Huge Appellate Division Win for the Special Hearings Unit!

ADPD Stephanie Lutz convinced the Appellate Division that the 2002 statute prohibiting certain sex offenders (aggravated sexual assault, sexual assault, etc.) from ever getting out from under Megan’s Law should not be applied retroactively.  This means that former clients can now be removed from Megan’s Law if convicted before 2002 and if they remain offense free for 15 years.  Prosecutors have consistently opposed our applications for relief until now.  Deputy Public Defender Fletcher Duddy can already identify 75 to 100 clients who will benefit from this ruling.  Big victory for the OPD!
