Case Disposition: On May 25, 2006, the Complainant made a request for items listed as one (1) through six (6). The first two (2) items on the list were requests for government records; items numbered four (4) and five (5) were questions, and the sixth (6th) was a statement.
On June 5, 2006 (six business days after receiving the request) the Custodian sent a letter to the Complainant informing him that the cost of the records available to him pursuant to his request would be $4.14. The Custodian also informed the Complainant that a portion of his request cannot be satisfied because it consists of questions and not documents.
Type of Administrative Disposition: Not a request for a government record
Applicable OPRA Provision: N.J.S.A. 47:1A-1.1. states that a “‘[g]overnment record’ or ‘record’ means any paper, written or printed book, document, drawing, map, plan, photograph, microfilm, data processed or image processed document, information stored or maintained electronically or by sound-recording or in a similar device, or any copy thereof, that has been made, maintained or kept on file … or that has been or received in the course of his or its official business by any such officer, commission, agency, or authority of the State or of any political subdivision thereof, including subordinate boards thereof…” (Emphasis added.)
This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New Jersey within forty-five (45) days.
