At its July 8, 2004 public meeting, the Government Records Council (Council) considered the June 25, 2004 Supplemental Findings and Recommendations of the Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said findings and recommendations. 
The Council, therefore, dismissed the case on the basis of the Complainant’s voluntary withdrawal of his complaint. This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New Jersey within forty-five (45) days. Information about the appeals process can be obtained from the Appellate Division Clerk’s Office, Hughes Justice Complex, 25 W. Market St., PO Box 006, Trenton, NJ 08625-0006.

Recommendations of the Executive Director

The Executive Director respectfully recommends that the Council dismiss the case because the Complainant has voluntarily withdrawn his complaint.

Background

The Council heard this case at its September 5, 2003 meeting. The Council recommended that the matters be referred to the Office of Administrative Law for a hearing, assembly of a record, and an Initial Decision of fact and conclusions of law pursuant to the Administrative Procedures Act. Prior to the OAL scheduling a hearing ,, the Complainant on April 21, 2004 sent written documentation stating that he was withdrawing his case.

Analysis

Due to the Complainants voluntary withdrawal, no analysis is needed.

Conclusion
