    A regular meeting of the Civil Service Commission was held on Wednesday, February 2, 2022, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2021, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of January 19, 2022.

 

ACTION:      The Civil Service Commission adopted the minutes of its meeting of January 19, 2022.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Ryan DeForge, Truck Driver Heavy, Little Egg Harbor, Department of Public Works, removal.

A-2    RYAN MCHUGH – CSC DOCKET NO. 2021-128

 

Ryan McHugh, County Correctional Police Lieutenant, Burlington County Jail, 14 working day suspension and demotion to County Correctional Police Sergeant, effective June 21, 2020, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the 14 working day suspension and demotion to County Correctional Police Sergeant.  

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    KEVIN O’CONNOR – CSC DOCKET NO. 2020-1522

 

Kevin O’Connor, Sheriff’s Officer, Union County, Sheriff’s Office, removal effective May 17, 2018, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee and other sufficient cause.    

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    JASMINE BUSSEY – CSC DOCKET NO. 2022-891

 

Jasmine Bussey appeals the decision to remove her name from the Correctional Police Officer (S9999A), Department of Corrections eligible list on the basis of an unsatisfactory driving record and falsification of the employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    KAREEM GREENE – CSC DOCKET NO. 2022-770

 

Kareem Greene appeals the decision to remove his name from the County Correctional Police Officer (S9999U), Essex County, eligible list on the basis of falsification of the employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    VERONICA ALFORD – CSC DOCKET NO. 2020-1105

 

Veronica Alford appeals the determination of the Division of Agency Services that her application was incomplete, and her eligibility could not be determined for the promotional examination for Cottage Training Technician (PS5321K), Hunterdon Developmental Center.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    JAMES ANDERSON, JR. – CSC DOCKET NO. 2022-803

 

James Anderson, Jr., appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Technical Assistant 1 (PS5505H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

 

B-5    MICHAEL DACOSTA-MEACHEM AND ILIANA PERALTA – CSC DOCKET NOS. 2022-755 AND 2022-754

 

Michael DaCosta-Meachem and Iliana Peralta appeal the determinations of the Division of Agency Services which found that they were below the minimum requirements in experience for the open competitive examination for Principal Account Clerk (M0208C), Jersey City.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-6    HEATHER HAINES – CSC DOCKET NO. 2022-1035

 

Heather Haines appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Principal Account Clerk (PC4350C), Burlington County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    DARLENE HERRING – CSC DOCKET NO. 2022-869

 

Darlene Herring appeals the determination of the Division of Agency Services which found that she did not meet, per the substitution clause for education, the experience requirements for the promotional examination for Assistant Administrative Analyst (PM4204C), Trenton.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    ELIZABETH JAMES – CSC DOCKET NO. 2022-900

 

Elizabeth James appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the open competitive examination for Management Assistant (M0252C), Trenton.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-9    ARAVIND KRISHNA – CSC DOCKET NO. 2022-669

 

Aravind Krishna appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the open competitive examination Veterans Services Officer (C0143C), Passaic County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10   DONNETTA SHABAZZ – CSC DOCKET NO. 2022-734

 

Donnetta Shabazz appeals the determination of the Division of Agency Services which found that she did not meet the minimum educational and experience requirements for the promotional examination for Supervisor of Billing and Collecting (PM3365C), Trenton.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11   JESSICA SCHUTTE – CSC DOCKET NO. 2022-952

 

Jessica Schutte appeals the decision of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the open competitive examination for Management Specialist (M0257C), Paterson.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12   ALEXANDRE GABLER – CSC DOCKET NO. 2022-364

 

Alexandre Gabler appeals his final average and rank on the eligible list for Librarian 3 (PM4239C), Woodbridge Library.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13   NANCY AQUINO, ET AL. – CSC DOCKET NOS. 2022-701, ET AL.

 

Nancy Aquino, Elizabeth Black, Carmen Cruz, Sheena Johnson-Rolax, Patricia Neil, Shannon Reeves and Aisha Robinson-James appeal the decisions of the Division of Agency Services (Agency Services) which found that their positions are properly classified as Human Services Specialist 2 (HSS2). Hien Huynh appeals the decision of Agency Services which found that his position is properly classified as HSS2, Bilingual in Vietnamese and English. They seek classifications of Human Services Specialist 3.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

  

B-14   ERICCA GREENE – CSC DOCKET NO. 2022-858

 

Ericca Greene appeals the decision of the Division of Agency Services which found that her position with the Department of the Treasury is properly classified as a Conferee 1, Taxation. She seeks a classification of Dispute Resolution Specialist 2.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15   KENNETH HYLAND – CSC DOCKET NO. 2022-859

 

Kenneth Hyland appeals the decision of the Division of Agency Services that the proper classification of his position with the Office of Information Technology is Technical Support Specialist 1. He seeks a classification of Administrative Analyst 3, Information Systems.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-16   ASHLEY MCCORMICK – CSC DOCKET NO. 2022-857

 

Ashley McCormick appeals the decision of the Division of Agency Services that the proper classification of her position with the Department of the Treasury is Pensions Benefits Specialist 1. She seeks a classification of Pensions Benefits Specialist 2.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-17   ALBERT GONZALEZ, JR. – CSC DOCKET NO. 2022-831

 

Albert Gonzalez, Jr., represented by Marc A. Calello, requests reconsideration of In the Matter of Albert Gonzalez, Jr. (CSC, decided September 22, 2021) where the Civil Service Commission denied his appeal to remove his name from the Fire Fighter (M1844W), Jersey City eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-18   JAMIE VAN SYCKLE – CSC DOCKET NO. 2022-949

 

Jamie Van Syckle, an Assistant Family Service Worker 2, with the Department of Children and Families, represented by Todd J. Gelfand, Esq., petitions the Civil Service Commission for interim relief of her removal, effective June 16, 2021.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-19   DONALD BOICE – CSC DOCKET NO. 2022-708

 

Donald Boice, a Police Sergeant with Wildwood, and Wildwood request that Boice be given a retroactive appointment date of July 7, 2020, based on administrative error. Boice and Wildwood also request that Boice be admitted to the promotional examination for Police Lieutenant (PM4192C), Wildwood.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-20   NICHOLAS DEFALCO AND DORIAN MINOND – CSC DOCKET NOS. 2022-656 AND 2022-657

 

Nicholas DeFalco and Dorian Minond, Police Sergeants with the City of New Brunswick, represented by Brian J. Manetta, Esq., request retroactive appointment dates of September 16, 2020, based on administrative error. DeFalco and Minond also request that they be admitted to the promotional examination for Police Lieutenant (PM4147C), New Brunswick.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-21   MICHAEL NEGRON – CSC DOCKET NO. 2020-2235

 

Michael Negron, a Sheriff’s Officer, Hudson County Sheriff’s Office, represented by Robert Chewning, Esq., appeals his reassignment.  

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

        

B-22   BRIAN BLUM AND JAROD SMILEY – CSC DOCKET NOS. 2022-968 AND 2022-994

 

Brian Blum and Jarod Smiley appeal the determinations of the Division of Agency Services, which found that they did not meet the experience requirements for the promotional examination for Contract Administrator 1 (PS6052K), Department of Children and Families.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-23   EMERGENCY MEDICAL TECHNICIAN TRAINEE - CSC DOCKET NO. 2022-1620

 

The Division of Agency Services requests the creation of the local government noncompetitive title of Emergency Medical Technician Trainee.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-24   FORENSIC MORGUE TECHNICIAN - CSC DOCKET NO. 2022-1619

 

The Division of Agency Services recommends the reallocation of the title of Forensic Morgue Technician to the noncompetitive division of the career service in accordance with N.J.A.C. 4A:3-1.2, effective February 12, 2022.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-25   PARALEGAL TECHNICIAN 1, DEPARTMENT OF LAW AND PUBLIC SAFETY - CSC DOCKET NO. 2022-1688

 

The Department of Law and Public Safety requests the reallocation of Paralegal Technician 1 title to the noncompetitive division of the career service on an interim basis.

 

ACTION:     The Civil Service Commission directed that this request be granted.

  

B-26   FY2022 SALARY REGULATIONS COMPENDIUM

 

The FY 2022 Salary Regulations Compendium includes the following: Section 1 - Aligned Salary Regulation, Deputy Attorneys General, Non-Aligned Salary Regulation, Management Salary Regulation, Exempt Salary Regulation, and Attachments A and B; Section 2 - Emergency Conditions Salary Regulation; Section 3 - Special Incentive Salary Programs; Section 4 - Miscellaneous Salary Regulation; Appendix A, including Employee Relations Group List, Salary Schedules, Single Rates and Trainee Rates; Appendix B, including State Benefits Programs; and Index. The Compendium has been approved by Deirdré L. Webster Cobb, Esq., Chair/CEO, Civil Service Commission, and Lynn Azarchi, Acting Director, Office of Management and Budget.

 

ACTION:     The Civil Service Commission recorded the regulations.

 

B-27 COUNTY CORRECTIONAL POLICE OFFICER, CAMDEN COUNTY CSC DOCKET NO. 2022-1689

 

Camden County requests permission to make temporary appointments of entry-level County Correctional Police Officers.

 

ACTION:     The Civil Service Commission directed that this request be granted.
