Summary:
The New Jersey Division on Civil Rights
proposes to readopt with amendments its
rules pertaining to Employment Advertising.
The existing rules prohibit employers, employment
agencies, labor organizations, newspapers
and other publications from publishing any
advertisement regarding employment that
expresses, directly or indirectly, any preference
or discrimination as to race, creed, color,
national origin, ancestry, age, marital
status, sex, nationality, disability, sexual
orientation or liability for Service in
the Armed Forces of the United States. The
rules also provide for a process by which
entities may request an exception from the
rules when membership in a particular class
is a bona fide occupational qualification
(BFOQ). Upon readoption, the Division proposes
amendments to cover all forms of employment
advertising, whether in print or electronic
media, and to conform the rules to amendments
to the Law Against Discrimination. The Division
also proposes amendments to make the BFOQ
request process more efficient. The proposed
readoption with amendments appears in the
September 5, 2006 edition of the New Jersey
Register.
