At its April 8, 2004 public meeting, the Government Records Council (Council) considered the April 8, 2004 Findings and Recommendations of Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said Finding and Recommendations of the Executive Director. Therefore, the Council will forego any adjudicatory action pending the outcome of mediation.

Findings and Recommendations of Executive Director

Relevant Records Requested: Various change orders, resolutions, minutes, bid documents and contracts, documents regarding the Hillside Avenue project, cash receipt book from Engineering Office and Clerk's Office, specifications of furniture and portable stages, State approval for preschool space, general fixed asset group of accounts with latest data, Township Attorney’s opinion regarding General Trust Fund 911 Memorial Fund, copies of five certifications of funds, documentation regarding Jarmel Kizel, correspondence from Tahney (business administrator), various documents on VTM, billing and payment records for Ins. Consultant, 2002 Audit Report, ISS payment and proposal documentation.

Executive Director’s Findings and Recommendation
The custodian voluntarily signed the Agreement to Mediate on February 26, 2004 and the requester did the same on March 1, 2004.  The Executive Director respectfully recommends that the Council and GRC staff forego any adjudicatory action pending the outcome of mediation.

Analysis

Pursuant to N.J.S.A. 47:1A-7(d), no legal analysis is needed at this time.
