Legacy Landfills: N.J.A.C. 7:26, Solid Waste; N.J.A.C. 7:26A, Recycling Rules; N.J.A.C. 7:27, Air Pollution Control; and N.J.A.C. 7:27A, Air Administrative Procedures and Penalties

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection is proposing rules pertaining to sanitary landfills to codify and implement the provisions of the Legacy Landfill Law, N.J.S.A. 13:1E-125.1 et seq., which became effective on June 26, 2013.  The Department is integrating the Legacy Landfill Law’s requirements into the existing Solid Waste Rules to provide the regulated community and the public with comprehensive rules that address closure and post-closure care and disruption of all sanitary landfills. Amendments to the Air Pollution Control rules address the hydrogen sulfide emission standard provided in the Legacy Landfill Law. The Department also proposes to extend some requirements of the Legacy Landfill Law to all sanitary landfills. In addition, the Department is proposing amendments to the Solid Waste Rules that will provide the Department with more comprehensive information during a sanitary landfill’s post-closure care period, and to clarify other existing Solid Waste Rules.
