    A regular meeting of the Civil Service Commission was held on Wednesday, January 15, 2020, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamula Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 13, 2019, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    WILFREDO GUZMAN

 

Wilfredo Guzman, Police Officer, Rockaway Township, Police Department, removal effective April 24, 2017, on charges of incompetency, inefficiency, or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law JudgeDeny the motion for summary decision and reverse the fine.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    RICHARD MORALES

 

Richard Morales, Supervising Plumber, Newark School District, removal effective March 4, 2019, on charges of conduct unbecoming a public employee, insubordination and other sufficient cause.

 

Recommendation of the Administrative Law JudgeModify the removal to a 30 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    KIMMICA PANNELL

Brian Pio, County Correction Officer, Salem County, Sheriff’s Office, removal effective July 19, 2019, on charges conduct unbecoming a public employee, violation of rules and regulations and other sufficient cause.

Recommendation of the Administrative Law JudgeUphold the removal.

 

ACTION:    The Civil Service Commission modified the Administrative Law Judge’s recommendation to uphold the removal and imposed a six-month suspension.

 

A-8    DANIEL SKRABONJA

 

Daniel Skrabonja, Senior Correctional Police Officer, Bayside State Prison, Department of Corrections, removal effective February 14, 2017, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1    ASSOCIATE MEDICAL EXAMINER – CSC DOCKET NO. 2020-1630

 

          The Division of Agency Services requests the establishment of the unclassified title of Associate Medical Examiner for use in the Department of Health.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-2    G.D. – CSC DOCKET NO. 2019-1654

 

          G.D., represented by Giovanna Giampa, Esq., appeals his rejection as a Police Officer candidate by the City of Jersey City and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    F.S. – CSC DOCKET NO. 2019-1899

 

          F.S., represented by Giovanna Giampa, Esq., appeals his rejection as a Police Officer candidate by the City of Jersey City and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:     The Civil Service Commission directed that the appellant be referred for an independent psychological evaluation.

 

B-4    RODRIGO ALEXANDER – CSC DOCKET NO. 2019-2160

 

          Rodrigo Alexander, represented by Christopher J. O’Rourke, Esq., appeals his removal from the Correctional Police Officer (S9988U), Department of Corrections eligible list on the basis of an unsatisfactory driving record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    CALVIN COSENTINO – CSC DOCKET NO. 2020-660

 

          Calvin Cosentino, appeals the removal of his name from the eligible list for Fire Fighter (M1557T), North Hudson Fire and Rescue on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-6    WAYNE HAMPTON – CSC DOCKET NOS. 2019-2735, ET AL.

 

          Wayne Hampton appeals the removals of his name from the County Correction Officer (S9999U), Essex County, eligible list on the basis of an unsatisfactory background report, and from the Police Officer (S9999U), City of East Orange, and Police Officer (S9999U), City of Orange Township eligible lists on the basis of an unsatisfactory driving record.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-7    ELIAS SALEH, JR. – CSC DOCKET NO. 2019-2034

 

          Elias Saleh, Jr., represented by Stuart J. Alterman, Esq., appeals the removal of his name from the Sheriff’s Officer (S9999U), Hudson County eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be granted but the appellant’s name be reflected as bypassed on the subject certification.

 

B-8    STEPHEN VENTURA – CSC DOCKET NO. 2020-187

 

          Stephen Ventura, represented by Craig S. Gumpel, Esq., appeals the removal of his name from the eligible list for Fire Fighter (M1556T), Newark, on the basis of an unsatisfactory background.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    CALVIN WILLIAMS – CSC DOCKET NO. 2020-375

 

          Calvin Williams appeals the removal of his name from the eligible list for Fire Fighter (M1556T), Newark on the basis that he was no longer interested.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10  GEORGE MUNDO AND GUILLERMO MARCIAS – CSC DOCKET NOS. 2020-632 AND 2020-633

 

          The City of West New York petitions the Civil Service Commission for the revival of the eligible list for Police Lieutenant (PM1514R) in order to acknowledge a settlement agreement, which provides for retroactive regular appointments for George Mundo and Guillermo Macias, effective January 28, 2017.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-11  THOMAS MARTIN – CSC DOCKET NO. 2020-1195

 

          Thomas Martin appeals the decision of the Division of Agency Services which found that his position with the Department of Corrections is properly classified as Accountant 1. The appellant seeks a Section Supervisor, Fiscal Resources job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12  LISA SHUMARD – CSC DOCKET NO. 2020-1335

 

          Lisa Shumard appeals the decision of the Division of Agency Services which found that her position with the Department of Corrections is properly classified as Classification Officer 2. The appellant seeks a Classification Officer 3 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13  CLERK 2, BILINGUAL IN SPANISH/ENGLISH (M0209W), LAKEWOOD TOWNSHIP – CSC DOCKET NO. 2020-1109

 

          Lakewood Township requests permission not to make an appointment from the October 29, 2018 certification for Clerk 2, Bilingual in Spanish/English (M0209W), Lakewood Township.

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-14  KEYBOARDING CLERK 3 (M1098W), UNION TOWNSHIP – CSC DOCKET NO. 2020-1398

 

          Union Township requests permission not to make an appointment from the August 26, 2019 certification for Keyboarding Clerk 3 (M1098W), Union Township.

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

ACTION:     The Civil Service Commission directed that this appeal be denied.

          Todd Giallella appeals the decision of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Administrative Analyst 3, Fiscal Management (PS9943U), Department of the Treasury.

 

ACTION:    The Civil Service Commission directed that this appeal be denied and the matter of the appellant’s position classification be referred to Agency Services for review.

 

B-21  TAMMY HANAK AND SHAKIA MCCLINTON – CSC DOCKET NOS. 2020-1420 AND 2020-1383

 

          Tammy Hanak and Shakia McClinton appeal the decisions of the Division of Agency Services that, per the substitution clause for education, they did not meet the experience requirements for the promotional examination for Fiscal Analyst (PS9768U), Department of the Treasury.

 

ACTION:    The Civil Service Commission directed that these appeals be denied and the matter of the appellants’ position classifications be referred to Agency Services for review.

          Gregory Bradley appeals the determination of the Division of Administrative Services which denied him a make-up of the physical performance portion of the examination for Fire Fighter (M1860W), Ocean City.

B-34  JAMES DEROSE – CSC DOCKET NO. 2020-1437

 

          The Division of Agency Services requests a relaxation of N.J.A.C. 4A:4-7.6(c)4, on behalf of the Department of Transportation, to enable the lateral title change of James DeRose, a Section Chief, to the title of Section Chief, Planning.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-35  OVERTIME PROGRAM, DEPARTMENT OF LAW AND PUBLIC SAFETY, DIVISION OF STATE POLICE – CSC 2020-1614

 

          The Division of Agency Services, on behalf of the Department of Law and Public Safety (DL&PS), Division of State Police, Office of Forensic Sciences, requests that the provisions of N.J.A.C. 4A:3-5.3 be relaxed to provide individuals in the non-limited, non-exempt titles of Forensic Scientist 1, DL&PS and Forensic Scientist 2, DL&PS, cash compensation at one and one-half times the regular rate for hours worked between 35 and 40 hours.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-36  VICTOR KLYMENKO – CSC DOCKET NO. 2020-1384

 

          The Borough of Roselle requests the retroactive intergovernmental transfer of Victor Klymenko, an Economic Development Representative 4, from the City of Paterson to Roselle.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-37  RODNEY K. WILLIAMS – CSC DOCKET NO. 2019-82

 

          Rodney K. Williams, a Senior Correctional Police Officer with the Department of Corrections, represented by Nathan Van Embden, Esq., requests a waiver of an overpayment of his vacation time entitlements, pursuant to N.J.S.A. 11A:3-7, which provides that when an employee has erroneously received a salary overpayment, the Civil Service Commission may waive repayment based on a review of the case.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-38  DARSI BEAUCHAMP – CSC DOCKET. NO. 2020-1030

 

          Darsi Beauchamp, a Program Development Specialist, Community Service with Morris County, Department of Human Services, petitions the Civil Service Commission for reconsideration of the administrative decision, rendered on August 28, 2019, in which the Director of the Division of Appeals and Regulatory Affairs denied her request for a hearing with respect to her removal.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-39  LOURDES MATEO-CASANOVA – CSC DOCKET NO. 2020-845

 

          Lourdes Mateo-Casanova, a Judiciary Clerk 2 with the Judiciary, Passaic Vicinage, requests that the Civil Service Commission reinstate the appeal of her release at the end of the working test period, which was dismissed based on her failure to appear at the scheduled settlement conference.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-40  F.M. – CSC DOCKET NO. 2020-571

 

          F.M., a former Deputy Executive Director with the Juvenile Justice Commission, represented by Loryn M. Lawson, Esq., appeals the decision of the Counsel to the Attorney General, which found sufficient evidence to support a finding that he violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-41  C.R. – CSC DOCKET NO. 2018-1843

 

          C.R., represented by Frank C. Cioffi, Esq., appeals his rejection as a Police Officer candidate by the Sayreville Police Department and its request to remove his name from the eligible list for Police Officer (S9999R), Sayreville on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-42  W.L.W. – CSC DOCKET NO. 2019-3277

 

          W.L.W. appeals her rejection as a Correctional Police Officer by the Department of Corrections and its request to remove her name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

          Jeanie Dansbury appeals the determination of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for Management Assistant (PS9725N), Department of Labor and Workforce Development.

 

ACTION:     The Civil Service Commission directed that this appeal be denied and the appellant be returned to her permanent title.

          Rose Marie DeBlasio appeals the decision of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for Management Assistant (PS9919N), Department of Labor and Workforce Development.
