Neglected Set Aside

Title I, Part A Neglected Allocation

School districts in proximity to facilities for students categorized under the federal definition of "neglect" are eligible for an additional allocation under Title I, Part A—the "neglect set-aside." Students who are resident in locally-run facilities of this type generate additional dollars for the LEA's in which they are located, since their residents may attend school in the LEA on a temporary or ongoing basis.

The additional allocation should be considered as part of your Title I, Part A funding for planning and budgeting purposes, and be used along with the rest of the program funds for services to eligible students in the district schools, under the Title I, Part A guidelines.

Federal law mandates that student residents in locally-run neglect facilities that attend school in districts where their facilities are located must be provided with the same services as any other Title-I eligible student. LEA's may opt to partner with neglected facilities in their borders in order to offer special programs in the facility or district-wide, however, this is not a requirement under the federal law.

Title I, Part D: Prevention and Intervention Programs for Children and Youth Who Are Neglected, Delinquent or At Risk (N or D)

  • Improve educational services for children and youth who are N or D so that they have the opportunity to meet the same challenging State academic standards that all children in the State are expected to meet;
  • Provide youth who are N or D with services so that they can successfully transition from institutionalization to further education or employment; and
  • Prevent at-risk youth from dropping out of school and provide youth who have dropped out and youth returning from correctional facilities or N or D institutions with a support system to ensure continued education and the involvement of their families and communities.1

Subpart 1 funds are allocated by formula from the U.S. Department of Education (USED) to the New Jersey Department of Education (NJDOE).  NJDOE makes subgrants to the New Jersey Juvenile Justice Commission, Department of Corrections and Department of Children and Families.

Subpart 2 requires NJDOE to reserve, from its Title I allocation, funds generated by the annual caseload data of the number of children and youth living in local facilities for delinquent children and county correctional facilities.  The NJDOE awards the funds to the local educational agencies that are associated with the locally run correctional facility.

In addition to the TIPD goals, the facilities receiving funds must annually evaluate their program participation and use the data to plan and improve programming.
