    A regular meeting of the Civil Service Commission was held on Wednesday, February 16, 2022, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2021, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

A-2    JARE BROOKS – CSC DOCKET NO. 2019-1830

 

Jare Brooks, County Correctional Police Officer, Cumberland County, Department of Corrections, removal, effective December 10, 2018, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    COLLIN CAESAR – CSC DOCKET NO. 2020-1768

 

Collin Caesar, Fire Fighter, Jersey City, Department of Public Safety, fine equal to a nine working day suspension, on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.    

 

Recommendation of the Administrative Law Judge Modify the fine equal to a nine working day suspension to a fine equal to a three working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    CATHERINE ZUIDEMA – CSC DOCKET NO. 2020-2552

 

Catherine Zuidema, Human Services Specialist 1, Monmouth County, Department of Human Resources, release at the end of the working test period, effective April 20, 2020.

 

Recommendation of the Administrative Law Judge Dismiss the appeal for failure to appear.  

 

ACTION:     The Commission affirmed the dismissal of the appeal for failure to appear.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    C.J.C. – CSC DOCKET NO. 2021-1837

 

C.J.C., represented by Kenneth Ralph, Esq., appeals his rejection as a Fire Fighter candidate by North Hudson Regional Fire and Rescue and its request to remove his name from the eligible list for Fire Fighter (M1557X) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-2    A.M. – CSC DOCKET NO. 2022-163

 

A.M, represented by Donald Barbati, Esq., appeals her rejection as a Police Officer candidate by the Township of Belleville and its request to remove her name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    R.O.T. – CSC DOCKET NO. 2022-141

 

R.O.T. appeals his rejection as a Police Officer candidate by the City of East Orange and its request to remove his name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission request that this appeal be granted.

 

B-4    DARREL DOCKERY – CSC DOCKET NO. 2022-932

 

Darrel Dockery appeals the decision to remove his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list on the basis of falsification of the employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    GLENN ABRAMS – CSC DOCKET NO. 2022-984

 

Glenn Abrams requests permission to file a late application for the promotional examination for Police Sergeant (PM4505C), Atlantic City.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-6    GEORGE HAWKINS – CSC DOCKET NO. 2022-1037

 

George Hawkins requests to file a late application for the open competitive examination for Principal Legal Stenographer (M0475C), Newark.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-7    GEORGE HESSE – CSC DOCKET NO. 2022-1732

 

George Hesse appeals the denial of his request to file a late application for the Deputy Fire Chief (PM5172C) West Orange promotional examination.

 

ACTION:     The Civil Service Commission directed that this request be granted.

Thomas McCabe requests permission to file a late application for the promotional examination for Police Sergeant (PM4505C), Atlantic City.

 

ACTION:     The Civil Service Commission directed that this request be denied.

Michael Newell requests permission to file a late application for the promotional examination for Police Sergeant (PM4662C), Ventnor.

Ursula Ascencio and Daniel Garofalo appeal the determinations of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Assistant Chief of Administrative Services (PC4205C), Somerset County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that these appeals be held.

 

B-11   RONALD DEPASQUALE – CSC DOCKET NO. 2022-907

 

Ronald DePasquale appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Management Information Systems Coordinator (PC3328C), Morris County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted. 

 

B-12   MICHAEL DUNLOP – CSC DOCKET NO. 2022-1109

 

Michael Dunlop appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Counselor, Penal Institution (C0434C), Morris County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13   MONICA KONBOZ – CSC DOCKET NO. 2022-616

 

Monica Konboz appeals the determination of the Division of Agency Services, which found that she was below the minimum requirements in experience for the promotional examination for Clerk 2 (PM3179C), Vernon.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-14   STEPHEN PATEN – CSC DOCKET NO. 2022-947

 

Stephen Paten appeals the determination of the Division of Agency Services that he did not meet the experience requirement for the open competitive examination for Mechanical Equipment Specialist (S0393C), South Woods State Prison.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-15   SAMANTHA SANBORN – CSC DOCKET NO. 2022-987

 

Samantha Sanborn appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Human Services Specialist 1 (PC4466C), Camden County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-16   CHRISTINA SECCONDRO – CSC DOCKET NO. 2022-1026

 

Christina Seccondro appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Quality Assurance Officer, Animal Health Diagnostic Laboratory (PS5038A), Department of Agriculture.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

  

B-17   BRIAN WELLS – CSC DOCKET NO. 2022-1009

 

Brian Wells appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Tree Maintenance Worker 3 (PC4463C), Atlantic County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-18   DANIEL WORTS – CSC DOCKET NO. 2022-1096

 

Daniel Worts appeals the determination of the Division of Agency Services (Agency Services) that he did not meet the experience requirements for the promotional examination for Assistant Chief of Administrative Services (PC4205C), Somerset County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that this appeal be held.

 

B-19   PERRY GIANATIEMPO – CSC DOCKET NO. 2022-934

 

Perry Gianatiempo appeals his rank and score for the promotional examination for Master Mechanic, Marine (PS6114P) Department of Law and Public Safety.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-20   S.J. – CSC DOCKET NO. 2022-1527

 

S.J. requests to re-take the Chief, Contract Administration Section (PS3351N), Department of Labor and Workforce Development promotional examination.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-21   VICKI CHIRCO – CSC DOCKET NO. 2022-1007

 

Vicki Chirco appeals the decision of the Division of Agency Services which found that her position with the Department of Environmental Protection is properly classified as Resource Interpretive Specialist 2, Historic Resources. She seeks an Resource Interpretive Specialist 3 job classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be denied. 

 

B-22   SHERITA WHETSTONE – CSC DOCKET NO. 2022-985

 

Sherita Whetstone appeals the decision of the Division of Agency Services which found that her position with the Department of Community Affairs is correctly classified as Program Specialist 3, Regulatory Programs. She seeks a Program Specialist 4, Regulatory Programs classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23   WAYNE COLLINS – CSC DOCKET NO. 2022-1260

 

Wayne Collins, represented by Dudley Burdge, CWA Local 1032, requests reconsideration of the decision rendered on October 27, 2021, which upheld the determination of the Division of Agency Services that his position with the Office of Information Technology is Technician, Management Information Systems.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-24   SHANTEEYAH HALL AND AL-KEDAR JENKINS – CSC DOCKET NOS. 2022-965 AND 2022-966

 

Shanteeyah Hall and Al-Kedar Jenkins request reconsideration of In the Matter of Rochelle Petty (CSC, decided October 6, 2021) where the Civil Service Commission granted Petty’s requests to file a late application for the promotional examination for Senior Juvenile Detention Officer (PC2176B), Essex County.

 

ACTION:     The Civil Service Commission directed that these requests be denied.

 

B-25   FOOD SERVICE MANAGER (C0539W), BERGEN COUNTY – CSC DOCKET NO.  2022-1024

 

The matter of Bergen County’s failure to make an appointment from the OL181204 certification of the Food Service Manager (C0539W), Bergen County list, has been referred to the Civil Service Commission for review.

 

ACTION:     The Civil Service Commission ordered Bergen County to pay selection cost in the amount of $2,048.

  

B-26   RACHEL COLLINS – CSC DOCKET NO. 2022-1726

 

Rachel Collins, a former Technical Assistant, Department of Human Services, appeals her removal, effective December 23, 2021.

 

ACTION:     The Civil Service Commission directed that this appeal be denied for lack of jurisdiction.

 

B-27   LISA DAVIS, ET AL. - CSC DOCKET NOS. 2022-1072, ET AL.

 

Lisa Davis, Jodie Eastlack, James Sinclair, and Shane Stevenson appeal the determinations of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Deputy Director of Welfare (PC4336C), Gloucester County Division of Social Services.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-28   JOSEPH SULLIVAN - CSC DOCKET NO. 2022-1196

 

Joseph Sullivan appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Director, Office of the Handicapped (C0434C), Ocean County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-29 MARCUS BLACKMON, SR. - CSC DOCKET NO. 2022-542

 

Asbury Park requests the revival of the eligible list for Fire Captain (PM1099S), Asbury Park in order to appoint Marcus Blackmon, Sr. Additionally, Asbury Park requests that Blackmon be admitted to the examination for Battalion Fire Chief (PM3373C), Asbury Park.

 

ACTION:    The Civil Service Commission directed that this appeal be granted.

John Maldonado (PM4542C), Elizabeth; Sean Gartland (PM4552C), Gloucester City; Timothy Lontz and Juwan Morgan (PM4553C), Gloucester Township; Victoria Vazquez (PM4580C), Linden; David Bryson (PM4588C), Magnolia; Alberto Sanabria and John Sanabria (PM4619C), Paterson; Chanel Johnson, Gregory Peterson and Joseph Weresow (PM4652C), Plainfield; Sidra Colvin, Justyna Maloney and Scott Maloney (PM4631C), Rahway; Danny Santos (PM4661C), Union Township; and Maximino Guevarez (PM4670C), Weehawken; request that they be permitted to submit applications for the promotional examination for Police Sergeant (various jurisdictions), after the application filing deadline.

 

ACTION:       The Civil Service Commission directed that these requests be granted.

 

B-31 JUDICIARY TITLES - CSC DOCKET NO. 2022-1575

 

The Superior Court of New Jersey, Appellate Division, has remanded the Civil Service Commission’s decision to reallocate the Judiciary Clerk 1, Judiciary Clerk 2, Judiciary Account Clerk 1, Court Services Representatives, and their associated bilingual variants, and Judiciary Clerk Driver titles to the non-competitive division of the career service on an interim basis instead of a permanent basis. 

 

ACTION:     The Civil Service Commission permanently reallocated the titles of Judiciary Clerk 1, Court Services Representative, and their associated bilingual variants, and Judiciary Clerk Driver to the non-competitive division of the career service.
