Notice of Re-opening of Comment Period
Endangered, Nongame, and Exotic Wildlife Exotic Species and Nongame Species Requiring a Permit for Possession; Exempted Species Proposed Amendments: N.J.A.C. 7:25-4.3 and 4.4

PUBLIC NOTICE
Take notice that the Department of Environmental Protection (Department) is re-opening the comment period for the proposed amendment of the rules governing the possession of nongame and exotic species at N.J.A.C. 7:25-4.3 and 4.4 to add bison (commonly known as the American buffalo) to the list of mammals exempted from the requirement to obtain an annual possession permit from the Department.  Bison will continue to be regulated by the Department of Agriculture pursuant to the definition of “cattle” in that department’s rules.  The Department is also proposing to codify prior statutory changes that classified several species of small ruminants and flightless birds as agricultural livestock.  Specifically, the Department is proposing to delete the llama from the list of species for which a permit is required and to add the llama, alpaca, guanaco, emu, ostrich, greater rhea, and lesser rhea to the list of species exempt from Department permitting.  A copy of the proposal is available at: http://www.nj.gov/dep/rules/proposals/20141117b.pdf; and the LexisNexis free public access to the New Jersey Register, www.lexisnexis.com/njoal.

This proposal was published in the New Jersey Register on November 17, 2014 at 46 N.J.R. 2258(a).  The original comment period closed on January 16, 2015.  The Department is re-opening the comment period for an additional 30 days to Wednesday, April 15, 2015.  Written comments may be submitted electronically by April 15, 2015 at http://www.nj.gov/dep/rules/comments; or in hard copy to:
