A goal of the Medicare Supplement Under 50 Program is to equitably spread the losses that are incurred by the contracting carrier among other carriers offering health coverage in New Jersey, within limits established by law. To achieve this goal, the Governing Board collects information about carrier market share, audits the reported losses of the Contracting Carrier, makes recommendations for assessments by market share to reimburse the audited losses, collects the assessments, then distributes funds to the Contracting Carrier. In addition, the Governing Board recommends certain underwriting standards for the program, responding as necessary to changes in federal law. However, the Commissioner of the Department of Banking and Insurance has final approval of the assessments and distributions, and promulgates regulations for the program.
