Proposed Amendment to the Lower Delaware Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Lower Delaware Water Quality Management (WQM) Plan will be published on July 5, 2022, in the New Jersey Register. The proposed amendment, identified as the “Pennsville-Tufts & Fort Mott Roads” (Program Interest No. 435441, Activity No. AMD21001) would expand the sewer service area (SSA) of the Pennsville Sewage Authority (NJPDES No. NJ0021598) sewage treatment plant (STP) by roughly one acre to serve 11 existing single family homes located on Block 4803, Lots 3, 4, 5, 6, 7 and Block 4804, Lots 2, 3, 4, 5, 6, 7 and a baseball park snack stand and restrooms located on Block 4803, Lot 1, in Pennsville Township, Salem County.

Extension of Public Comment Period and Public Hearing onWhite - 519 Commerce Center Amendment Proposal to the Upper Delaware Water Quality Management Plan
A public notice regarding a public comment period extension and public hearing for a Proposed Amendment to the Upper Delaware Water Quality Management Plan will be published on July 5th, 2022, in the New Jersey Register (NJR). The May 2, 2022 publication of the NJR (54 N.J.R. 787(a)) contained the preliminary notice regarding the proposed amendment for “White - 519 Commerce Center” (Program Interest No. 435437, Activity No. AMD210001) in White Township, Warren County. A public hearing will be held on August 5th, 2022 at 10:00 AM via Microsoft Teams. The hearing will conclude at 12:00 PM or the conclusion of all public testimony, whichever is earlier. For those without access to web meetings, the hearing will also be accessible by phone for audio only. Commenters that anticipate providing verbal testimony are encouraged to notify the Department in advance by calling (609) 633-7021 or emailing wqmp.publiccomments@dep.nj.gov to ensure a timely and streamlined public hearing process.

Proposed Amendment to the Mercer County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Mercer County Water Quality Management (WQM) Plan will be published on June 6, 2022, in the New Jersey Register. The proposed amendment, identified as “Brick Farm Properties LLC” (Program Interest No.435452, Activity No.210003) would expand the sewer service area (SSA) of the Stony Brook Regional Sewage Authority Hopewell Sewage Treatment Plant (NJPDES No. NJ0035301) by 0.3 acres to serve an existing 135-seat restaurant with 1,500 square feet of office space and a brewery with 3 employees on a portion of Block 14, Lot 15.01, in Hopewell Township, Mercer County. The project will generate a projected wastewater flow of 4,575 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Northeast Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Northeast Water Quality Management (WQM) Plan will be published on June 6, 2022, in the New Jersey Register. The proposed amendment, identified as “Hurstmont-Glen Alpin” (Program Interest No.435442, Activity No.190009) would establish a new sewer service area (SSA) of 17.6 acres to serve a proposed 250-unit residential housing development consisting of 75 1-bedroom units, 50 2-bedroom units, 40 2-bedroom age-restricted units, 85 1-bedroom assisted living units on a portion of Block 27, Lot 2, and a banquet hall designed for 360 people on a portion of Block 34, Lot 1 in Harding Township, Morris County. The proposed residential development and banquet hall are to be served by a proposed onsite Discharge to Ground Water (DGW) wastewater treatment system. The project will generate a projected wastewater flow of 45,000 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Mercer County Water Quality Management Plan
In accordance with the Water Quality Management Planning Rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Mercer County Water Quality Management (WQM) Plan will be published on June 6, 2022, in the New Jersey Register. The proposed amendment, identified as “Hilton West Windsor” (Program Interest No. 435452, Activity No. AMD210002) would expand the sewer service area (SSA) of the Stony Brook Regional Sewerage Authority (SBRSA) River Road Sewage Treatment Plant (STP), NJPDES No. NJ0031119, by 21.23 acres to serve a proposed residential development on a portion of Block 37, Lot 7 in West Windsor Township, Mercer County. The proposed project consists of 88 age-restricted residential units with a clubhouse, recreation center, and pool. The project will generate a projected wastewater flow of 21,210 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Sussex County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Sussex County Water Quality Management (WQM) Plan will be published on June 6, 2022, in the New Jersey Register. The proposed amendment, identified as “Hudson Farm” (Program Interest No. 435459, Activity No. AMD210001), would expand the Hudson Farm discharge to groundwater sewer service area by approximately of 0.15 acres to include a new pavilion located on Block 50002, Lot 7, in Hopatcong Borough, Sussex County. As calculated in accordance with N.J.A.C. 7:9A-7.4, the proposed project will generate a projected 750 gallons per day of new wastewater to be treated by an on-site subsurface sewage disposal system regulated under the New Jersey Pollutant Discharge Elimination System permit number NJG0179523.

Proposed Amendment to the Ocean County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Ocean County Water Quality Management (WQM) Plan will be published on May 16, 2022, in the New Jersey Register. The proposed amendment, identified as “Homes for All Manitou Park – Phase IV” (Program Interest No. 435448, Activity No. AMD180003) would expand the sewer service area (SSA) of the Ocean County Utilities Authority Central Wastewater Pollution Control Facility (OCUA Central WPCF) by 7.99 acres to serve a proposed residential development consisting of 51 three-bedroom and four-bedroom single-family homes within Berkeley Township, Ocean County. Seven of the proposed homes are located within the presently adopted SSA and are not the subject of this amendment. The OCUA Central WPCF sewer service area is proposed to be expanded to include the following blocks and lots: Block 24, Lots 1381-1386; Block 25, Lots 116 (portion), 1170-1181, and 1362-1369; Block 26, Lots 985-987; Block 27, Lots 1387-1400; Block 28, Lots 1182-1195, and 1348-1361; Block 29, Lots 996-1001, and 1154-1159; Block 31, Lots 1403-1411; Block 32, Lots 1198-1208, and 1336-1345; Block 33, Lot 114. The amendment portion of the proposed project would generate a projected wastewater flow of 13,200 gallons per day (gpd), as calculated in accordance with N.J.A.C. 7:14A-23.3, to be received by the OCUA Central WPCF (New Jersey Pollutant Discharge Elimination System (NJPDES) permit #NJ0029408).

VIRTUAL PUBLIC HEARING
Public Hearing on the Milly’s Court – Sussex County WQMP Amendment Proposal
On April 4, 2022, the Bureau of NJPDES Stormwater Permitting and Water Quality Management published a public hearing announcement for the Milly’s Court amendment to the Sussex County Water Quality Management Plan in the New Jersey Register (54 N.J.R.664(a)). The public hearing is scheduled for 10:00 am on May 6, 2022, and will be conducted virtually via Microsoft Teams. The hearing will remain open until 12:00 pm or the conclusion of all public testimony, whichever is earlier.

Prior to entering the hearing, participants are strongly encouraged to read the following information and guidelines:
- Participants are encouraged, but not required, to pre-register to comment at the public hearing by emailing to wqmp.publiccomments@dep.nj.gov or by calling (609) 633-7021.
- If an attendee to the public hearing would like to provide testimony, they are encouraged, but not required, to notify the WQMP program via the wqmp.publiccomments@dep.nj.gov email address or by calling 609-633-7021. Make sure to include full name, the name of the organization that you represent, phone number and email as applicable. When called upon for testimony, participants will be asked to re-state their full name and the name of the organization that they represent.
- Access to the public hearing is available on your computer or mobile device through either the Microsoft Teams application or the device’s web browser.
- The web browsers that best support Microsoft Teams meetings are Internet Explorer 11, Microsoft Edge, Chrome, and Firefox.
- The hearing will begin promptly at the designated starting time of 10:00 am.
- The hearing will be moderated by a NJDEP representative.
- Upon entering the hearing, participants are encouraged to post their name, organization they are representing (if applicable), and email address or phone number to the meeting chat box. If you do not wish to post that information, you may instead email it to wqmp.publiccomments@dep.nj.gov.
- If you wish to remain anonymous the NJDEP will not be able to provide you with a copy of the response to comment document; however, if the project proceeds to adoption it will be published in the NJR as part of the adoption notice.

Proposed Amendment to the Upper Delaware County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Upper Delaware Water Quality Management (WQM) Plan will be published on May 2, 2022, in the New Jersey Register. The proposed amendment, identified as White – 519 Commerce Center (Program Interest No. 435437, Activity No. AMD210001) would establish an approximately 62 acre discharge to groundwater sewer service area for a proposed warehouse development to be located on existing Block 7, Lots 3, 4, 5, 11, 14 and 16, White Township, Warren County. The project will generate a projected wastewater flow of 32,525 gallons per day based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Tri-County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Tri-County Water Quality Management (WQM) Plan will be published on April 4, 2022, in the New Jersey Register. The proposed amendment, identified as Knight Owl Holdings V, LLC (Program Interest No. 435433, Activity No. AMD200011) would expand the sewer service area (SSA) of the Gloucester County Utilities Authority (NJPDES No. NJ0024686) sewage treatment plant (STP) by 36 acres to serve a proposed 694,000 square foot building to include warehouse and office space to be located within Block 201, Lot 2 (portion) and Lot 3, in East Greenwich Township, Gloucester County. Currently, approximately 12.5 acres of the project property are located within the adopted GCUA SSA. The project will generate a projected wastewater flow of 28,350 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

The proposed project consists of 30 one-bedroom apartments, 52 two-bedroom apartments, and 2 three-bedroom apartments. Proposed Amendment to the Sussex County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Sussex County Water Quality Management (WQM) Plan will be published on February 7, 2022, in the New Jersey Register. The proposed amendment, identified as “Milly’s Court” (Program Interest No. 435459, Activity No. AMD170002) would expand the sewer service area (SSA) of the Sussex County Municipal Utilities Authority’s Upper Wallkill Valley Water Control Facility (SCMUA UWVWCF) by 7.59 acres to serve a proposed residential development located on Block 2701, Lot 2 (portion) in Franklin Borough, Sussex County. Four and three quarters acres of presently adopted sewer service area that is located on the property is proposed to be removed by this amendment. The proposed amendment portion of the project consists of 91 one-bedroom apartments, 105 two-bedroom apartments, and 28 three-bedroom apartments. The entire proposed project also includes 21 additional one-bedroom apartments, 15 additional two-bedroom apartments, and a clubhouse and pool, however, these buildings are located within the presently adopted sewer service area and therefore, are not the subject of this amendment. The proposed amendment portion of the project would generate a projected wastewater flow of 45,675 gallons per day (gpd), as calculated in accordance with N.J.A.C. 7:14A-23.3, to be received by the SCMUA UWVWCF (New Jersey Pollutant Discharge Elimination System (NJPDES) permit #NJ0053350).

Proposed Amendment to the Northeast and Upper Raritan Water Quality Management Plans
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Northeast and Upper Raritan Water Quality Management (WQM) Plans will be published on December 6, 2021 in the New Jersey Register. The proposed amendment, identified as “KRE Mine Hill” (Program Interest No. 435442, Activity No. AMD200005) would alter the sewer service area (SSA) of the Rockaway Valley Regional Sewerage Authority Sewage Treatment Plant (STP) (NJPDES No. NJ0022349) by adding 14 acres to serve a 390-unit residential development with a clubhouse and pool located on portions of Block 1102, Lot 1 and Block 1502, Lot 1, in Mine Hill Township, Morris County. Additionally, 16 acres of the project site would be removed from the SSA with the proposal due to the presence of Environmentally Sensitive Areas. As calculated in accordance with N.J.A.C. 7:14A-23.3, the project will generate a projected wastewater flow of 80,500 gallons per day (gpd).

In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Tri-County Water Quality Management (WQM) Plan will be published on June 7, 2021 in the New Jersey Register. The proposed amendment, identified as the “Deptford Redevelopment Area-Proposed Warehouse “(Program Interest No. 435433, Activity No.AMD200002) would expand the sewer service area (SSA) of the Gloucester County Utilities Authority (GCUA) Sewage Treatment Plant (STP), NJPDES No. NJ0024868, by 2.8 acres on portions of Block 387.01; Lots, 33, 36 & 50, in Deptford Township, Gloucester County. The proposed project site is 143 acres of which approximately 92 acres are currently designated as SSA of the GCUA STP. The expanded SSA would allow for the proposed development consisting of the construction of two warehouses, 1,200 square feet (sf) and 150,215 sf in size, and a 8,000 sf retail building. The project will generate a projected wastewater flow of 19,550 gallons per day (gpd) as calculated in accordance with N.J.A.C. 7:14A-23.3.

Notice of Extension of Comment Period for Proposed Amendments Published April 6, 2020
The comment period on four proposed Water Quality Management Plan amendments has been extended. The public notices of the proposed amendments were published in the April 6, 2020 New Jersey Register identifying a 30-day public comment period. Subsequent to the filing of these notices for publication, by Executive Order No. 103, dated March 9, 2020 (EO 103), Governor Phil Murphy declared that a Public Health Emergency and State of Emergency exists in the State of New Jersey as a result of COVID-19. In light of the disruption caused by the COVID-19 virus, the public comment periods for each of these proposed amendments is extended to 60 days. The affected amendments are: Cape May County WQM Plan - Ocean Isle Campground; Lower Delaware WQM Plan - Galetto SSA; Northeast WQM Plan - Guru Nanak, Inc.; Northeast WQM Plan – Mine Hill WMP Chapter.

Proposed Amendment to the Upper Delaware Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice seeking additional public comment for a Proposed Amendment to the Upper Delaware Water Quality Management (WQM) Plan will be published on December 16, 2019 in the New Jersey Register. A preliminary notice was published in the New Jersey Register on September 03, 2019, at 51 N.J.R. 1435(a) seeking public comment on the proposed amendment (Program Interest No. 435437, Activity No. AMD170002), identified as “Haberman Hampton.” The proposed amendment would establish a new on-site wastewater treatment plant that discharges to ground water and a new sewer service area of 47 acres to serve a proposed development consisting of 142 single-family homes, 146 multi-family attached units, and 45 multi-family attached affordable units, and 6,000 square feet of commercial space, on a portion of Block 23, Lot 1 in Hampton Borough, Hunterdon County. The proposed project would generate a projected wastewater flow of 86,175 gallons per day to be received by the new subsurface sewage disposal system. A non-adversarial public hearing will be held from 5:00 – 7:00 PM on Tuesday January 21, 2020, at the Hunterdon County Administration Route 12 County Complex, NJ-12, Flemington, NJ 08822. The public comment period is extended to February 3, 2020.

This amendment proposal, identified as “Radvany Site” would expand the sewer service area (SSA) of the Hamilton Township Water Pollution Control Facility by 52 acres to allow for construction of a proposed athletic complex on Block 2712/Lots 151 and 156 in Hamilton Township, Mercer County.

Proposed Amendment to the Northeast Water Quality Management Plan
The December 18, 2017 publication of the New Jersey Register contains a preliminary notice regarding the Borough of Oakland Wastewater Management Plan (WMP). The Department has been advised of additional, substantially different information regarding the WMP that renders the December 18 publication inaccurate. The Department will issue a superseding notice in a subsequent publication of the New Jersey Register, and requests that the public withhold comments until that publication is made. The Department will also issue a corresponding listserv statement upon publication of the superseding notice.

Proposed Amendment to the Upper Delaware Water Quality Management Plan
In accordance with the Statewide Water Quality Management Planning rules (N.J.A.C. 7:15-5.13, 3.4), a public notice for a Proposed Amendment to the Upper Delaware Water Quality Management (WQM) Plan will be published on May 16, 2016 in the New Jersey Register and on May 12, 2016 in the Hunterdon County Democrat. This amendment proposal would provide for a new sewer service area to accommodate an individual groundwater discharge wastewater treatment system for a proposed mixed use building on Block 3, Lot 20.06 , in West Amwell Township, Hunterdon County. This amendment proposal was submitted on behalf of Investment Group, LLC.

In accordance with the Statewide Water Quality Management Planning rules (N.J.A.C. 7:15-5.13, 3.4), a public notice for a Proposed Amendment to the Upper Raritan Water Quality Management (WQM) Plan was published on October 5, 2015 in the New Jersey Resister. Notice was also published in the Hunterdon County Democrat. This amendment proposal would provide for the High Bridge Borough chapter of the Hunterdon County Wastewater Management Plan. This amendment proposal was submitted by Hunterdon County.

January 17, 2012
P.L.2011, c.203 was enacted on January 17, 2012, which permits a Wastewater Management Planning Agency to prepare and submit to the Department at least that portion of a wastewater management plan designating sewer service area, which shall comply with the Department’s regulatory criteria.
