A regular meeting of the Civil Service Commission was held on Wednesday, May 13, 2009, in Trenton, New Jersey.

      PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, John Currie and Margaret E. L. Howard; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

      In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2008, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION:     The Civil Service Commission acknowledged the settlements.
It is noted that Flavella Branham abstained on the settlement for Essex County Layoffs.

A-2    ARNOLD BORRERO

Arnold Borrero, Police Officer, City of Newark, Police Department, removal effective February 5, 2007, on charges of conduct unbecoming a public employee, conviction of a crime and violation of Police Department rules regarding criminal law and unfavorable conduct.

Recommendation of the Administrative Law Judge - Modify the removal to a six-month suspension.

ACTION:      The Civil Service Commission directed that this matter be held over.

A-3    VIVIAN CHESTNUT

Vivian Chestnut, Custodial Worker, Newark School District, removal and resignation not in good standing effective March 10, 2008, on charges of chronic or excessive absenteeism or lateness, neglect of duty, resignation not in good standing and other sufficient cause.

Recommendation of the Administrative Law Judge - Grant appointing authority's motion for summary decision and dismiss the appeal.

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4    THOMAS CORBIN

Thomas Corbin, Park Attendant, Hudson County, Department of Parks Engineering and Planning, removal effective April 13, 2009 on charges of neglect of duty, insubordination, conduct unbecoming a public employee and violation of Federal regulations concerning drug use.

Recommendation of the Administrative Law Judge - Dismiss the appeal, with prejudice, pursuant to an order of forfeiture.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5      JULIO CORDERO

Julio Cordero, Police Officer, City of Jersey City, Police Department, removal effective July 6, 2007, on the charge of inability to perform duties.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-6    MICHAEL FOLIGNO - SETTLEMENT

Michael Foligno, a former Police Lieutenant, Borough of Elmwood Park, Police Department, 90-day suspension and demotion to the title of Police Sergeant on charges of incompetency, inefficiency or failure to perform duties, insubordination, or serious breach of discipline, chronic or excessive absenteeism or lateness, conduct unbecoming a public employee, neglect of duty, misuse of public property, including motor vehicles and other sufficient cause.  Settled to a 90-working day suspension, a five-day suspension, and reinstatement to the title of Police Lieutenant effective January 1, 2009.

Recommendation of the Administrative Law Judge - Acknowledge the settlement.

ACTION:      The Civil Service Commission acknowledged the settlement.

SECTION B - MISCELLANEOUS MATTERS

B-1    ELLIS CHERRY

Ellis Cherry, represented by Peter J. Cresci, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-2    JOSEPH C. FERRARO

Joseph C. Ferraro, represented by Joseph A. Carmen, Esq., appeals his rejection as a Police Officer candidate by Belleville Township and its request to remove his name from the eligible list for Police Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-3    JASON FRANK

Jason Frank, represented by Bianca P. Pereiras, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9999F) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-4    DANIEL GONZALEZ

Daniel Gonzalez, represented by Alexander W. Booth, Esq., appeals his rejection as a Police Officer candidate by Union City and its request to remove his name from the eligible list for Police Officer (S9999F) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-5    BRUCE MOBLEY

Bruce Mobley appeals his rejection as a Fire Fighter candidate by Pleasantville and its request to remove his name from the eligible list for Fire Fighter (M2388H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:     The Civil Service Commission referred the matter for an independent psychological evaluation.

B-6    ALLEN MORRIS

Allen Morris appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-7    ROBERT T. RAIO, JR.

Robert T. Raio, Jr., appeals his rejection as a Police Officer candidate by Winslow Township and its request to remove his name from the eligible list for Police Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:     The Civil Service Commission directed that this appeal be granted.


B-8    RICHARD L. BALDISH

Richard Baldish, a Senior Correction Office with South Woods State Prison, Department of Corrections, represented by Henry J. Cistrelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:     The Civil Service Commission directed that this appeal be granted.

Paulette Caputo, a Practical Nurse with the Juvenile Justice Commission, appeals the denial of sick leave injury (SLI) benefits.

Joseph Crawford, an Institutional Trade Instructor 2, Cooking with the Juvenile Justice Commission, Department of Law and Public Safety, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

Ruben DeJesus, a Correction Officer Recruit with Northern State Prison, Department of Corrections, represented by Henry J. Cistrelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.

Jose Egel, a Senior Correction Officer with Northern State Prison, Department of Corrections, represented by Henry J. Cistrelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

James Gantz, a Senior Correction Officer at Garden State Youth Correctional Facility, Department of Corrections, represented by Frank M. Crivelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-15   CAROLE GERSTENBLUTH

Carole Gerstenbluth, an Assistant Supervisor of Educational Programs 1 at East Jersey State Prison, Department of Corrections, represented by Sarah A. Evans, Staff Representative, CWA Local 1040, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

David Gillespie, a Supervisor, Regional Food Service Operation with the Juvenile Justice Commission, Department of Law and Public Safety, represented by Donald L. Klein, Executive Vice President, CWA Local 1040, appeals the denial of sick leave injury (SLI) benefits.

ACTION:     The Civil Service Commission directed that this appeal be denied.

Arthur Hess, a Staff Assistant 2 at the Department of Military and Veterans Affairs, represented by Gaye Palmer, Staff Representative with the Communications Workers of America, Local 1033, appeals the denial of sick leave injury (SLI) benefits.

B-22   JUDY THORPE

Judy Thorpe, a former Supervisor of Nursing Services with the Juvenile Justice Commission, represented by Christopher Young, Staff Representative, Communications Workers of America, Local 1040, appeals the denial of sick leave injury (SLI) benefits.

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-23   JAIME ARAUJO

Jaime Araujo, represented by Lynsey A. Johnson, Esq., appeals the removal of his name from the Fire Fighter (M2289E), Newark, eligible list due to his failure to meet the residency requirement.

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-24   LUCINDA A. FIGUEROA

Lucinda A. Figueroa appeals the decision of the Division of Local Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Police Officer (S9999H), Newark eligible list on the basis of an unsatisfactory criminal record.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-25   BRAM HEIDENBERG

Bram Heidenberg appeals the decision of the Division of Local Human Resource Management, which upheld the bypass of his name on the Police Sergeant (PM2523G), Hackettstown, eligible list.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-26   RONALD RIGGINS

The Department of Corrections appeals the decision of the Division of State Human Resource Management which reinstated Ronald Riggins' name to the eligible list for Correction Officer Recruit (S9999H).

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-27   SANTOS V. SAENZ

The Township of North Bergen, represented by Mark A. Tabakin, Esq., requests the revival of the S9999H eligible list to effectuate the appointment of Santos V. Saenz to the position of Police Officer.

ACTION:      The Civil Service Commission granted the request.


B-28   ASSISTANT SUPERVISOR OF RESIDENT LIVING, DEVELOPMENTAL DISABILITIES (PS3732K), HUNTERDON DEVELOPMENTAL CENTER

In In the Matter of Assistant Supervisor of Resident Living, Developmental Disabilities (PS3732K), Hunterdon Developmental Center (Merit System Board, decided October 5, 2005), the Board granted the request of the Hunterdon Developmental Center (HDC), Department of Human Services, for an appointment waiver from the June 8, 2005 certification and ordered that no selection costs be assessed at that time since there was a possibility that the list could be utilized prior to its expiration.  However, the HDC did not utilize the subject eligible list and the matter of the assessment of costs is now before the Civil Service Commission.

ACTION:     The Civil Service Commission assessed selection costs in the amount of $1,602.

B-29   AUDIO VIDEO SPECIALIST (M0214K) WOODBRIDGE TOWNSHIP

Woodbridge Township requests permission not to make an appointment from the August 12, 2008 certification for Audio Video Specialist (M0214K).

ACTION:      The Civil Service Commission granted the request for an appointment waiver and assessed selection costs in the amount of $2,048.

B-30   FIRE PREVENTION SPECIALIST (M9867H), MONTVILLE FIRE DISTRICT #2

Montville Fire District #2 requests permission not to make an appointment from the October 24, 2007 certification for Fire Prevention Specialist (M9867H).

ACTION:      The Civil Service Commission granted the request for an appointment waiver and assessed selection costs in the amount of $2,048.

B-31   HOUSING INSPECTOR (M6106J), GLOUCESTER TOWNSHIP

Gloucester Township requests permission not to make an appointment from the September 25, 2007 certification for Housing Inspector (M6106J).

ACTION:      The Civil Service Commission denied the request for an appointment waiver and ordered the appointing authority to properly dispose of the certification and remit $500 in compliance costs.

B-32   REGULATORY OFFICER 1 (S3034F), DEPARTMENT OF HEALTH AND SENIOR SERVICES

In In the Matter of Regulatory Officer (S3034F), Department of Health and Senior Services (DHSS) (Merit System Board, decided July 19, 2006), the Board granted the request of DHSS for an appointment waiver for the October 28, 2005 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration.  However, DHSS did not utilize the subject eligible list and the matter of the assessment of costs is now before the Civil Service Commission.

ACTION:      The Civil Service Commission assessed selection costs in the amount of $8,285.

B-33   SANITATION DRIVER (M0151K), LONG BRANCH

Long Branch requests permission not to make an appointment from the June 16, 2008 certification for Sanitation Driver (M0151K).

ACTION:      The Civil Service Commission denied the request for an appointment waiver and ordered the appointing authority to properly dispose of the certification and remit $500 in compliance costs.

B-34   SUPERVISING ENVIRONMENTAL SPECIALIST (SPECIAL) & (PS5798G), DEPARTMENT OF ENVIRONMENTAL PROTECTION

The Department of Environmental Protection (DEP) requests permission not to make an appointment from the May 20, 2008 certification for Supervising Environmental Specialist (Special) & (PS5798G), DEP.

ACTION:      The Civil Service Commission granted the request and directed that no selection costs be assessed at this time.

B-35   DALE E. ALEXANDER

Dale E. Alexander, a Senior Interviewer (Veterans Services) with the Department of Labor and Workforce Development (DLWD), appeals the determination of the Commissioner, DLWD, finding that he violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this matter be held over.

B-36   RAUL COUCE

Raul Couce, a Sergeant, Field Operations with the Department of Law and Public Safety, appeals the determination of the Chief of Staff, Office of the Attorney General, stating that the appellant failed to present sufficient evidence to support a finding that had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-37   STACEY GOODALL

Stacey Goodall, a Senior Correction Officer at Northern State Prison, Department of Corrections (DOC), appeals the determination of the Director of the Equal Employment Division of the DOC, stating that the appellant had failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-38   MICHELE GREAVES

Michele Greaves, an Investigator 3, Law and Public Safety with the Division of State Police, Department of Law and Public Safety (DLPS), appeals the determination of the Director, Office of Equal Employment Opportunity, DLPS, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-39   CELESTE LAMPLEY

Celeste Lampley, an Unemployment Insurance Clerk with the Department of Labor and Workforce Development (DLWD), appeals the determination of the Commissioner, DLWD, stating that the appellant did not present sufficient evidence to support a finding that she had been subject to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-40   JUDY THORPE

Judy Thorpe, a former Supervisor of Nursing Services with the Juvenile Justice Commission, appeals the determination of the Equal Employment Opportunity Office, Department of Law and Public Safety, stating that the appellant did not present sufficient evidence to support a finding that she had been subject to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission directed that this appeal be denied.


B-41   JOANN CALCESE

Joann Calcese appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Secretarial Assistant 3.  The appellant seeks a Secretarial Assistant 2 classification.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-42   LUZ DIAZ

Luz Diaz appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Senior Investigator, Public Defender (Bilingual in Spanish and English).  The appellant seeks a Principal Investigator, Public Defender (Bilingual in Spanish and English) classification.

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-43   MICHELE GREAVES

Michele Greaves appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Investigator 3, Law and Public Safety.  The appellant seeks an Investigator 2, Law and Public Safety classification.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-44   ANDREW KOHLMAYER

Andrew Kohlmayer appeals the determination of the Division of State Human Resource Management that his position is properly classified as a Printing Machine Operator 2 with the Department of Labor and Workforce Development.  The appellant seeks a Printing Operations Technician 1 classification in this proceeding.

ACTION:      The Civil Service Commission directed that this appeal be denied.


B-45   CHRISTOPHER LUBERTO

Christopher Luberto, represented by Robert O. Yaeger, Principal Staff Representative, Communications Workers of America, Local 1040, appeals the decision of the Division of Local Human Resource Management that the proper classification of his position is Registered Environmental Health Specialist, Public Health.  The appellant seeks a Senior Registered Environmental Health Specialist, Public Health classification.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-46   JAMES MUELLER

James Mueller appeals the decision of the Division of Local Human Resource Management (LHRM) that his position is properly classified as Network Administrator 1.  The appellant seeks a Senior Systems Analyst classification in this proceeding.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-47   THERESA SWEENEY

Theresa Sweeney appeals the decision of the Division of State Human Resource Management that the proper classification of her position is Head Clerk.  The appellant seeks an Administrative Analyst 4 or an Administrative Analyst 4 (Data Processing) classification.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-48   JOHN CRILLEY

John Crilley appeals the decision of the Division of Selection Services which found that he lacked the required amount of continuous permanent status as of the closing date for the promotional examination for Battalion Fire Chief (PM3517L), Town of Harrison and he requests a retroactive appointment date as a Fire Captain.

ACTION:      The Civil Service Commission directed that this appeal be granted.
B-49   DAVID MACFARLAND

David MacFarland, a Fire Fighter with Bordentown Township Fire District #2, represented by John F. Pilles, Jr., Esq., appeals his immediate suspension, effective January 29, 2009.

ACTION:      The Civil Service Commission directed that this appeal be granted in part.

B-50   JUAN RODRIGUEZ

Juan Rodriguez, a Police Officer with the City of Camden, represented by John P. Rowland, Esq., petitions the Civil Service Commission for interim relief of his immediate suspension effective February 18, 2009.

ACTION:      The Civil Service Commission denied the request.

B-51   NIOCLE GLONEK

Nicole Glonek, a former Senior Clerk Typist with Hamilton Township, petitions the Civil Service Commission for reconsideration of the final administrative decision rendered on November 24, 2008, in which the Director of the Division of Merit System Practices and Labor Relations denied her request for a hearing with respect to her removal from employment.

ACTION:      The Civil Service Commission granted the request for reconsideration.

B-52   JUDY JILES

Judy Jiles, represented by Robert L. Tarver, Jr., Esq., requests reconsideration of the final administrative decision, rendered on August 27, 2008, which found that the appointing authority had presented sufficient evidence to uphold the decision removing her from State service.

ACTION:     The Civil Service Commission denied the request for reconsideration.


B-53   CHARLENE SHEEHAN

Charlene Sheehan, a former Senior Clerk Typist with Bergen County, represented by Richard M. Greenspan, Esq., petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on March 17, 2009, in which the Director of the Division of Merit System Practices and Labor Relations denied her request for a hearing with respect to her removal from employment and resignation not in good standing.

ACTION:      The Civil Service Commission granted the request for reconsideration and directed that the matter be referred to the Office of Administrative Law for a hearing.

B-54   SPEECH AND HEARING PATHOLOGY TITLE SERIES

The Communications Workers of America, Local 1040, represented by Robert O. Yaeger, Principal Staff Representative, requests reconsideration of the decision rendered on December 3, 2008, which found that an insufficient basis had been presented to warrant reevaluation of the Speech and Hearing Pathology title series.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-55   JUDY THORPE

Judy Thorpe, a former Supervisor of Nursing Services with the Juvenile Justice Commission, requests reconsideration of the decision rendered on November 8, 2007, which found that she was not entitle to sick leave injury (SLI) benefits.

ACTION:     The Civil Service Commission denied the request for reconsideration.


B-56   RAYMOND CALUBAYAN

Raymond Calubayan appeals the decision of the Division of Selection Services that, per the substitution clause for education, he did not meet the experience requirements for the promotional examination for Network Administrator 1 (PM1423J), Camden City.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-57   PATRICIA EPPS

Patricia Epps appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Assistant Training Supervisor, County Welfare Agency (PS1029K), Essex County.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-58   TERRY V. EVANS

Terry V. Evans appeals the determination of the Division of Selection Services which found that she did not meet the requirements for the promotional examination for Senior Standards and Procedures Technician (PS9189I), Department of Corrections.

ACTION:      The Civil Service Commission directed that this appeal be granted.

Damon Koslow appeals the decision of the Division of Selection Services that he was below the minimum requirements in experience for the promotional examination for Executive Assistant 3 (PS5732K), Department of Children and Families.

ACTION:      The Civil Service Commission directed that this appeal be dismissed as moot.

The City of Newark (Newark) requests that the eligible list for Supervising Public Safety Telecommunicator (PM1925E), Newark be revived in order to effectuate the permanent appointment of Ethan Mann, effective April 11, 2005.  Additionally, Ethan Mann appeals the determination of the Division of Selection Services which found him ineligible for the promotional examination for Chief Public Safety Telecommunicator (PM0633K).

ACTION:      The Civil Service Commission directed that the request and appeal be granted.

Nancy McGarigal appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Technical Assistant 2, Higher Education (PS9976J), Richard Stockton College.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-82   READOPTION OF N.J.A.C 4A:3, CLASSIFICATION, SERVICES AND COMPENSATION

Submitted for the Commissions review is a Notice of Proposal regarding the proposed readoption of N.J.A.C. 4A:3, Classification, Services, and Compensation.  This rule chapter is scheduled to expire on June 4, 2009 but will be automatically extended for six months.  It is recommended that this proposal be approved for publication in the New Jersey Register.

ACTION:      The Civil Service Commission approved the proposal for publication in the New Jersey Register.

The Minutes of the Civil Service Commission Meeting of April 29, 2009 are submitted for adoption.

ACTION:     The Civil Service Commission adopted the minutes of its meeting of April 29, 2009.

B-84   SCOTT EDWARDS

The Borough of Hopatcong requests that the eligible list for Public Works Repairer (M6549C) be revived in order to effectuate the permanent appointment of Scott Edwards, effective October 28, 2002.

ACTION:      The Civil Service Commission granted the request.

B-85   ANGELA BRADLEY

The appeal of Angela Bradley, Police Officer, City of Newark, of her removal on charges, was considered by Administrative Law Judge James A. Geraghty (ALJ), who rendered his initial decision on November 18, 2008, recommending acknowledgement of the settlement of the parties.

ACTION:      The Civil Service Commission remanded the matter to the Office of Administrative Law.

B-86   SAKINAH COTTON

The appeal of Sakinah Cotton, Police Officer, City of Newark, of her removal effective June 18, 2007, on charges was heard by Administrative Law Judge Jesse H. Strauss who rendered his initial decision on October 28, 2008, recommending acknowledgement of the settlement.

ACTION:      The Civil Service Commission remanded the matter to the Office of Administrative Law.

B-87   KARAMA THOMAS

The appeal of Karama Thomas, Police Officer, City of Newark, of her 30-day suspension and removal effective April 8, 2008, on charges, was heard by Administrative Law Judge Joseph A. Paone, who rendered his initial decision February 10, 2009, recommending acknowledgement of the settlement.

ACTION:      The Civil Service Commission remanded the matter to the Office of Administrative Law.


B-88   MARY LAUFFER

The appeal of Mary Lauffer, a Supervisor 1 with the Judiciary, Essex Vicinage, of her demotion to the position of Judiciary Clerk 4, effective February 15, 2008, on charges, was heard by Administrative Law Judge Jesse H. Strauss (ALJ), who rendered his initial decision on March 3, 2009.  At its meeting of April 29, 2009, the Civil Service Commission adopted the ALJ's recommendation to uphold the demotion.  The proposed final decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the final decision.
