At its April 26, 2004 public meeting, the Government Records Council (Council) considered the April 19, 2004 Findings and Recommendations of Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said findings and recommendations.  Therefore, the Council dismisses this complaint on the basis of the complainant’s voluntary withdrawal of same.

This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New Jersey within forty-five (45) days. Information about the appeals process can be obtained from the Appellate Division Clerk’s Office, Hughes Justice Complex, 25 W. Market St., PO Box 006, Trenton, NJ 08625-0006.

Findings and Recommendations of Executive Director

Relevant Records Requested: Contract between Berkeley Heights and private individual to gut and rebuild train station. Time sheets of all town workers for work done on the train station after the contractor abandoned the site. Disposition of all funds and any physical property received by Berkeley Heights for construction of a senior citizen center.

Recommendations of Executive Director

Mr. D’Angio advised the Government Records Council (GRC) Staff on April 12, 2004 that he was withdrawing the subject complaint based on the fact he received most of the requested documents, and was confident he would receive the remaining requested records. 

The Executive Director respectfully recommends that the Council dismiss the complaint based on the complainant’s voluntary withdrawal of his complaint.
