A regular meeting of the Merit System Board was held on
Wednesday, February 14, 2001, in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz, Merit System Board
Members, Alan Dexter Bowman, and Leo Vartan; Andrea Grundfest,
Deputy Attorney General; and Henry Maurer, Director, Division of
Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Janice Mitchell
Mintz opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on November 30, 2000, and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE

ACTION: The Merit System Board acknowledged the
settlements.

A-2 SAMUEL BADIE

Samuel Badie, Human Services Assistant, Ancora Psychiatric
Hospital, Department of Human Services, resignation not in
good standing, on charges of abandonment of position for
five or more consecutive business days without approval and
suspension for 15 days on charges of excessive absenteeism.

Recommendation of the Administrative Law Judge - Uphold the
resignation not in good standing and the 15-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-3 WILLIAM BURKERT

William Burkert, County Correction Officer, County of Union,
Department of Public Safety, suspension for 15 days, on
charges of insubordination and conduct unbecoming a public
employee.

Recommendation of the Administrative Law Judge - Uphold the
15-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-4 EDWARD O'LONE

The Department of Human Services, represented by Robert H.
Stoloff, Assistant Attorney General, requests that the Board
make a determination as to the amount of back pay due to
Edward O'Lone as a result of the Board's decision issued
July 3, 1997, granting him back pay.

Recommendation of the Administrative Law Judge - Claim for
back pay denied.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge. The Board denied
the request for back pay through April 29, 1997,
but awarded back pay from April 30, 1997 through
the date of reinstatement and granted
reimbursement of expenses for the maintenance of
health insurance.

A-5 PATRICK ZICARO

Patrick Zicaro, Sheriff's Officer, County of Essex,
Sheriff's Office, suspension for 12 days, on charges of
conduct in public and private, acts or omissions;
disparaging nationality, race or creed; conduct; unfavorable
conduct; language, indecent language, duty time, criminal
law violation and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Modify the
12-day suspension to a 10-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-6 SALO ROOPNARINE

Salo Roopnarine, Institutional Trade Instructor 1, Needle
Trades, Northern State Prison, Department of Corrections,
removal effective January 7, 1999, on charges of undue
familiarity with an inmate, engaging in financial
transactions with an inmate, and violation of prison rules.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-7 BENJAMIN WHITLEY

Benjamin Whitley, Police Sergeant, City of Jersey City,
Police Department, suspension for 58 days and removal
effective January 30, 1998, on charges of obedience of
rules, narcotics use and instructions for department
reporting off sick.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to uphold the
removal as effective December 4, 1997 at the
beginning of the 58-day suspension.

A-8 CHRISTOPHER EUTSEY

Christopher Eutsey, Senior Security Guard, Newark School
District, removal effective September 7, 1998, on charges of
chronic or excessive absenteeism or lateness and conduct
unbecoming a public employee.

Recommendation of the Administrative Law Judge - Modify the
removal to a 30-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

SECTION B - MISCELLANEOUS MATTERS

B-1 AMORETTE DANIELS

Amorette Daniels appeals her rejection as a Police Officer
candidate by the City of Camden and its request to remove
her name from the eligible list for Police Officer on the
basis of psychological unfitness to perform effectively the
duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-2 JERRY GUSTOSO, II

Jerry Gustoso, II, represented by Joel G. Scharf, Esq.,
appeals his rejection as a Police Officer candidate by the
City of Hoboken and its request to remove his name from the
eligible list for Police Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-3 WARREN M. REVAS-GUEVARA

Warren M. Revas-Guevara, represented by Fayth A. Ruffin,

Jeffrey D. Villee, a Senior Building Maintenance Worker with
the Department of Law and Public Safety, Division of State
Police, represented by M. Scott Tashjy, Esq., appeals the
denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be denied.

B-23 WINNIE BOEN

Winnie Boen, a Supervising Family Service Specialist I with
the Division of Youth and Family Services, Department of
Human Services, appeals the decision of the Assistant
Commissioner for Human Resources, Department of Human
Services, which found that there was not sufficient evidence
to establish that she had been discriminated against on the
basis of her age or gender or that an act of reprisal was
taken against her.

She also petitions the Merit System Board to reconsider the
decision denying a hearing on her non-contractual grievance
of a written warning she received on June 2, 1997 for
neglect of duty. Further, she requests that the Board
review two other matters: an official reprimand for
insubordination in connection with an incident that occurred
on October 17, 1997, and a non-contractual grievance for an
involuntary reassignment.

ACTION: The Merit System Board directed that these appeals
be denied.

B-24 LAWRENCE BRITTON

Lawrence Britton, a Supervising Administrative Analyst at
the Office of Information Systems, Department of Human
Services, appeals the determination of the Assistant
Commissioner for Human Resources, stating that the appellant
failed to present sufficient evidence to support a finding
of probable cause that he had been discriminated against
based on his age.

ACTION: The Merit System Board directed that this matter
be held over.

B-25 WILLIAM CAPARAZZO

William Caparazzo, a Plumbing Subcode Official with the City
of Orange, represented by Kevin P. McGovern, Esq., petitions
the Merit System Board
for relief, pursuant to N.J.S.A. 11A:2-24 and N.J.A.C. 4A:2-
5.1, et seq., from alleged reprisal by his employer.

ACTION: The Merit System Board directed that this appeal
be held over.

B-26 JOHN D'AURIA

John D'Auria appeals the decision of Selection Services
which found that the appointing authority had presented a
sufficient basis to remove his name from the eligible list
for Police Officer (S9999V), City of Newark, for failure to
meet the age requirement for this position.

ACTION: The Merit System Board directed that this matter
be held over.

B-27 CARMINE DEVONE

The Department of Corrections appeals the decision of
Selection Services restoring Carmine DeVone's name to the
Correction Officer Recruit (S9999W) eligible list.

ACTION: The Merit System Board directed that this appeal
be granted and the ordered that the eligible's
name be removed from the list.

B-28 NORMAN GAINEY, JR.

The Department of Corrections appeals the decision of
Selection Services restoring Norman Gainey, Jr.'s name to
the Correction Office Recruit (S9999W) eligible list.

ACTION: The Merit System Board granted the appeal and
ordered that the eligible's name be removed from
the list.

B-29 MARK A. JOHNSON

Mark A. Johnson, represented by Eldridge Hawkins, Esq.,
appeals the decision of Selection Services which found that
the appointing authority had presented a sufficient basis to
remove his name from the eligible list for Police Officer
(S9999V), City of Newark, on the basis of an unsatisfactory
driving record.

ACTION: The Merit System Board directed that this matter
be held over.

B-30 DAVID J. MORAN

David J. Moran, represented by Anthony J. Fusco, Jr., Esq.,
appeals the determination of Selection Services which upheld
the bypass of his name for appointment from the Police
Sergeant (PM3229S), Township of Nutley eligible list.

ACTION: The Merit System Board granted a hearing.

B-31 STEPHEN NOE

Stephen Noe, represented by Lee J. Hughes, Esq., appeals the
decision of Selection Services which found that the
appointing authority had presented a sufficient basis to
remove his name from the eligible list for Correction
Officer Recruit (S9999W), Department of Corrections on the
basis of an unsatisfactory driving record.

ACTION: The Merit System Board directed that this matter
be held over.

B-32 WAYNE STINSON

The Department of Corrections (DOC) appeals the decision of
Selection Services which found that it did not present a
sufficient basis to remove Wayne Stinson's name from the
Correction Officer Recruit (S9999W) eligible list on the
basis of an unsatisfactory driving record.

ACTION: The Merit System Board directed that this appeal
be granted and the ordered that the eligible's
name be removed from the list.

B-33 CORNEL SUGGS

The Department of Corrections appeals the decision of
Selection Services restoring Cornel Suggs' name to the
Correction Officer Recruit (S9999W) eligible list.

ACTION: The Merit System Board directed that this appeal
be granted and the ordered that the eligible's
name be removed from the list.

B-34 JORGE TEIXEIRA

Jorge Teixeira, represented by Anthony J. Fusco, Jr., Esq.,
appeals the decision of Selection Services which found that
the appointing authority had presented a sufficient basis to
remove his name from the eligible list for Police Officer
(S9999V), City of Newark, on the basis of an unsatisfactory
driving record.

ACTION: The Merit System Board directed that this matter
be held over.

B-35 CEDRIC THOMAS

Cedric Thomas, represented by Anthony J. Fusco, Jr., Esq.,
appeals the decision of Selection Services which found that
the appointing authority had presented a sufficient basis to
remove his name from the eligible list for Police Officer
(S9999V), City of Newark, on the basis of an unsatisfactory
driving record.

ACTION: The Merit System Board directed that this appeal

B-36 ROBERT MCGOWAN

Robert McGowan, a Laborer with the Township of Middletown,
represented by David F. Corrigan, Esq., petitions the Merit
System Board for interim relief of his immediate suspension,
effective November 27, 2000.

ACTION: The Merit System Board denied the request.

B-37 SPENCER SCOTT

Spencer Scott, a former County Correction Officer with the
Gloucester County Sheriff's Office, represented by Anthony
J. Fusco, Jr., Esq., petitions the Merit System Board for
interim relief of his immediate suspension, effective August
18, 1999. This matter was held over from the January 30,
2001 Board meeting for further review.

ACTION: The Merit System Board granted a hearing.

B-38 JACQUELINE WALKER

Jacqueline Walker, a Family Service Specialist 3 with the
Division of Youth and Family Services, Department of Human
Services, represented by Kirk D. Rhodes, Esq., petitions the
Merit System Board for a stay of her two removals, effective
December 29, 2000 and December 30, 2000, pending the outcome
of her hearings on these matters at the Office of
Administrative Law.

ACTION: The Merit System Board denied the request.

B-39 INGRID BAIRD

Ingrid Baird, a former Police Officer with the Township of
North Bergen, appeals her resignation in good standing.

ACTION: The Merit System Board directed that this appeal
be denied.

B-40 JOHN S. SABOSKI

John S. Saboski, a former Maintenance Worker 1,
Transportation with the Department of Transportation,
appeals his resignation in good standing.

ACTION: The Merit System Board directed that this appeal
be denied.

B-41 RICHARD ELLIS

Richard Ellis, represented by Kevin M. Costello, Esq, seeks
enforcement of that part of the Merit System Board decision
rendered on May 9, 2000, which found him medically fit to
perform the duties of a Police Officer and which restored
his name to the Police Officer (S9999W), City of Camden
eligible list.

ACTION: The Merit System Board denied the request for
enforcement and ordered that the eligible's name
be removed from the list.

B-42 PETER MATHUS

The City of Jersey City (City), represented by Carmine J.
Scarpa, Assistant Corporation Counsel, requests
reconsideration of the final decision of the Merit System
Board, rendered October 11, 2000, which modified the removal
imposed by the City against Peter Mathus, a Range
Instructor, with the City Police Department, to a six-month
suspension.

ACTION: The Merit System Board denied the request.

B-43 ROBERT SANTINI

Robert Santini, a Painter with the Division of Property
Management and Construction, Department of the Treasury,
petitions the Merit System Board for reconsideration of its
final administrative decision, rendered on June 21, 1999,
which found that Santini's removal was justified.

ACTION: The Merit System Board denied the request.

B-44 CAMILLA JOHNSON

The County of Middlesex and Camilla Johnson request
acknowledgement of an amended settlement agreement, that
modifies an earlier settlement and fully resolves the matter
of Ms. Johnson's appeal of her August 28, 1997 removal from
the Middlesex County Department of Human Services and the
issue of approved pension service time.

ACTION: The Merit System Board directed that this matter
be held over.

B-45 KAREN BREVOGEL

The appeal of Karen Brevogel, a Senior Practical Nurse at
Buttonwood Hospital, Burlington County, of her removal
effective April 22, 1998 on charges, was heard by
Administrative Law Judge M. Kathleen Duncan (ALJ), who
rendered her initial decision on July 10, 2000, modifying
appellant's removal to a 90-day suspension. At its meeting
on January 17, 2001, the Merit System Board did not adopt
the ALJ's recommendation. Rather, the Board ordered that
the matter be remanded to the Office of Administrative Law.
The proposed decision is now submitted for the Board's
review.

ACTION: The Merit System Board adopted the decision.

B-46 JANE RICHARDS-MERCADO

Jane Richards-Mercado, a Purchasing Agent with the City of
Hoboken, seeks enforcement of that part of the Merit System
Board decision rendered on October 8, 1998, granting her
back pay and benefits. The matter was heard by
Administrative Law Judge Arnold Samuels (ALJ), who rendered
his initial decision on November 13, 2000. At its meeting
on January 17, 2001, the Board ordered that this matter be
remanded to the Office of Administrative Law for further
clarification. The proposed decision is now submitted for
the Board's review.

ACTION: The Merit System Board adopted the decision.

B-47 LISA SANSBURY

The appeal of Lisa Sansbury, a Human Services Technician
with Ancora Psychiatric Hospital, Department of Human
Services, of her 10-day suspension on charges, was heard by
Administrative Law Judge Robert S. Miller (ALJ), who
rendered his initial decision on December 7, 2000. At its
meeting on January 17, 2001, the Merit System Board (Board)
did not adopt the ALJ's recommendation to uphold the 10-day
suspension. Rather the Board determined that a five-day
suspension was warranted. The proposed final decision is
now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-48 DRUCELLA SHANNON

The appeal of Drucella Shannon, a Receptionist/Telephone
Operator at the Cumberland Manor, Cumberland County, of her
removal effective December 22, 1999 on charges, was heard by
Administrative Law Judge Lillard E. Law (ALJ), who rendered
his initial decision on December 8, 2000, upholding the
removal. At its meeting on January 17, 2001, the Merit
System Board adopted the ALJ's recommendation. The proposed
final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-49 BRIAN ANDERSON

Brian Anderson appeals his ineligibility for the Entry Level
Law Enforcement examination (S9999B).

ACTION: The Merit System Board directed that this appeal
be denied.

B-50 INEZ D. ANDERSON

Inez D. Anderson appeals the determination of the Division
of Selection Services, which found that she did not meet the
education requirement for the open competitive examination
for Field Representative, Disease Control (M1428B), Jersey
City.

ACTION: The Merit System Board directed that this appeal
be granted.

B-51 MICHAEL ANDERSON

Michael Anderson appeals the determination of the Division
of Selection Services which found that he did not meet the
experience requirements for the open competitive examination
for Deputy County Emergency Management Coordinator,
(C6028B), Burlington County.

ACTION: The Merit System Board directed that this appeal
be granted.

B-52 KERRY BRENNAN, ET AL.


Kerry Brennan, Kharizma Johnson, Carol McLaughlin, Jennifer
Schubert, and Carroll Ward appeal the determination of the
Division of Selection Services that they did not meet the
educational requirements for the examination for
Habilitation Plan Coordinator (S0519B).
