On July 29, 2011, New Jersey-American Water Inc., filed a petition with the New Jersey Board of Public Utilities seeking a rate increase of $95.5 million or approximately 15.5% over pro-forma present rate revenues of $565 million. The actual percentage increases applicable to specific customers will vary according to the applicable rate schedule and level of each customer's usage. The Company also proposes to implement a Conservation Plan Tracker and Water Efficiency Tracker in support of its proposed conservation plan.

Petition of United Water New Jersey for Authority to Issue and Sell up to $75 Million Dollars Principal Amount Taxable Bonds, BPU Docket No. WF10120914
On December 6, 2010, United Water New Jersey submitted a petition to the Board of Public Utilities seeking authority to issue up to $75,000,000 in long-term debt. The net proceeds from the sale and delivery of the Bonds will be applied to the redemption of $40 million of the Company’s tax-exempt First Mortgage bonds; $26 million worth of short-term debt; and $9 million of preferred stock.

Petition of United Water New Jersey Inc. for Approval of an Increase in Rates for Water Service and Other Tariff Changes, BPU Docket No. WR09120987
On December 9, 2009, United Water New Jersey filed a petition with the New Jersey Board of Public Utilities seeking approval for an increase in rates for water service of 21.3%, or approximately $37.8 million in additional revenues per year. In addition, the petition also seeks to establish a Distribution System Improvement Charge and an Energy and Chemicals Cost Adjustment Clause. Under United's proposal, a residential customer using an average of about 22,000 gallons of water per quarter will see his or her bill increase from $115.70 to $144.94, an increase of $28.24 per quarter of 25.3%.

I/M/O New Jersey-American Water Company for Authorization to Implement a Distribution System Improvement Charge ("DSIC"), BPU Docket No. WO08050358
On May 23, 2008, New Jersey American Water Company filed a Petition with the New Jersey Board of Public Utilities seeking approval of a Distribution System Improvement Charge (DSIC). The DSIC as currently proposed will result in self implementing, provisional rate adjustments each calendar quarter to customer bills to recover the cost for water and sewer system improvements. The Company proposes to apply the DSIC as a percentage of each customer’s bill and that percentage will not exceed 7.5% of the Company’s gross revenues from the prior year, exclusive of DSIC charges.

Aqua New Jersey performed a true-up comparing actual revenues and expenses for the 2006 calendar year and determined that there was an over-recovery, including the estimated costs of this proceeding, of $15,034 for 2006. As a result of this analysis, Aqua New Jersey Inc. has concluded that an adjustment should be made in the tariff rates.

On July 17, 2007, East Coast Oakwood Apartment Sewage, LLC, filed a petition to acquire a one hundred percent (100%) ownership in Oakwood Village Sewerage Associates, L.L. C, a public utility regulated by the Board. The Petition was filed to facilitate a much larger transaction whereby East Coast Residential Associates and affiliated entities, will be purchasing eighty-six major rental properties from Westminster Management and affiliated entities. The majority of these rental properties are located in New Jersey, including the Oakwood Village Apartments complex, in Mount Olive Township, Morris County, New Jersey, which receives sewer service from Oakwood Village.

Lawrenceville Water Company which serves approximately 2,600 customers in Lawrence Township on January 31, 2007 filed a Petition before the Board of Public Utilities seeking approval for an increase in rates of $438,928 or approximately 47.91% in additional revenues per year. Lawrenceville is seeking financing to enable it to undertake a capital program to install two generators for emergency situations, to replace 2 inch water mains with 6 inch water mains and replace telemetric equipment that coordinates replenishment of water tower levels. The Company represents that the proposed rate increase will support the required capital improvement program.

Wallkill Sewer Company which serves 315 customers in Hardyston Township on May 23, 2006 filed a Petition for approval of a Purchased Sewerage Treatment Adjustment Clause true-up for calendar years 2004 and 2005. Wallkill’s sewage is treated by the Sussex County Municipal Utilities Authority. The increase is a pass through of charges to Wallkill from the Sussex County Municipal Utilities Authority. Wallkill in its filing is proposing a net over recovery combining 2004 and 2005 that will result in a refund to each of Wallkill’s 315 customers in the amount of $84.35 plus interest at 6% per year, a total annual refund of $89.41.
Rate Counsel is reviewing the matter. A public hearing was held on January 31, 2007 at the Wallkill Valley High School where members of the public were able to voice their concerns.
