A regular meeting of the Merit System Board was held on Wednesday,
February 27, 2002, in Trenton, New Jersey.
PRESENT: Chairwoman Ida L. Castro, Merit System Board
Members, Alan Dexter Bowman, Josephine DiRienzo, Margaret
E. L. Howard, and Leo R. Vartan; Barbara Bereski, Deputy Attorney
General; and Henry Maurer, Director, Division of Merit System
Practices and Labor Relations.
In accordance with L.1975, c.231, Chairwoman Ida L. Castro
opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and
Star Ledger on February 13, 2002, and posted at the Department
of Personnel, 3 Station Plaza, Trenton, New Jersey.
It is noted that agenda item A-6 was considered at the conclusion
of the Hearing Matters. After item A-19, the open session
was recessed and, pursuant to Section 12(b) of the Open Public
Meetings Act, the Merit System Board entered into Executive
Session for the purpose of legal advice on the matter of A-6
German Naranjo. The Board subsequently reconvened the Public
Meeting in order to render a decision in this matter.
All actions were by unanimous vote unless otherwise specified.

Elena McAllister and Barbara Catlett, Head Nurses, at Southern
State Correctional Facility, Department of Corrections, resignations

20, 1994 respectively, on the charge of being absent from
duty for five or more consecutive business days without approval.
Additionally both appellants also appeal denial of sick leave

Robert Green, Investigator I, Administrative Office of the

the charge of continuous disregard to follow office policy.

A-6 GERMAN NARANJO
German Naranjo appeals the removal of his name from the
eligible list for Correction Officer Recruit (S9999V), Department
of Corrections on the basis of an unsatisfactory employment
history which adversely relates to the position sought.
Recommendation of the Administrative Law Judge - Uphold
the removal from the eligible list.
ACTION: The Merit System Board reversed the recommendation
of the
Administrative Law Judge and ordered the appellant's name
to be
restored to the eligible list for Correction Officer Recruit
(S9999V).

of Health Care Facilities, ten-day suspension on charges of
failure or neglect to perform official duty, insubordination,

Leigh Shaw, Principal Engineer Electrical, Division of Human

on the charge of sexual harassment.

the 30-day suspension to a 15-day suspension.
ACTION: The Merit System Board modified the recommendation

B-12 THOMAS C. LUCKEY
The Department of Community Affairs (DCA) appeals the decision
of Human Resource Information Services (HRIS) which found
that it had not presented a sufficient basis to remove Thomas
C. Luckey's name from the eligible list for Inspector, Fire
Safety (S2000A) on the basis of an unsatisfactory employment
record. Additionally, DCA's request for the removal of the
appellant's name from the eligible list for Safety Inspector
(S0552B), on the basis of his falsification of his preemployment
application, has been referred to the Merit System Board for
review.
ACTION: The Merit Board directed that the appellant's
name be restored to the
eligible list for Inspector, Fire Safety (S2000A) and the
February 16,
2000 certification be returned for proper disposition; and
appellant's
name be removed from the eligible list for Safety Inspector
(S0552B).
B-13 BEVERLY D. CONNELLY FIGUEROA
Beverly D. Connelly Figueroa, a Sheriff's Officer with the
County of Union, represented by Carl Figueroa, Esq., petitions
the Merit System Board (Board) for interim relief regarding
her enrollment with the John H. Stamler Police Academy, Union
County, and requests enforcement of a Board decision rendered
on September 12, 2000.
ACTION: The Merit System Board directed that the
request for interim relief
be dismissed as moot and request for enforcement be denied.

Evelyn Magyar, a Legal Secretary 1 with the Department of
Law and Public Safety, appeals the determination of the Attorney
General, stating that the appellant failed to present sufficient
evidence to support a finding that she had been subjected
to a violation of the New Jersey State Policy Prohibiting
Discrimination, Harassment or Hostile Environments in the
Workplace.
ACTION: The Merit System Board directed that this

Janelle Spearman, a Senior Correction Officer at East Jersey
State Prison (EJSP), Department of Corrections (DOC), appeals
the determination of the Director, Equal Employment Division
(EED) with the DOC, stating that the appellant failed to present
sufficient evidence to support a finding that she had been
subjected to violations of the New Jersey State Prohibiting
Discrimination, Harassment or Hostile Environments in the
Workplace.

The Department of Corrections petitions the Merit System
Board to reconsider its final decision granting the appellant's
appeal of his minor discipline charge.

Scott Sista, represented by Gregory A. Busch, Esq., petitions
the Merit System Board for reconsideration of its decision
rendered June 12, 2001, upholding the removal of his name
from the eligible list for Police Officer (M33382Z), City
of Jersey City, due to unsatisfactory driving and employment
records.
ACTION: The Merit System Board denied the request
for reconsideration.
B-18 WILLIAM C. WHITE, SR.
William C. White, Sr., formerly a Senior Correction Officer
with the Garden State Reception and Youth Correctional Facility,
Department of Corrections, represented by Michael K. Sharp,
Executive Vice President, P.B.A. Local 105, petitions the
Merit System Board (Board) for reconsideration of the Board's
decision rendered on May 22, 2001, in which the Board upheld
his removal.
ACTION: The Merit System Board directed that this
request be denied.
B-19 JUAN C. BETANCOURTH
Juan C. Betancourth, represented by Peter J. Cresci, Esq.,
requests that the Merit System Board review the certification
of the list for Police Officer (S9999A), City of Bayonne,
based on the fact that he received and passed medical and
psychological examinations.
ACTION: The Merit System Board directed that the
appellant be given an
appointment from the certification absent disqualification
after an updated background check.

ESSEX COUNTY
The appointing authority requests permission not to make
an appointment from the certification for Management Information

accessed for the costs of the selection process in the amount
of $2,048.

The appeal of Toni Hilsin, an Environmental Specialist (Waste
Management) with the Department of Environmental Protection,
concerning her layoff, effective July 8, 1994, for reasons
of economy and efficiency, was heard by Administrative Law
Judge Joseph F. Martone (ALJ), who rendered his initial decision
on July 26, 2001, recommending that the layoff be reversed.
At its meeting of December 18, 2001, the Board adopted the
ALJ's recommendation. The proposed final decision is now submitted
for the Board's review.
ACTION: The Merit System Board adopted the final
decision.

The Manager, Division of Human Resource Management, on behalf

title of Communications Systems Technician 2, in order to
qualify for either a lateral title change or a promotion,
pending examination, to the Technical Assistant MIS, Technician
MIS, Senior Technician MIS, and Technical Support Specialist
2 titles.
