Please be advised that the Department has concluded that no further action will be taken on PRN 2006-405 (Health Benefit Plans Minimum Standards for Network-Based Health Benefit Plans Basis for Payment of Out-of-Network Non-Hospital Provider Claims).  The Department appreciates the extensive comments submitted by interested parties. 

After careful review it is evident that significant issues were raised and many parties have grave concerns about the proposal.  Consequently, the Commissioner has determined that this proposal will not be adopted at this time.  The Department will continue to closely monitor developments in the market related to the conditions which precipitated the making of the proposal and take action as needed in the future.
