Subject: Revision to Section 8 Environmental, of the Procedures Manual, Revision to 8.6.1 Policy on Cost Recovery in Acquisition of Contaminated Property, and Addition of Subsection 8.6.3 Procedure Addressing Contamination Left Within New Jersey Department of Transportation Right-of-Way.
Section 8 has been revised to include new subsection 8.6.3. Procedure Addressing Contamination left Within New Jersey Department of Transportation Right-of-Way (R.O.W.). This procedure has been incorporated in the Departmental process in response to changes in New Jersey Department of Environmental Protection (NJDEP) regulations addressing the contaminated soil reuse process.
As part of the regulatory approval, NJDEP may impose various conditions on soil reuse projects. One condition that is incorporated into all reuse approvals is the placement of an environmental restriction on N.J.D.O.T. R.O.W. in question. An environmental restriction essentially defines any use limitations put on a property and details the type of site controls. Such a restriction must be documented and filed with the appropriate county clerk's office. Subsection 8.6.3. defines the process and assures compliance with state regulations, clarifies and defines lines of responsibility and sets the method for archiving data.
Additionally, page 8.6.8 of Subsection 8.6.1 Policy on Cost Recovery in Acquisition of Contaminated Property has been revised.
Incorporate the following attached revisions to the Procedures Manual:
Replace Pages 8.6.8 and 8.6.9 with New Pages 8.6.8 and 8.6.9.
Add New Pages 8.6-11 through 8.6-13.
Add New Pages 8.6-31 through 8.6-37.A summary of the changes are as follows:
Subsection 8.6.1 Policy on Cost Recovery in Acquisition of Contaminated Property.
Page 8.6.8 has been revised to include the word "not" in the first sentence of the last paragraph of the subsection.Subsection 8.6.3 Procedure Addressing Contamination Left Within New Jersey Department of Transportation Right-of-Way.
New subsection addressing the procedure has been added to the Manual.Attachment 14 – Environmental Summary Memoranda.
A model Deed Notice, pages 8.6-31 through 8.6-37, has been added to Attachment 14 of the manual. The Deed Notice provides notification that contamination exists on the property, provides restrictions applicable to the property, as well as engineering and institutional controls applicable to the property.Distribution to In-House Staff and Various Public Agencies
