A regular meeting of the Merit System Board was held on Wednesday, December 4, in Trenton, New Jersey.

PRESENT: Margaret E. L. Howard, Presiding Board Member, Merit System Board Members, Alan Dexter Bowman, and Robert J. Long; Barbara Stoop, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Margaret E. L. Howard opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on March 7, 2002, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

SUBJECT: Change in the State Classification Plan

JUDICIARY

The New Jersey Judiciary requests to offer interim non-competitive appointments to the titles of Probation Officer and the bilingual variant title.

For some time the Judiciary has been experiencing difficulty in maintaining a sufficient pool of eligibles in certain vicinages, for both Probation Officer and Probation Officer, Bilingual in Spanish and English. Depending on the geographical preferences of the eligible candidates, the lists are quickly exhausted for some areas/vicinages while others continue to have access to qualified candidates.

Specifically, several high-density vicinages such as Essex, Passaic, Warren, Hudson, and Camden exhaust their lists before the eligible lists are depleted in other vicinages.

The Judiciary was granted permission in November 2000 to fill vacancies for these titles on an interim non-competitive basis. This action was taken to address the Judiciary's immediate need to fill positions in the absence of eligible lists.

The Judiciary continues to experience this need, particularly in light of the vacancies that were not filled due to the FY2002 hiring freeze and the subsequent Early Retirement Incentive Program. Therefore, it is requested that the Judiciary be granted permission make interim non-competitive appointments for existing provisional employees and to fill new vacancies from December 14 through January 25, 2002 for those vicinages that have exhausted their respective lists of eligible candidates.

Candidates for bilingual titles will be required to pass the Department of Personnel's proficiency skill testing for bilingual communication (BICAT) prior to permanent appointment.

The Open Competitive Announcement for Probation Officer and Probation Officer Bilingual in Spanish and English will be announced after the first of the year with lists expected to become available sometime between May and June 2003.

It is also to be noted that the affected bargaining unit, Probation Officers Association of New Jersey (PANJ) has no objection to the utilization of interim noncompetitive status in this case.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE - ACKNOWLEDGE THE SETTLEMENTS

ACTION: The Merit System Board acknowledged the settlements with the exception of Roger Harris, which was held over.

Rashid Bey, Senior Food Service Handler, Ancora Psychiatric Hospital, Department of Human Services, 60-day suspension on charges of threatening a fellow employee on state property and violation of a policy.

Recommendation of the Administrative Law Judge - Uphold the 60-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-3 CRAIG DAVIS

Craig Davis, Senior Correction Officer, South Woods State Prison, Department of Corrections, 15-day suspension on charges of inappropriate physical contact or mistreatment of an inmate, patient, client, resident or employee.

Recommendation of the Administrative Law Judge - Modify the 15-day suspension to a six-month suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-4 ROBERT OCHES

Robert Oches appeals the request of the Township of Middletown to bypass his name from the Police Chief (PM3311V) eligible list based on his claim of retaliation.

Recommendation of the Administrative Law Judge - Uphold the bypass from the eligible list for Police Chief (PM3311V).

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-5 JAMES WATSON

James Watson, Police Officer, City of Newark, Police Department, 25-day suspension on charges of violation of Police Department rules regarding disobedience of orders, outside employment and false statement.

Recommendation of the Administrative Law Judge - Reverse the 25-day suspension.

ACTION: The Merit System Board directed that this matter be held over.

A-6 DIANE WENTZ

Diane Wentz, County Correction Officer, County of Salem, Sheriff's Department, five-day suspension (12-hour days equal to 60 hours) on charges of, inter alia, violation of Sheriff's Department rules regarding sleeping while on duty.

Recommendation of the Administrative Law Judge - Modify the five-day suspension (12-hour days equal to 60 hours) to a five-day suspension (8 hour days equal to 40 hours).

ACTION: The Merit system Board affirmed the recommendation of the Administrative Law Judge.

A-7 NATHAN CAREY

Nathan Carey, Human Services Assistant, Woodbine Developmental Center, Department of Human Services, removal effective February 8, 2001, on the charge of physical abuse of a client.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-8 BRIAN L. CARUTH

Brian L. Caruth, Senior Correction Officer, East Jersey State Prison, Department of Corrections, removal effective July 16, 2001, on charges of use, possession, or sale of any controlled dangerous substance and conduct unbecoming an employee.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board directed that this matter be held over.

A-9 ANN MARIE COLLINS-COLE

Ann Marie Collins-Cole, Assistant Tax Collector, City of Clifton, Finance Department, removal effective November 23, 1998, on charges of incompetence, inefficiency, failure to perform duties, chronic absenteeism or lateness and other sufficient cause.

Recommendation of the Administrative Law Judge - Grant motion for Summary Decision to dismiss the appeal.

ACTION: The Merit System Board directed that this matter be held over.

A-10 RODNEY EDMONDS

Rodney Edmonds, Intermittent Labor Clerk, Unemployment Insurance, Department of Labor, removal effective December 2, 1999, on the charge of insubordination.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-11 BETTY JEAN KESSLER

Betty Jean Kessler, Practical Nurse, New Lisbon Developmental Center, Department of Human Services, removal effective January 9, 2001, on charges of insubordination and threatening, intimidating, coercing or interfering with fellow employees on state property.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a six-month suspension.

B-1 CHUCK A. SCOTT

Chuck A. Scott appeals his rejection as a County Correction Officer candidate by the County of Hudson and its request to remove his name from the eligible list for County Correction Officer (S9999B) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal be denied.

B-2 WILLIAM PIERCE

William Pierce, represented by William T. Smith, Esq., appeals his rejection as a Police Officer candidate by the City of Hackensack and its request to remove his name from the eligible list for Police Officer on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal be granted.

B-3 GERTRUDE DICKERSON

Gertrude Dickerson, a Cottage Training Supervisor at New Lisbon Developmental Center, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this matter be referred to the Medical Examiners Panel.

B-4 NICHOLAS B. KRISS

Nicholas B. Kriss, a Customer Service Representative 3 with the Division of Alcoholic Beverage Control, Department of Law and Public Safety, appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal be granted.

B-5 JANINE M. KHALIFA

Janine M. Khalifa appeals the decision of Human Resource Information Services, which upheld the removal of her name from the Probation Officer (S0681C) eligible list on the basis of her failure to respond to several Notices of Certification.

ACTION: The Merit System Board directed that this appeal be granted.

B-6 SOPHIA E. KHALIFA

Sophia E. Khalifa appeals the decision of Human Resource Information Services, which removed the appellant's name from the Probation Officer (S0681C), Judiciary Vicinage 1 eligible list, due to the appellant's failure to respond to a Notice of Certification.

ACTION: The Merit System Board directed that this appeal be granted.

B-7 DAUD ABDUS-SABUR

Daud Abdus-Sabur, a Senior Correction Officer at Northern State Prison, Department of Corrections (DOC), appeals the determinations of the Director, Equal Employment Division (EED), with the DOC, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace. This matter was held over from the November 7, 2002 Merit System Board meeting.

ACTION: The Merit System Board granted a hearing on his April 16, 2001 complaint but denied the appeal regarding the May 15, 2001 complaint.

B-8 JOSEPH CASTLE

Joseph Castle, an Administrator of Investigations, Law and Public Safety, with the Department of Law and Public Safety, represented by Anthony J. Fusco, Jr., Esq., appeals the determination of the Attorney General, which found no violations of the Department's Policy Against Discrimination, Harassment and Hostile Environments in the Workplace as a result of a comment made by Castle during the investigation of a discrimination complaint filed by Shawn Sweeney, a then-recruit in the New Jersey Division of Criminal Justice Academy.

ACTION: The Merit System Board dismissed the appeal.

B-9 MICHELE COLEMAN

Michele Coleman, a Head Clerk with the New Jersey State Police, Department of Law and Public Safety, appeals the determination of the Office of the Attorney General with the Department of Law and Public Safety, stating that appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied but directed that the additional claims be remanded to the appointing authority for investigation.

B-10 BARBARA GREEN

Barbara Green, an Executive Assistant 2 with the Department of Corrections (DOC), appeals the determination of the Director, Equal Employment Division, with the DOC, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment, or Hostile Environments in the Workplace.

ACTION: The Merit System Board granted a hearing.

B-11 MATTHEW KNIGHT

Matthew Knight, a Correction Sergeant at Albert C. Wagner Youth Correctional Facility, Department of Corrections (DOC), appeals the determination of the Director, Equal Employment Division (EED), with the DOC, stating that the appellant had failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board remanded the matter to the Department of Corrections.

B-12 MARY BETH MAHLMANN

Mary Beth Mahlmann, an Acting Sergeant First Class with the New Jersey State Police, Department of Law and Public Safety, represented by George T. Daggett, Esq., appeals the determination of the Attorney General, stating that the appellant had failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment and Hostile Environments in the Workplace.

ACTION: The Merit System Board granted a hearing.

B-13 JOANNE T. MCKNIGHT

Joanne T. McKnight, a Senior Correction Officer with the Edna Mahan Correctional Facility for Women, Department of Corrections (DOC), appeals the determinations of the Director of the Equal Employment Division (EED) with the DOC, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment, or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-14 SHERRY RAINEAR

Sherry Rainear, a Human Services Assistant at Ancora Psychiatric Hospital, Department of Human Services (DHS), appeals the determination of the Assistant Commissioner for Human Services, DHS, which found that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-15 DIANE SEBASTIAN

The Department of Community Affairs (DCA) requests reconsideration of the Merit System Board (Board) decision rendered on December 19, 2000, in which the Board granted Diane Sebastian, a Technical Assistant 1, Community Affairs, with the DCA, a hearing on her complaint that she was sexually harassed in violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace. This matter was held over from the November 7, 2002 Merit System Board meeting.

ACTION: The Merit System Board, upon reconsideration, upheld its prior decision granting a hearing.

B-16 WALTER TORWICH

Walter Torwich, a Senior Correction Officer at New Jersey State Prison, Department of Corrections (DOC), appeals the determination of the Director, Equal Employment Division (EED), with the DOC, stating that the appellant had failed to present sufficient evidence to support a finding that he had been subjected to violations of the New Jersey State Police Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board granted a hearing.

B-17 BARBARA CATLETT, ELENA MCALLISTER, AND JANET COOK FLANAGAN

The Department of Corrections, represented by Sonia Frontera, DAG, petitions the Merit System Board for reconsideration of the final decision rendered on April 10, 2002, which reversed the resignations not in good standing of Barbara Catlett and Elena McAllister, both Head Nurses, and Janet Cook Flanagan, a Pharmacy Assistant, and granted Catlett and McAllister sick leave injury (SLI) benefits.

ACTION: The Merit System Board denied the request for reconsideration and a stay.

B-18 WILLIAM MANOES

The Borough of Keansburg (Borough), represented by Paul Castronovo, Esq., petitions the Merit System Board for a stay of the decision In the Matter of William Manoes, (MSB, decided June 26, 2002), which ordered to the Borough of provide remedial relief for procedural violations regarding the layoff of employees of the Keansburg Municipal Utilities Authority (KMUA), pending the Borough's appeal to the Appellate Division of the Superior Court of New Jersey

ACTION: The Merit System Board denied the request for a stay.

B-19 LINDA M. NASUTI

Linda M. Nasuti petitions the Merit System Board (Board) for reconsideration of the final administrative decision, rendered on May 9, 2000, in which the Board denied her request to retake a promotional examination.

ACTION: The Merit System Board directed that this appeal be denied.

B-20 GEORGE PHILLIPS

George Phillips, a Senior Correction Officer at New Jersey State Prison, Department of Corrections, represented by Michele Alcalde, Esq., requests a hearing regarding his removal from employment, effective January 11, 2002.

ACTION: The Merit System Board denied the request for a hearing.

B-21 FRANK DELORENZO, JR.

Frank DeLorenzo, Jr., represented by Anthony F. Malanga, Jr., Esq., petitions the Merit System Board for a determination of his entitlement to permanent status in the title of Building Inspector, Township of Belleville.

ACTION: The Merit System Board denied the request for permanent status as a Building Inspector.

B-22 KEVIN FREIBOTT

The appeal of Kevin Freibott, a Police Officer with the Township of Middletown, of his removal effective August 15, 2001 on charges, was heard by Administrative Law Judge Kathryn A. Clark (ALJ), who rendered her initial decision on August 6, 2002. At its meeting on November 7, 2002, the Merit System Board (Board) did not adopt the ALJ's recommendation to modify the removal to a two-month suspension. Rather, the Board determined that a six-month suspension was warranted. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board directed that this matter be held over.

B-23 EDWARD C. GARVIN

The appeal of Edwin C. Garvin, a Truck Driver with the Department of Public Works, Borough of Wildwood Crest, of his 60 calendar-day suspension and six follow-up unannounced drug/alcohol tests over a 12-month period, effective August 20, 2001 on charges, was heard by Administrative Law Judge Edgar R. Holmes (ALJ), who rendered his initial decision on October 3, 2002 upholding the suspension and testing. At its meeting on November 20, 2002, the Merit System Board (Board) increased the suspension to a 60 working-day suspension and upheld the testing. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-24 GREGORY MCDANIEL

The appeal of Gregory McDaniel, a Human Services Specialist 2 with the Mercer County Board of Social Services, of his removal, effective March 15, 2000, on charges, was heard by Administrative Law Judge John Schuster III (ALJ), who rendered his initial decision on October 7, 2002. At its meeting on November 20, 2002, the Merit System Board (Board) did not adopt the ALJ's recommendation to uphold the removal. Rather, the Board modified the removal to a three-month suspension. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-25 LATEISHA M. MERCER

Lateisha M. Mercer appeals her rejection as a Correction Officer Recruit candidate by the Juvenile Justice Commission and its request to remove her name from the eligible list for Correction Officer Recruit (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal be granted.

B-26 THOMAS A. ALVEREZ

Thomas A. Alverez appeals the decision of the Division of Selection Services that found that he was below the minimum requirements in experience for the promotional examination for Principal Clerk Typist (PS2891K), Trenton Psychiatric Hospital.

ACTION: The Merit System Board directed that this appeal be granted.

B-27 DAVID BRUCCOLERI AND VINCENZO MARTORANA

David Bruccoleri and Vincenzo Martorana appeal the determination of the Division of Selection Services, which found that they did not meet the education and experience requirements for the Project Manager, Transportation (PS2357T), Department of Transportation promotional examination.

ACTION: The Merit System Board directed that these appeals be denied.

B-28 EDWARD CARROLL

Edward Carroll appeals the determination of the Division of Selection Services, which found, per the substitution clause for education, he did not meet the experience requirements for the open competitive examination for Construction and Maintenance Technician 4 (S9137C), Department of Transportation.

ACTION: The Merit System Board directed that this appeal be denied.

B-29 GERALDINE DELANEY

Geraldine Delaney appeals the determination of the Division of Selection Services, which found that she did not meet the announced experience requirements for the promotional examination for Medical Social Care Specialist 1, Medical Assistance and Health Services (PS3773K), Department of Human Services.

ACTION: The Merit System Board directed that this appeal be granted.

Janice DiClaudio appeals the determination of the Division of Selection Services that she did not meet the education and experience requirements for the Supervisor, Standards and Procedures (S5001B) examination.

ACTION: The Merit System Board directed that this appeal be denied.

Joanne Graffeo and Gwendolyn Nolley appeal the determination of the Division of Selection Services, which found that they did not meet the experience requirements for the open competitive examination for Supervising Program Development Specialist (Medical Assistance and Health Services) (S3003C). Kunal Kaushal and Rashmin Patel appeal the determination of the Division of Selection Services, which found that they did not meet the experience requirements for the Project Manager, Transportation (PS2357T), Department of Transportation promotional examination.

ACTION: The Merit System Board directed that these appeals be denied.

The City of Bordentown requests that the provisions of N.J.A.C. 4A:4-7.1A(c) be relaxed in order to process the Intergovernmental Transfer Request of Joe Bourn from the title of Sheriff's Officer, Burlington County Sheriff's Officer, to the title of Police Officer, City of Bordentown.

The Town of Harrison, represented by Patricia Reddy-Parkinson, Esq., appeals the determination of the Director, Office of Intergovernmental Services, which denied its request for the transfers of Raymond McGuire and Michael Ryan from the title of Sheriff's Officer, Hudson County Sheriff's Department, to the title of Police Officer, Town of Harrison.

ACTION: The Merit System Board directed that this appeal be granted.

The Acting Director, Division of Human Resource Management, requests that the titles of Probation Officer and Probation Officer, Bilingual in Spanish and English, within the Judiciary be allocated to the noncompetitive division of the career service on an interim basis where lists currently do not exist.

ACTION: The Merit System Board granted the request.

B-60 PROPOSED REACSCTION WITH AMENDMENTS OF N.J.A.C. 4A:8 LAYOFFS

It is recommended that the proposed readoption with amendments of N.J.A.C. 4A:8 layoffs be approved for publication in the New Jersey Register.

ACTION: The Merit System Board approved the proposed readoption with amendments for publication in the New Jersey Register.

B-61 CARL STANFORD

The appeal of Carl Stanford, a Head Cook 1 at New Jersey State Prison, Department of Corrections, of his indefinite suspension pending the disposition of criminal charges, effective October 15, 2001, was heard by Administrative Law Judge Douglas H. Hurd, who rendered his initial decision on September 3, 2002, reversing the indefinite suspension. At its meeting on November 20, 2002, the Merit System Board (Board) ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.

ACTION: The Merit System Board, upon reconsideration, upheld its prior decision remanding the matter to the Office of Administrative Law and adopted the decision.
