The MVC regulates the installation and use of Breath Alcohol Ignition Interlock Devices (BAIID) ordered by the court to be installed. You need a BAIID license to be authorized to install the devices.

The BAIID is designed to allow a vehicle ignition switch to start the engine when the driver's Blood Alcohol Content (BAC) is below the alcohol set point and locks the ignition when the driver’s BAC is at or above the alcohol set point.

How to get a BAIID license

Submit a completed license application form as prescribed by the Chief Administrator of the Motor Vehicle Commission certifying that the installation and use of the BAIID will not impede the safe operation of the vehicle in which it is installed.

Submit the original Certificate of Insurance from a licensed insurance company with minimum liability limit of $1 million per occurrence and a $3 million aggregate total. The liability should cover defects in product design, materials and manufacturing.

• A $10,000 surety bond from a licensed insurance company that insures the MVC against any monetary loss suffered by a violation from the manufacturer or one of its service centers.
• Provide copies of written instructions for servicing a BAIID to service center employees.
• Provide a copy of written instructions for proper operation and use to the offender.
• Technical specification of a BAIID's safety, utility, optional features and the manufacturer's required service interval.
• Copy of manufacturer's warranty.
• Sample of warning label.
• Certification or approval that BAIID meets or exceeds (National Highway Traffic Safety Admnistration (NHTSA) Model Specifications.
• A list of all states that have certified or approved BAIID for use to meet or exceed NHTSA specifications and the name, address and telephone number of state official(s) responsible for the certification or approval.
• A list of all states that have revoked, suspended or denied certification or approval, the reasons for such actions and the name, address and telephone number of the state official(s) responsible for such actions.
• An online listing of all service centers in the manufacturer's network, including the address of each, whether it is owned, leased, rented or otherwise secured from the owner, and the name, address and telephone number of the owner.
• A list of employees that will provide services for a BAIID at the manufacturer’s service centers.

Interlock device specifications that must be followed

• A BAIID installed to meet court-ordered sentencing requirements must meet or exceed specifications for performance and testing of the NHTSA Model Specifications. (N.J.S.A 39:4–50 and 39:4–50.17).
  • The device can only be installed at a service center designated by the MVC.
  • The breath alcohol concentration (BAC) set point must be at 0.05%.
  • The required service interval shall not exceed 60 days.
  • Must include a warning label:
    • "Any person tampering with, circumventing or misusing this Ignition Interlock system shall be subject to prosecution and/or civil liability."

Annual registration requirements

You should register the BAIID with the Chief Administrator by January 31 of each subsequent year certified on the form supplied by the MVC.

You must state that you are a certified BAIID technician and that each service center in your network meets the requirements of this subchapter, as amended and supplemented.

Service center requirements

You must provide annual reports to the MVC detailed in N.J.A.C 13.19–6.9 stating that you are able to service the BAIID in accordance with accepted industry standards and according to instructions provided by the BAIID manufacturer.

Provide a secure area, inaccessible to customers to service and/or install BAIIDs, a waiting area during BAIID servicing and an area for customer training.

Display an authorized MVC sign stating, "New Jersey approved Ignition Interlock Service Center" clearly visible to BAIID customers.

Monitor BAIID performance periodically at intervals of no more than 60 days.

Comply with detailed list in accordance with N.J.A.C 13:19–6.11.

Violations

Your BAIID license may be suspended or revoked for any violation of the law or regulations listed in N.J.A.C. 13:19–6.10.

Upon revocation, you are responsible for:

• The removal of all BAIID equipment from the vehicles where it was installed; and
• Any costs connected with the removal.

The cost of the installation of new BAIIDs that comply with N.J.A.C. 13:19-6.1 et seq.
