A regular meeting of the Merit System Board was held on Wednesday, October 23, 2002, in Trenton, New Jersey.

PRESENT: Margaret E. L. Howard, Presiding Board Member, Merit System Board Members, Alan Dexter Bowman, Josephine DiRienzo, and Robert J. Long; Elizabeth Laufer, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Margaret E. L. Howard opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on March 7, 2002, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified. It is noted that Josephine DiRienzo was present and voted on item A-3 and items B-9 through B-85 only.

SUBJECT: Change in the Classification and Compensation Plan

DEPARTMENT OF LAW AND PUBLIC SAFETY
The Department of Law and Public Safety requests the restructuring of the Forensic Scientist title series in the Division of State Police. The action involves the restructuring of non-managerial levels, elimination of the entry level of the series, a title verbiage change for all levels, an increase in the education requirement from a specific Bachelor's to a specific Master's, and the upward movement of non-managerial staff. This restructuring is requested to keep pace with changes in forensic science and to attract and retain qualified staff.

Legislative mandates have increased the quantity and scope of DNA testing, a highly complex area of forensic science. DNA testing is widely used by law enforcement to solve criminal cases and assist in the conviction of alleged law violators. There is no margin for error; the scientist is held accountable for the validity of the test methods, the test results and the reliability of the instrumentation.

Incumbents serving in the existing entry, senior and principal levels of this series will be moved to the new levels of Forensic Scientist, 1, 2 and 3 respectively, with retention of existing status. Specifically, Forensic Scientists (P22-01591) will be moved to Forensic Scientist 1 (P25-01592). Senior Forensic Scientists (P25-01592) will be moved to Forensic Scientist 2 (R28-01593). Principal Forensic Scientists (R28-01593) will be moved to Forensic Scientist 3 (S30-01594). The Department of Law and Public Safety intends to process this as a "no-pain, no-gain" transaction, in that incumbents will be moved to the new range with their current salary. Permanent incumbents will move RA to RA; provisional incumbents will be expected to complete examination procedures. The appropriate negotiations representatives have been made aware of this request.

Thomas Wallace, Police Officer, Township of Little Egg Harbor, Police Department, removal effective August 2, 1999, on charges of misconduct, failure to deposit funds paid to the local unit, failure to maintain cash on hand in an approved petty cash fund, failure to perform duties, conduct unbecoming a public employee, neglect of duty, misuse of public property, including motor vehicles, and violations of various department rules and regulations.

Recommendation of the Administrative Law Judge - Reverse the removal.

A-10 KETLINE CHARLOT
Ketline Charlot, Human Services Assistant, Woodbridge Developmental Center, Department of Human Services, removal effective November 19, 2001, on the charge of intentional misstatement of material fact in connection with pre-employment physical. This matter was held over from the Merit System Board meeting of September 10, 2002.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a resignation in good standing.

A-11 JENNIFER MANLEY
Jennifer Manley, County Correction Officer, Monmouth County Department of Corrections and Youth Services, removal effective March 29, 2001 on charges of failing to successfully complete training. This matter was consolidated to include the appeal of removal to the Merit System Board and an appeal to the Police Training Commission (PTC) regarding removal from the Police Academy. The PTC had the predominant interest in the matter and rendered their final decision on September 11, 2002.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

George Trampler appeals the Township of Marlboro's bypass of his name on the certification of the Police Captain (PM1112W) eligible list.

A motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of legal advice on the matters of B-9 Stephanie Carter-Green, B-10 Lisa R. Easley, and B-12 Gail Harris. The Board subsequently reconvened the public meeting.

Stephanie Carter-Green, a Senior Correction Officer at the Garden State Reception and Youth Correctional Facility, Department of Corrections (DOC), appeals the determinations of the Attorney General and the Director, Equal Employment Division, with DOC, stating that the appellant failed to present sufficient evidence to support a finding that she had been dismissed from Investigator training in violation of the New Jersey State Policy Prohibiting Discrimination, Harassment for Hostile Environments in the Workplace.

The Superior Court, Law Division, has transmitted, by order Counts Two and Four of the Verified Intervention Complaint of Intervenor Joseph Auer, a former Police Inspector with the Borough of Keansburg, represented by David F. Corrigan, Esq., in the case of James Pigott v. Edward Striedl, et al., to the Merit System Board to address Joseph Auer's claims of an improper immediate suspension.

ACTION: The Merit System Board denied the request for interim relief.

The appeal of Vera Borisovs, a Practical Nurse at Vineland Developmental Center, Department of Human Services, of her resignation not in good standing, effective December 7, 1999, on charges, was heard by Administrative Law Judge W. Todd Miller (ALJ), who rendered his initial decision on July 3, 2002. At its meeting on September 25, 2002, the Merit System Board (Board) adopted the ALJ's recommendation to reverse the resignation not in good standing. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-22 WILLIAM C. KLUSARITZ, JR.
The appeal of William C. Klusaritz, Jr., a Principal Accountant with Cape May County, of his removal, effective November 18, 1997, on charges, was heard by Administrative Law Judge Joseph F. Martone (ALJ), who rendered his initial decision on May 13, 2002, upholding the removal. At its meeting on September 25, 2002, the Merit System Board (Board) modified the removal to a six-month suspension. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-23 JACQUETTA SPINKS
The appeal of Jacquetta Spinks, a County Correction Officer with the Union County Department of Public Safety, of her removal, effective May 24, 2000, on charges, was heard by Administrative Law Judge Irene Jones (ALJ), who rendered her initial decision on April 9, 2002. At its meeting on September 25, 2002, the Merit System Board (Board) adopted the ALJ's recommendation to uphold the appellant's removal. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-24 MARIA APOSTOLOS
Maria Apostolos appeals the determination of the Division of Selection Services, which found that, per the substitution clause for education, she did not meet the experience requirements for the Administrative Analyst 4 (PS1028K) and Child Support and Paternity Specialist 3 (PS0278K), Division of Family Development promotional examinations.

ACTION: The Merit System Board directed that these appeals be denied.

Gary Badger, Gus Guzman, Kim Herbert and Craig Owens appeal the decision of the Division of Selection Services, which found that they did not meet the education requirement for the examination for Parole Officer Recruit (S2004B), Juvenile Justice Commission.

B-64 MICHAEL SCARLATA
The appeal of Michael Scarlata, a County Correction Officer with the Department of Public Safety, County of Union, of his 15-day suspension, beginning September 26, 2001, on charges, was heard by Administrative Law Judge Maria Mancini La Fiandra, who rendered her initial decision on August 5, 2002, upholding the 15-day suspension. At its meeting on October 9, 2002, the Merit System Board (Board) modified the penalty to a three-day suspension. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-65 JOAN BUECKER
Joan Buecker appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Supervisor of Patient Accounts (PC0171D), Camden County.

ACTION: The Merit System Board directed that this appeal be granted.

The Acting Director, Division of Human Resource Management, requests that the provisions of N.J.A.C.4A:4-2.6(a)2, Eligibility for promotional examination, be relaxed to allow seven employees of the Department of Environmental Protection to be admitted to the promotional examinations for the titles of Technical Support Specialist 1 (PS3339G), and Technical Support Specialist 2 (PS3340G).

B-84 SALARY REGULATIONS, FY 2003
It is recommended that the Board record the Salary Regulations for Fiscal Year 2003. They include the Aligned Salary Regulation, the Non-Aligned Salary Regulation (with Attachments A and B), the Emergency Conditions Salary Regulation, the Special Incentive Salary Regulations and the Miscellaneous Salary Regulations.

ACTION: The Merit System Board recorded the Salary Regulations.
