At its April 8, 2004 public meeting, the Government Records Council (“Council”) considered the April 8, 2004 Findings and Recommendations of the Executive Director, the April 8, 2004 Administrative Changes to Findings and Recommendations of Executive Director and all related documentation submitted by the parties. The Council voted to adopt the entirety of said Finding and Recommendations of the Executive Director, as amended. Therefore, the Council dismissed this complaint on the basis that there is prior pending action in the Superior Court of New Jersey.
This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New jersey within forty-five (45) days. Information about the appeals process can be obtained from the Appellate Division Clerk’s Office, Hughes Justice Complex, 25 W. Market St., PO Box 006, Trenton, NJ 08625-0006.

Administrative Changes to Findings and Recommendations of the Executiv

Findings and Recommendations of the Executive Director

Executive Director’s Findings and Recommendation

In accordance with the Open Public Records Act (“OPRA”), a complainant was filed on November 23, 2003.  The complainant requested audiotape or cd copies of all meetings of the Borough Council meetings—including executive sessions if or when they become a record available to the public.  The complainant also has a Superior Court case pending wherein he is addressing his OPRA issues.

The Executive Director respectfully recommends that the Council dismiss the case based on the fact that there is prior pending action in the Superior Court of New Jersey.

Analysis

This case is currently pending in a court of competent jurisdiction in the State of New Jersey.  Pursuant N.J.S.A. 47:1A-6, a requestor who is denied access may, at their option, bring the institute an action the Superior Court of New Jersey OR file with the Government Records Council.  The language of the statute is clear that the requestor may choose one OR the other. It is recommended that the GRC case be dismissed.
