At its April 8, 2004 public meeting, the Government Records Council (Council) considered the April 8, 2004 Findings and Recommendations of Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said Finding and Recommendations of the Executive Director. Therefore, the Council dismisses this complaint on the basis of the complainant’s voluntary withdrawal of the complaint.

This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New jersey within forty-five (45) days. Information about the appeals process can be obtained from the Appellate Division Clerk’s Office, Hughes Justice Complex, 25 W. Market St., PO Box 006, Trenton, NJ 08625-0006.

Recommendations of Executive Director

Mr. Edwards advised Government Records Council (GRC) Staff by phone that he received the requested documents.  The GRC Staff sent a letter on March 2, 2004 to the Complainant confirming that he received the requested documents.  In addition, the letter advised him that if the GRC received no response by March 9, 2004, the case would be closed.  The GRC received no response by March 9, 2004 to its March 2, 2004 letter. 

The Executive Director respectfully recommends that the Council dismiss the complaint because Mr. Edwards received a copy of the requested documents.

Analysis

Since the complainant has received the requested documents and voluntarily withdrew his case, a legal analysis is not needed.
