- Denial of Complaint-Warrant - Application for issuance of complaint-warrant was made, and judge or court officer declined to issue same but instead issued or directed issuance of complaint-summons. (4.11)
- Denial of Special Release Conditions - Specific request for the imposition of special release condition(s) is denied by the court (in those instances in which a prosecutor refrains from seeking pretrial detention only because he/she assumed the court would impose maximum release conditions). (6.4)
- Denial of Pretrial Detention - Motion for pretrial detention was filed, and court denied motion and released defendant. (7.10)
- Denial of Revocation of Release - Application for revocation of release was filed, and court denied the motion. (8.7)
- Deadline Not Met - Court determined that a deadline (speedy indictment/trial) imposed under Bail Reform Law was not met. Report to indicate:
- Reasons for delay;
- Whether court found pursuant to NJSA 2A:162-22b(2)(a) that failure to commence trial was due to unreasonable delay by prosecutor;
- Steps that were taken by prosecutor and law enforcement agencies to attempt to comply with deadlines; and
- Whether defendant was released from custody as a result. (11)
- Unauthorized Judicial Plea Offer - Without the consent of prosecutor required under R. 3:9-3(c), court advised that if defendant pleads guilty the court will impose a lesser term of imprisonment than that contemplated by plea offer tendered by prosecutor pursuant to escalating plea policy. (12.7)
- Crimes Committed on Release - Report all known instances in which a defendant, while on release, committed a crime or crimes. (15)
