A regular meeting of the Merit System Board was held on Wednesday, January 28, 2004 , in Trenton , New Jersey .

PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Josephine DiRienzo, and Robert J. Long; Barbara Bereski, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2003, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

SUBJECT: Change in the Classification Plan

DEPARTMENT OF ENVIRONMENTAL PROTECTION

The Department of Environmental Protection requests the consolidation of several Trainee titles, and their temporary re-allocation to the non-competitive service.

The Department of Environmental Protection currently utilizes four Trainee titles to classify the functions performed by either environmental science or environmental engineering staff. Three of these four titles have multiple workweeks. All titles require a degree in an area related to environmental science or engineering, and no experience. The "trainee" period provides the experience needed for movement to one of a variety of entry-level titles in either discipline.

The Department requests the consolidation of these Trainee titles into two tracks; one will promote to titles in engineering areas and the other to titles in science areas. Each title will have two workweeks to accommodate the working hours of all units.

It is requested that these titles be temporarily re-allocated to the non-competitive service for a period of two years. The Department contends this action will provide them with an opportunity to aggressively recruit a diverse pool of candidates. This consolidation will permit greater flexibility in the appointment and movement of staff, and will result in the elimination of three titles. Permanent appointments will be given to incumbents currently pending open-competitive examination.

This consolidation can be accomplished by using existing titles, and renaming them where necessary. Unnecessary titles will be inactivated. The appropriate negotiations representatives have been notified and support this request.

Merit System regulations only permit a temporary re-allocation for a one-year period. Thus, this request is intended to incorporate the first year. The Department intends to petition the Merit System Board for a one-year extension prior, or a permanent re-allocation, prior to the conclusion of the first year.

The appeal of Richard A. Sheppard, a former Senior Correction Officer with Southern State Correctional Facility, Department of Corrections, of his 30-day suspension, effective March 22, 2002 , on charges, was heard by Administrative Law Judge John R. Tassini (ALJ), who rendered his initial decision on November 13, 2003 . At its meeting on December 17, 2003 , the Merit System Board (Board) did not adopt the ALJ's recommendation to uphold the appellant's 30-day suspension. Rather, the Board modified the appellant's penalty to a 120 working day suspension. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

The Communications Workers of America, Local 1040 (CWA), on behalf of Beverly Battle, Darlene Mack, and Jacquetta Rawls, and Collen Randazzo on her own behalf, appeal the determination of the Division of Selection Services that they were not employed in the announced unit scope for the promotional examination for Assistant Supervisor of Professional Residential Services, Developmental Disabilities (PS5950K), Vineland Developmental Center - Group Home Operation.

ACTION: The Merit System Board directed that these appeals be denied.

B-121 DEWITT GAMBLE AND CYNTHIA G. (ROBINSON) CAMP

Dewitt Gamble and Cynthia G. (Robinson) Camp, Correction Sergeants with the Department of Corrections (DOC), request retroactive dates of appointment pursuant to a settlement agreement entered into between them and the DOC.

ACTION: The Merit System Board denied the requests.

B-122 ENVIRONMENTAL ENGINEER TRAINEE AND ENVIRONMENTAL SERVICES TRAINEE

The Director, Division of Human Resource Management, requests the consolidation of eleven trainee titles used primarily by the Department of Environmental Protection and the reallocation of the new Environmental Engineer Trainee and Environmental Services Trainee titles to the noncompetitive division of the career service on an interim basis where lists currently do not exist, effective November 15, 2003 through November 12, 2004.

ACTION: The Merit System Board granted the request.

B-123 SALARY REGULATIONS, FY 2004

It is recommended that Aligned Salary Regulation, the Non-Aligned Salary Regulation, the Emergency Conditions Salary Regulation, the Special Incentive Salary Regulations, and the Miscellaneous Salary Regulations be recorded for Fiscal Year 2004.

ACTION: The Merit System Board recorded the Salary Regulations for Fiscal Year 2004.

Jonathan Campo appeals the administration of the examination for Police Sergeant (PM2532C), Ocean City .

ACTION: The Merit System Board directed that his appeal be denied.

Monique Baylor appeals her rejection as a County Correction Officer by Camden County and its request to remove her name from the eligible list for County Correction Officer (S9999D) on the basis of medical unfitness to perform effectively the duties of the position.
