Description:
The proposed new rules set forth those records
of the Department of Law and Public Safety,
including the records of divisions and “in
but not of” agencies, not deemed government
records for the purposes of N.J.S.A. 47:1A-1,
in addition to those deemed exempt under
other authority. The proposed rules reflect
the Department’s decision to enact
confidentiality standards governing access
to government records that have been in
use under paragraph four of Executive
Order No. 21, which was issued in July 2002
and modified by Executive Order in August
2002. Under the rules, exempted records
include, but are not limited to, records
of background investigations for public
employment (including closed or inactive
investigations), as well as records that
may contain the identity of a confidential
informant or source, or reveal an agency’s
surveillance procedures or undercover personnel.
Other exempted records include those created
in connection with discipline, discharge
and employee performance and evaluation.
Also exempted is any inventory of state
and local emergency resources – including
employee contact information -- which if
disclosed could substantially interfere
with the state’s ability to protect
against acts of sabotage or terrorism.
