           A regular meeting of the Civil Service Commission was held on Wednesday, March 6, 2019, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 20, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Kimberly Rouse, Senior Correctional Police Officer, Edna Mahan Correctional Facility, Department of Corrections, removal.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    QUIANA BROWN

 

Quiana Brown, Practical Nurse, New Jersey Veterans Memorial Home - Vineland, Department of Military and Veterans Affairs, removal effective October 19, 2016 on charges of violation of rules, regulations, policies and procedures, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    LUIS DELEON

 

Luis DeLeon, Sheriff’s Officer, Camden County Sheriff’s Office, removal effective August 22, 2018 on charges of inability to perform duty, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    MONIQUE SMITH

 

Monique Smith, Police Captain, Irvington Township, Department of Public Safety, six-month suspension on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the six-month suspension to a 90-day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge to modify the six-month suspension to a 90 working day suspension.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    S.D.L. – CSC DOCKET NO. 2018-2769

 

          S.D.L., represented by Nicholas J. Palma, Esq., appeals his rejection as a Police Officer candidate by the Paterson Police Department and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    J.L.R. – CSC DOCKET NO. 2018-2712

 

          J.L.R., represented by Oswin E. Hadley, Esq., appeals his rejection as a Police Officer candidate by the Jersey City Police Department and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    ANDRE MITCHELL – CSC DOCKET NO. 2019-1003

 

          Andre Mitchell, represented by Wilfredo Benitez, Esq., appeals his removal from the eligible list for County Correction Officer (S9999U), Union County on the basis that he possessed an unsatisfactory driving record.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    JADA SHIVERS – CSC DOCKET NO. 2018-3705

 

          Jada Shivers appeals the removal of her name from the Correctional Police Officer (S9988V), Department of Corrections, eligible list on the basis of a positive drug test.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    WENDY MERCADO – CSC DOCKET NO. 2019-1596

 

          Wendy Mercado appeals the decision of the Division of Agency Services which found that her position with Millville is properly classified as Keyboarding Clerk 2. The appellant seeks a Deputy Registrar of Vital Statistics/ Keyboarding Clerk 3 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    BRIAN CONSTANTINO – CSC DOCKET NO. 2019-1826

 

          Camden County, on behalf of Brian Constantino, appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Assistant Director of Solid Waste Management (PC2051W), Camden County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    ELEANOR CONTRERAS – CSC DOCKET NO. 2019-1902

 

          Eleanor Contreras appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Program Coordinator Aging/Disabilities (PC2857W), Bergen County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    KATHERINE GANGER – CSC DOCKET NO. 2019-1889

 

          Katherine Ganger appeals the decision of the Division of Agency Services which found that she lacked the required license for the examination for Emergency Medical Technician/Hazardous Materials Responder (C0812W), Union County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-9    ROSE MCGILL – CSC DOCKET NO. 2019-1134

 

          Rose McGill appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Administrative Analyst 2 (PS6918LN), Department of Banking and Insurance.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10  MAHMOUD TAMIMI – CSC DOCKET NO. 2018-1889

 

          Mahmoud Tamimi appeals his score on the promotional examination for Sheriff’s Officer Lieutenant (PC2094U), Essex County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11  MATTHEW BOLAND – CSC DOCKET NO. 2019-1728

 

          Matthew Boland requests a retest for the written portion of the examination for Fire Fighter (M9999W), various jurisdictions.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-12  CLAUDETTE BAILEY – CSC DOCKET NO. 2019-1079

 

          Claudette Bailey requests permission to submit a late application for the promotional examination for Project Engineer Electrical (PS8265T), Department of Transportation.

 

ACTION:     The Civil Service Commission directed that this request be denied.

B-14  DEREK D. DOBOL, JR. – CSC DOCKET NO. 2019-1713

 

          Derek D. Dobol, Jr. appeals his removal from the eligible list for Correctional Police Officer (S9988V), Department of Corrections on the basis that he possessed an unsatisfactory driving record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15  PROGRAM COORDINATOR, DRUG AND ALCOHOL ABUSE (C0101W), OCEAN COUNTY BOARD OF HEATH – CSC DOCKET NO. 2019-1112

 

          The Ocean County Board of Health requests permission not to make an appointment from the July 2, 2018 certification for Program Coordinator, Drug and Alcohol Abuse (C0101W).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-16  VINCENT MURRAY – CSC DOCKET NO. 2019-1896

 

          Vincent Murray requests permission to submit an application for the promotional examination for Motor Vehicle Operator 1 (PS4829K), Department of Human Services, after the filing closing date.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-17  R.M. – CSC DOCKET NO. 2018-2857

 

          R.M., represented by Daniel J. Zirrith, Esq., appeals his rejection as a Police Officer candidate by the Parsippany-Troy Hills Police Department and its request to remove his name from the eligible list for Police Officer (S9999U), on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-18  ANTHONY LEWIS – CSC DOCKET NO. 2019-1697

 

          Anthony Lewis, represented by Anthony Imbesi, Esq., appeals his removal from the eligible list for Correctional Police Officer (S9988V), Department of Corrections on the basis that he possessed an unsatisfactory criminal background.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19  JAMES CARROLL – CSC DOCKET NO. 2019-1573

 

          James Carroll appeals the determination of the Division of Agency Services which found that he was below the experience requirements for the promotional examination for Road Repair Supervisor (PC1679W), Mercer County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-20  RAY CURREY, JR. – CSC DOCKET NO. 2019-1184

 

          Ray Currey, Jr. appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the open-competitive examination for Senior Community Program Specialist (S0361W), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-21  ELLENA HERBERT – CSC DOCKET NO. 2019-508

 

          Ellena Herbert appeals the determination of the Division of Agency Services, which found that she did not meet the experience requirement for the promotional examination for Administrative Analyst 3 (PS6733H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be denied and the classification of the appellant’s provisional position be referred to the Division of Agency Services for review.

 

B-22  HAROLD JEAN-LOUIS – CSC DOCKET NO. 2019-2050

 

          Harold Jean-Louis appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Assistant Chief Accountant (M0606W), Newark.

 

ACTION:    The Civil Service Commission directed that this matter be held over.

 

B-23  JOSE MUNOZ – CSC DOCKET NO. 2019-89

 

          Jose Munoz appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Manager, Animal Control Facility (PM0106W), Trenton.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-24  NANCY O’DENNIS-BLISZCZ – CSC DOCKET NO. 2019-771

 

          Nancy O’Dennis-Bliszcz appeals the determination of the Division of Agency Services, which found that she did not meet the experience requirement for the promotional examination for Permit Coordination Officer 1, Environmental Protection (PS6720G), Department of Environmental Protection.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-25  JOSEPH PIROZEK – CSC DOCKET NO. 2019-1995

 

          Joseph Pirozek appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Recreation Supervisor (PC1753W), Ocean County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-26  CHRISTOHER WEIR – CSC DOCKET NO. 2019-1729

 

          Christopher Weir appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the open-competitive examination for the dual title Equipment Operator/Truck Driver (C0696W), Cumberland County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-27  DARIUSZ SZCZESNY – CSC DOCKET NO. 2018-1919

 

          Dariusz Szczesny appeals his score on the promotional examination for Sheriff’s Officer Lieutenant (PC2099U), Middlesex County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-28  GREGORY JOHNSON – CSC DOCKET NO. 2018-1917

 

          Gregory Johnson appeals his score on the promotional examination for Sheriff’s Officer Lieutenant (PC2094U), Essex County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-29  DAVID BENEDETTI – CSC DOCKET NO. 2019-2053

 

          The Department of Transportation requests that David Benedetti’s record be corrected to reflect a provisional appointment, effective December 19, 2009, and a permanent appointment, effective February 22, 2010, to the title of Crew Supervisor Equipment Inspectors.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-30  HENRI ZILLIOX – CSC DOCKET NO. 2019-2089

 

          The Division of Agency Services, on behalf of the Hunterdon County Sheriff’s Office, petitions the Civil Service to relax the provisions of N.J.A.C. 4A:4-7.1A(a) in order to permit the permanent transfer of Henri Zilliox, in the title of County Correction Officer from Monmouth County to Hunterdon County.

 

ACTION:     The Civil Service Commission directed that this petition be granted.

 

B-31  R.J. – CSC DOCKET NOS. 2019-468 AND 2019-1118

 

          R.J., a former Supervisor of Licensing, Banking and Insurance with the Department of Banking and Insurance, appeals the decisions of the Director, Division of EEO/AA, Civil Service Commission, which did not substantiate her allegations to support a finding that she had been subject to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.
