep; official repository libraries; or by contacting LexisNexis Customer Service at (800) 223-1944 or www.lexisnexis.com/bookstore.  Be advised that there may be a fee for obtaining a copy of the public notice of substantial change on adoption from some sources.
