Environmental Justice
Proposed New Rules: N.J.A.C. 7:1C

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection is proposing new Environmental Justice rules at N.J.A.C. 7:1C.

This proposed rulemaking implements N.J.S.A. 13:1D-157.  The proposed rule will require certain facilities seeking certain permits in overburdened communities to prepare an environmental justice impact statement and conduct a public hearing to ensure meaningful public participation in the permitting process.  Additionally, the Department will apply permit conditions where necessary to avoid increases to environmental and public health stressors. 

The proposal is scheduled to be published in the New Jersey Register dated June 6, 2022.  A copy of the proposal is available on the Department’s webpage at: http://www.nj.gov/dep/rules/proposals/proposal-20220606a.pdf and LexisNexis free public access to the New Jersey Register (https://www.lexisnexis.com/hottopics/njoal). 

Public hearings will be held on this notice of proposal on the following dates and times:

  1. Monday, July 11, 2022, from 3:00 P.M. through 5:00 P.M. and 6:00 P.M. through 7:00 P.M. at the Department of Environmental Protection’s (Department) Public Hearing Room, 401 E. State Street, Trenton.
  2. Wednesday, July 13, 2022, at 6:30 P.M. at the Ray and Jon Kroc Corps Community Multi Purpose Room; 1865 Harrison Ave., Camden, NJ 08105.
  3. Wednesday, July 27, 2022, at 6:00 P.M. at the New Jersey Institute of Technology (NJIT), Campus Center Atrium, First Floor 150 Bleeker Street, Newark, NJ 07102.  Parking is Available at the NJIT Summit Street Garage, 154 Summit Street: https://www.njit.edu/about/maps-directions .
  4. Thursday, July 28, 2022, at 6:00 P.M. through the Department’s video conferencing software (as noted below).

Written comments are due by September 4, 2022.  The Department encourages electronic submittal of comments.
