At its March 11, 2004 public meeting, the Government Records Council ("Council") considered the March 11, 2004 Findings and Recommendations of the Executive Director and all related documentation submitted by the parties. The Council voted to adopt the entirety of said Findings and Recommendations to dismiss the case based on the voluntary withdrawal of the complaint by the requestor's successor at the Herald News.

Findings and Recommendations of the Executive Director

Executive Director's Findings and Recommendation

On March 2, 2004, the requestor's successor at the Herald News stated to the GRC staff that it was withdrawing the complaint. 

On March 4, 2004, correspondence from the GRC staff was sent to the requestor acknowledging the withdrawal of the complaint and to advise that the case would be closed. 

The Acting Executive Director respectfully recommends that the Council dismiss this complaint on the basis of the requestor’s voluntary withdrawal.

Due to the requestor's voluntary withdrawal, no legal analysis is needed.
