Notice of Rule Proposal
Radiation Protection Programs N.J.A.C. 28

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection and the Commission on Radiation Protection are proposing amendments, repeals, and new rules related to Agreement State program, and the licensing of nuclear medicine technologists.  With regard to the Agreement State program, the proposed new rules incorporate by reference the Nuclear Regulatory Commission’s rules at 10 CFR Part 37 regarding Physical Protection of Category 1 and Category 2 Quantities of Radioactive Materials, and eliminate conflicts between the State’s rules and the NRC’s rules incorporated by reference.

The proposed rules related to the licensing of nuclear medicine technologists create the new license category of fusion imaging CT technology, and provide a means by which nuclear medicine technologists (with additional training and demonstration of competency in Computed Tomography (CT)) can become licensed to perform fusion imaging studies. This license will permit a nuclear medicine technologist to fully operate Positron Emission Technology/Computed Tomography (PET/CT) and Single Photon Emission Tomography/Computed Tomography (SPECT/CT) equipment required for fusion imaging studiesCurrently, fusion imaging studies require two differently licensed technologists to perform one PET/CT or SPECT/CT study.

The proposal is scheduled to be published in the New Jersey Register dated October 19, 2015.  A copy of the proposal is available from: the DEP website at www.nj.gov/dep/rules/ and LexisNexis free public access to the New Jersey Register,www.lexisnexis.com/njoal.
