A regular meeting of the Merit System Board was held on Thursday, March 13, 2003, in Trenton, New Jersey.

PRESENT: Chairwoman Ida L. Castor, Merit System Board members, Alan Dexter Bowman, Josephine DiRienzo, and Margaret E. L. Howard; Todd Wigder, Deputy Attorney General; and Elizabeth Napolitano, Manager, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on March 3, 2003, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

A-3 STEPHANIE KING
Stephanie King, Graduate Nurse, Greystone Park Psychiatric Hospital, Department of Human Services, resignation not in good standing effective March 7, 2000, on the charge of job abandonment. This matter was previously presented to the Merit System Board at its regular meeting of December 18, 2002, and was held over for receipt of cross exceptions.

Recommendation of the Administrative Law Judge - Uphold the resignation not in good standing.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-4 ZACHARY ODUMES
Zachary Odumes, Senior Correction Officer, East Jersey State Prison, Department of Corrections, appeals a ten-day suspension on the charge of conduct unbecoming an employee. Further, he appeals his entitlement to back pay for the period of the indefinite suspension for the underlying criminal charges.

Recommendation of the Administrative Law Judge - Grant the appointing authority's motion for Summary Decision and deny back pay for the period of the indefinite suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-5 BENITA CISROW
Benita Cisrow, Senior Correction Officer, South Woods State Prison, Department of Corrections, removal effective August 16, 2000, on charges of inability to perform duties and incapacity to discharge one's duty due to mental or physical disability.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-6 PATRICIA EVERINGHAM
Patricia Everingham, Secretarial Assistant, Township of Monroe, Department of Community Affairs, removal effective April 25, 2001, on charges of chronic excessive lateness and absenteeism, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 30-day suspension.

A-7 FARRELL HIGGINBOTHAM
Farrell Higginbotham, Senior Medical Security Officer, Ann Klein Forensic Center, Department of Human Services, two removals effective November 28, 2001 and November 29, 2001, on charges of neglect of duty which could result in danger to persons or property and violation of administrative procedures involving safety and security.

Recommendation of the Administrative Law Judge - Uphold the removals.

Chinwe Nwadiogbu, an Auditor 3, Taxation, Department of the Treasury (Treasury, represented by Jesse J. Averhart, Executive Vice President, CWA Local 1033, appeals the denial of sick leave injury (SLI) benefits. The appellant also appeals Treasury's final department determination of her grievance.

ACTION: The Merit System Board directed that the appeal for SLI benefits be denied and the grievance appeal be dismissed since no further action is required.

Tanya Only, a Human Services Assistant with Ancora Psychiatric Hospital, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

Jeannette Cleary, a Hazardous Site Mitigation Specialist 3 with the Department of Environmental Protection (DEP), appeals the determination of the Director for the Office of Equal Opportunity, Contract Assistance and Environmental Equity, DEP, which found that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board remanded the matter to the DEP for further investigation.

B-28 ADRIAN EVANS
Adrian Evans, a Director of Nursing Services 1 (Developmental Disabilities) at the Woodbridge Developmental Center, Department of Human Services (DHS), appeals the determination of the Assistant Commissioner for Human Resources, DHS, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-29 ELLINOR JENKINS
Ellinor Jenkins, a Practical Nurse with New Lisbon Developmental Center, Department of Human Services (DHS), appeals the decision of the Assistant Commissioner for Human Resources of DHS partially denying her request for a reasonable accommodation.

ACTION: The Merit System Board directed that this appeal be denied.

B-30 RANDY GEIS
The City of Bayonne, represented by Robert J. Merryman, Esq., petitions the Merit System Board for a stay of the decision, In the Matter of Randy Geis (MSB, decided November 20, 2002), which granted Geis permanent status as a Fire Fighter and ordered Bayonne to reinstate him with back pay, benefits and seniority.

ACTION: The Merit System Board directed that this matter be held over.

Raymond Byron appeals the denial of veterans preference status on the examination for Human Services Specialist 1 (C1530C), Monmouth County.

B-44 JOHN MAGNER
The Borough of Keansburg requests relaxation of N.J.A.C 4A:4-7A.1A(d) so as to permit the intergovernmental transfer of John Magner from the title of Sheriff's Officer, Hudson County Sheriff's Office, to the title of Police Officer, Borough of Keansburg.

ACTION: The Merit System Board granted the request.

Louis Tondini appeals the determination of the Division of Selection Services that his application was late and could not be processed for the promotional examination for Manager 2, Department of Transportation Procurement, (PS2908T), Department of Transportation.

Gerard Fisher petitions the Merit System Board for reconsideration of the decision rendered on June 26, 2002 that denied his appeal regarding his score on the promotional examination for Fire Captain (PM3588A), Jersey City.

ACTION: The Merit System Board denied the request.

B-47 CYNTHIA I. MITCHELL
In its recent decision, In the Matter of Edward F. Millerick and In the Matter of Cynthia I. Mitchell, Supervising Public Health Representative (PS7709H), Department of Health and Senior Services (App. Div. Docket No. A-3104-00T1, decided January 2, 2003), the Superior Court of New Jersey, Appellate Division (Appellate Division), remanded to the Merit System Board (Board) In the Matter of Cynthia I. Mitchell, Supervising Public Health Representative (PS7709H), Department of Health and Senior Services (Merit System Board, decided June 14, 2001), with the directive that the Board provide findings of fact by March 14, 2003, to support its conclusion to cancel the eligible list in connection with the promotional announcement. The Appellate Division retained jurisdiction.

ACTION: The Merit System Board directed that the list cancellation be reaffirmed and the results of the Supervisory Test Battery continue in full force and effect.

B-49 WILLIAM J. BRENNAN, ET AL.

In its recent decision, In the Matter of William J. Brennan, (App. Div. Docket No. A-3104-00T1, decided June 18, 2002), the Superior Court of New Jersey, Appellate Division (Appellate Division) remanded this matter to the Merit System Board (Board) for additional proceedings consistent with its decision in order to permit the Board to develop a full factual record and to address the issue of whether the applicable civil service law and regulations permit the certification of a list of eligibles that is about to expire in order to effectuate appointments and fill vacancies at a point in time when vacancies are anticipated but do not yet exist. The Appellate Division did not retain jurisdiction.

ACTION: The Merit System Board directed that this matter be held over.

B-50 EVANGELINE M. DIXON
Evangeline M. Dixon appeals the determination of the Division of Selection Services, which found that she was below the minimum requirements in experience for the examination for Assistant Director of Nursing Services 1 (Developmental Disabilities) (S9135C), Division of Developmental Disabilities. It is noted that his matter was held over from the Board's February 26, 2003 meeting.

ACTION: The Merit System Board directed that this appeal be granted.

B-51 DIVISION OF YOUTH AND FAMILY SERVICES CLERICAL TITLES
The Director, Division of Human Resource Management, requests acknowledgement of an agreement between the Department of Human Services, Division of Youth and Family Services and the Department of Personnel in order to implement a title upgrade for DYFS support staff.

ACTION: The Merit System Board granted the request.
