At its March 11, 2004 public meeting, the Government Records Council (“Council”) considered the March 11, 2004 Findings and Recommendations of the Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said Findings and Recommendations to dismiss the complaint on the basis that Mr. Rothman received a copy of the requested documents and on March 1, 2004 withdrew his complaint.

Recommendations of Executive Director

Mr. Rothman received a copy of the documents that he requested on February 26, 2004. In e-mail to the Government Records Staff on March 1, 2004, he has withdrawn his Denial of Access Complaint.

The Executive Director respectfully recommends that the Council dismiss the complaint because Mr. Rothman received a copy of the requested documents and on March 1, 2004 he withdrew his complaint.

Legal Analysis

Since the complainant has withdrawn his case, a legal analysis is not needed.
