Final Administrative Action

Barbara Schwarz
Complainant
      v.
NJ Office of Legislative Services
Custodian of Record
Complaint No. 2004-185

At its February 10, 2005 public meeting, the Government Records Council (“Council”) considered the January 31, 2005 Findings and Recommendations of the Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said findings and recommendations with the amendment that the Custodian respond to whether or not the NJ Office of Legislative Services has any publicly-accessible reports which are required by law to be submitted to the Legislative or its members pursuant to N.J.S.A. 47:1A-1.1 concerning the Complainant’s OPRA request.

The Council, therefore, finds that the case will be dismissed upon receipt of a certification from the Custodian stating whether or not the NJ Office of Legislative Services has any publicly-accessible reports which are required by law to be submitted to the Legislative or it members in response to the Complainant’s OPRA request.  The certification shall be provided to Executive Director Paul Dice by February 28, 2005.

This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New Jersey within forty-five (45) days. Information about the appeals process can be obtained from the Appellate Division Clerk’s Office, Hughes Justice Complex, 25 W. Market St., PO Box 006, Trenton, NJ 08625-0006.

Analysis

Whether the Council has jurisdiction in this matter under the Open Public Records Act:

N.J.S.A. 47:1A-7(g) states:

“The council shall not have jurisdiction over the Judicial or Legislative Branches of State Government or any agency, officer, or employee of those branches.”

The NJ Legislative Services falls under the Legislative Branch of the Government; therefore, the Government Records Council does not have jurisdiction in this matter.

Conclusions and Recommendations

The Executive Director respectfully recommends that the Council dismiss this case on the basis that pursuant to N.J.S.A. 47:1A-7(g), the Government Records Council does not have jurisdiction in this matter.
