At its March 11, 2004 public meeting, the Government Records Council (“Council”) considered the March 11, 2004 Findings and Recommendations of the Executive Director and all related documentation submitted by the parties. The Council voted to adopt the entirety of said Findings and Recommendations to dismiss the complaint based on the fact  the complainant received the requested documents and voluntarily withdrew his complaint.

Recommendations of Executive Director

Mr. Berman has obtained access to the documents that he requested. Therefore, on March 1, 2004, he has withdrawn his Denial of Access Complaint.

The Executive Director respectfully recommends that the Council dismiss the complaint because Mr. Berman has been given access to the requested documents.  Per the complainant’s March 1, 2004 fax, he has withdrawn his complaint.

Legal Analysis

Since the complainant has withdrawn his case, legal analysis is not needed.
