    A regular meeting of the Civil Service Commission was held on Wednesday, April 7, 2021, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2020, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of March 24, 2021.

 

ACTION:      The Civil Service Commission adopted the minutes of its meeting of March 24, 2021.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Richard Dann, Human Services Specialist 2, Gloucester County, Department of Social Services, removal.

 

Brian Neill, Fire Prevention Specialist, Lower Township, Department of Fire Safety, removal.

 

ACTION: The Civil Service Commission noted the withdrawal of appeals without prejudice.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Mark Brown, Tree Maintenance Worker 1, City of Plainfield, Department of Public Works, demotion.

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    CZEZRE ADAMS – CSC DOCKET NO. 2020-1661

 

Czezre Adams, Police Officer, City of Newark, Police Department, removal effective November 13, 2019, on charges of conduct unbecoming a public employee and violation of various departmental policies.

 

Recommendation of the Administrative Law Judge Modify the removal to a six-month suspension.  

 

ACTION:    The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the removal.

 

A-3    ETTA ELLIOTT – CSC DOCKET NO. 2020-219

 

Etta Elliott, Human Services Assistant, Vineland Developmental Center, Department of Human Services, removal and resignation not in good standing effective May 14, 2019, on charges of job abandonment.

 

Recommendation of the Administrative Law Judge Uphold the removal and resignation not in good standing.

  

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    CYNTHIA WHITE – CSC DOCKET NO. 2019-3184

 

Cynthia White, Security Guard, City of Trenton, Department of Public Works, removal effective April 10, 2019, on charges of inability to perform duties.

 

Recommendation of the Administrative Law Judge Dismiss the appeal for failure to appear.

  

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    X.D. – CSC DOCKET NO. 2019-3308

 

          X.D., represented by Randy P. Davenport, Esq., appeals his rejection as a Correctional Police Officer candidate by the Department of Correction and its request to remove his name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    C.A.G. – CSC DOCKET NO. 2020-2243

 

          C.A.G., represented by Kevin P. McGovern, Esq., appeals his rejection as a Fire Fighter candidate by the City of Ocean city and its request to remove his name form the eligible list for Fire Fighter (M1860W) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    C.J.G. – CSC DOCKET NO. 2020-1464

 

          C.J.G. appeals his rejection as a Police Officer candidate by the City of Trenton and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    K.J.S. – CSC DOCKET NO. 2020-923

 

          K.J.S., represented by Michael L. Prigoff, Esq., appeals his rejection as a Fire Fighter candidate by the City of Jersey City and its request to remove his name from the eligible list for Fire Fighter (M1844W) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    C.A.T. – CSC DOCKET NO. 2021-136

 

          C.A.T. appeals his rejection as a Correctional Police Officer by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9988A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    NICHOLAS MARTIN – CSC DOCKET NO. 2020-490

 

          Nicholas Martin appeals the removal of his name from the Correctional Police Officer (S9999U), Department of Corrections eligible list due to an unsatisfactory employment record and falsification of his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    NICHOLAS MARTIN – CSC DOCKET NO. 2020-2473

 

          Nicholas Martin, represented by Katherine D. Hartman, Esq., appeals the removal of his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list due to an unsatisfactory employment record and falsification of his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    OCTAVIO RICHMOND – CSC DOCKET NO. 2020-1120

 

          Octavio Richmond appeals the removal of his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list due to an unsatisfactory employment record and falsification of his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    R.W. – CSC DOCKET NO. 2020-883

 

          R.W., represented by Anthony M. Radice, Esq., appeals the decision of the appointing authority to remove his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10   MICHAEL KINSLEY – CSC DOCKET NO. 2021-370

 

          Michael Kinsley, represented by Carl N. Tripician, Esq., appeals the bypass of his name on the County Correctional Police Lieutenant (PC2913W), Atlantic County eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11   VALENTINA GREEN – CSC DOCKET NO. 2021-555

 

          Valentina Green appeals the decision of the Division of Agency Services which found that her position with the Essex County is properly classified as Management Specialist. Appellant seeks an Administrative Supervisor of Family Services job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12   FABIOLA PIRONE – CSC DOCKET NO. 2021-1317

 

          Fabiola Pirone appeals the determination of the Division of Agency Services that the proper classification of her position with the Department of the Treasury is Pensions Benefits Specialist 1. The appellant seeks a Pensions Benefits Specialist 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13   JING ZHANG – CSC DOCKET NO. 2021-809

 

          Jing Zhang appeals the decision of the Division of Agency Services which found that her position with the Department of Labor and Workforce Development is properly classified as Accountant 3. The appellant seeks an Accountant 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14   JESSMARIE ACEVEDO – CSC DOCKET NO. 2021-666

 

          Jessmarie Acevedo, represented by David H. Weiner, CWA Local 1081, appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open competitive examination for Client Services Representative (C0045B), Essex County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15   BRIAN ALBERTSON – CSC DOCKET NO. 2021-1257

 

          Brian Albertson appeals the determination of the Division of Agency Services which found that he did not meet the minimum requirements in experience for the open-competitive examination for Drafting Technician/Public Works Inspector (C0504B), Burlington County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-16   THERESE BATTAGLIO – CSC DOCKET NO. 2021-1228

 

          Therese Battaglio appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Administrative Secretary (PC2221B), Ocean County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-17   BRANDY R. CHAVEZ – CSC DOCKET NO. 2021-663

 

          Brandy R. Chavez appeals the determination of the Division of Agency Services which found that she did not meet the requirements for the promotional examination for Administrative Secretary (PM0012B), Morristown.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-18   RUDY SOMA – CSC DOCKET NO. 2021-1186

 

          Rudy Soma appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Sewer Repairer 2/Water Repairer 3 (PM2196B), Freehold Township.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-19   DAVID BAILEY, ET AL. – CSC DOCKET NOS. 2021-1238, ET AL.

 

          The Department of Labor and Workforce Development, on behalf of David Bailey, Carol Gilchrist, Shivon Harris, and Jacquelyn Hutchinson petition the Civil Service Commission for retroactive regular appointment dates as Employment and Training Specialist 2s for Bailey and Harris, as a Senior Clerk Transcriber for Gilchrist, and as an Employment and Training Specialist 1 for Hutchinson.

 

ACTION:     The Civil Service Commission directed that these petitions be granted.

 

B-20   DEIRUSKA CORRALES, ET AL. – CSC DOCKET NOS. 2020-1967, ET AL.

 

            The Department of Children and Families requests relaxation of N.J.A.C. 4A:4-5.2(a) in order to accept the completion of the working test periods of Deiruska Corrales, Cullen Huczko, Mindy Miller, Robin Nugent, Jacqueline Poz, Ismeta Saintclair, and Erin Wyckoff as Paralegal Technician Assistants.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-21   MARK NACE – CSC DOCKET NO. 2021-1104

 

          Mark Nace, a County Correctional Police Officer, Warren County, Department of Detention, represented by Giovanna Giampa, Esq., petitions the Civil Service Commission for interim relief of an indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-22   DANIEL VNENCAK – CSC DOCKET NO. 2021-1006

 

          Daniel Vnencak, a former Parking Enforcement Officer with the Town of Boonton Police Department requests additional benefits and remedies based on the Civil Service Commission’s decision In the Matter of Daniel Vnencak (CSC, decided August 19, 2020). Boonton, represented by Adam S. Abramson-Schneider, Esq., requests reimbursement for its overpayment to Vnencak.

ACTION:     The Civil Service Commission directed that Vnencak’s request be granted in part and Boonton’s request be granted.

 

B-23   L.V. – CSC DOCKET NO. 2021-1062

 

          L.V., a Senior Parole Officer, Bilingual in Spanish and English, appeals the decision of the Chairman of the State Parole Board, which was unable to substantiate her allegations that she was subject to discrimination in violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.
