Preservation Area Boundary Description (from Act)

Boundary Description Updates

March 7, 2005
NJDEP has made been made aware of issues regarding the Highlands Preservation Area boundary and is applying the following changes:

Allamuchy State Park, Morris County Camp Pulaski, Mount Olive
(Open Space boundary update provided by Morris County)

At this location, Section 7b(1) provides:

 “thence southeasterly on International Drive North to its intersection with Waterloo Valley Road; thence easterly and southerly on Waterloo Valley Road to its intersection with Allamuchy State Park; thence easterly and southerly and westerly on the Allamuchy State Park boundary to its intersection with Lozier Road; thence easterly on Lozier Road to its intersection with Waterloo Road;”

 The geographic directions identified in bold and with underlining do not coincide with the physical direction of the indicated roadways on the ground. The clear intent of the Act was to follow the Allamuchy State Lands Boundary and run along Lozier Road to Waterloo Road.

Therefore, the Department has applied the boundary as follows:

“thence southwesterly southeasterly on International Drive North to its intersection with Waterloo Valley Road; thence westerly easterly and southerly northerly on Waterloo Valley Road to its intersection with Allamuchy State Park; thence easterly and southerly and westerly on the Allamuchy State Park boundary to its intersection with Lozier Road; thence easterly on Lozier Road to its intersection with Waterloo Road;”

Future Open Space in the Highlands Region

Where the Highlands Act refers to the boundary of the Highlands Preservation Area as a particular open space property (i.e. park or wildlife management area) please note that the boundary will be defined as it existed on the date of enactment of the Highlands Act, that is August 10, 2004. The subsequent addition of parcels to an open space property through acquisition or deed restriction shall not alter the Highlands Preservation Area boundary.

 Roadways and Natural Features as Boundaries

The Department also seeks to reiterate the language in the Act at Section 7b(2) that “any natural geographic feature, including a river, stream, or brook used… for the boundary description of the preservation area shall be considered to lie totally within the preservation area and any road, railroad, or railroad right of way used…for the boundary description of the preservation area boundary shall be considered to lie totally outside of the preservation area”.

 Requests for changes to the Highlands Map

The Department will consider written requests from the public that identify errors in either the boundary description language as it appears in the Act or in the Highlands Preservation and Planning Area i-Map. Please submit all requests in writing to:
