A regular meeting of the Merit System Board was held on Wednesday June 21, 2006, in Trenton, New Jersey.

PRESENT: Chairman Rolando Torres, Jr., Merit System Board Members, John Currie, Margaret E. L. Howard and Robert J. Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairman Rolando Torres Jr., opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 12, 2005, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

 

CONFIDENTIAL APPOINTMENTS
The Merit System Board recorded the following Confidential Appointments under N.J.S.A. 11A:3-4(h):

Lisa Alexander, appointed as a Confidential Assistant, Department of Human Services, effective January 21, 2006, salary of $117,762.88 per annum.

Katherine Bernyk, appointed as Confidential Assistant, Department of Human Services, effective February 18, 2006, salary of $42,000.00 per annum.

Carol Burset, appointed as Confidential Secretary, Department of Human Services, effective April 1, 2006, salary of $64,143.45 per annum.

SUBJECT: Change in the Classification Plan

DEPARTMENT OF TRANSPORTATION

The Department of Transportation requests the creation of a new title series for the Emergency Service Patrol Program (ESP). Staff from this program patrol State roadways and provide assistance to disabled motorists and others during emergency and accident situations. The Department utilizes existing highway and maintenance titles to perform these functions, but these titles do not accurately reflect the duties performed.

The Department of Transportation requests the entry level title in the series, Emergency Service Patrol Apprentice, be assigned to the non-competitive service. The Apprentice title will have no education or experience requirements. The Department of Transportation proposes a two (2) year apprenticeship period during which appointees will complete specific classroom and on-the-job training sufficient to prepare incumbents for the primary title. Competitive testing is not practical at the Apprentice level. The primary title requires a unique mixture of skills that are better acquired through a combination of on-the-job training and formal instruction. All other levels in the series will be assigned to the competitive service.

The Department of Transportation requests these appointments be processed as promotions pending examination with promotional salary calculations for employees whose movements represent an increase in class code. Movements between titles having the same class codes will be processed as lateral appointments with retention of existing salary and status. Incumbents promoted to non-competitive titles will be subject to a current working test period commencing with the processing of the personnel action.

The appropriate negotiations representatives are aware of and support this request. The bargaining units were established by the Office of Employee Relations.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

A-2 MICHAEL OLOFINTUYI

Michael Olofintuyi, Senior Engineer, Bridge Structure Evaluation, Department of Transportation, return to formerly held permanent title at the end of the working test period effective April 16, 2005.

Recommendation of the Administrative Law Judge – Uphold the return to formerly held permanent title at the end of the working test period.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-3 MARK WILLIAMS

Mark Williams, Fire Fighter, City of Atlantic City, Department of Public Safety, 10-day suspension on charges of violation of departmental rules and regulations regarding conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Reverse the 10-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

Petra M. James, Senior Parole Officer, State Parole Board, Department of Corrections, two removals effective May 2, 2002, removal effective June 4, 2002 and a removal effective June 14, 2002, on charges of, inter alia, incompetency, inefficiency or failure to perform duties, neglect of duty and violation of a rule, regulation, policy, procedure, order, or administrative decision.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-6 GLENROY SANGSTER

Glenroy Sangster, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal effective February 7, 2005, on the charge of physical abuse of a patient.

Nancy Pavez, Cottage Training Technician, Hunterdon Developmental Center, Department of Human Services, removal effective March 3, 2004, on the charge of physical abuse of a client. This matter was held over from the May 10, 2006 Merit System Board meeting.

SECTION B – MISCELLANEOUS MATTERS

B-1 AJA J. FRANKLIN

Aja J. Franklin appeals the removal of her name from the (S9999F) eligible list for the title of County Correction Officer, County of Essex on the basis of psychological unfitness.

ACTION: The Merit System Board directed that this appeal be denied.

B-2 CHRISTOPHER FADEYEV

Christopher Fadeyev, a Correction Captain at New Jersey State Prison, Department of Corrections, represented by Samuel M. Gaylord, Esq., appeals the denial of sick leave injury (SLI) benefits for two separate incidents. The appellant also requests a waiver of repayment of a salary overpayment pursuant to N.J.S.A. 11A:3-7, which provides that when an employee has erroneously received a salary overpayment, the Commissioner of Personnel may waive repayment based on a review of the case.

ACTION: The Merit System Board directed that the SLI appeal be granted in part and directed that the request for a waiver of repayment of a salary overpayment be dismissed as moot.

B-3 FRED HARRINGTON

Fred Harrington, a Senior Correction Officer at Northern State Prison, Department of Corrections, represented by Thomas L. Bell, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal be granted.

B-4 LORI LORSCH

Lori Lorsch, a Principal Clerk Typist with the Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal be granted.

B-5 RICHARD DINKINS, JR.

Richard Dinkins, Jr., appeals the decision of Human Resource Information Services, which upheld the removal of his name from the eligible list for Police Officer (S9999F), Township of West Orange based on an unsatisfactory background report.

ACTION: The Merit System Board directed that this appeal be denied.

B-6 TYRONE MABSON

Tyrone Mabson appeals the decision of Human Resource Information Services indicating that he was not considered for appointment from the Juvenile Detention Officer (C2097F), Monmouth County eligible list due to his failure to complete preemployment processing.

ACTION: The Merit System Board directed that this appeal be denied.

B-7 FRANK L. MANZO

Frank L. Manzo, represented by Charles J. Sciarra, Esq., appeals the decision of the Division of Human Resource Information Systems which found that the appointing authorities had presented a sufficient basis to remove his name from the eligible list for Police Officer (S9999D), Jersey City, and Sheriff’s Officer (S9999D), Hudson County, on the basis of an unsatisfactory criminal history.

ACTION: The Merit System Board directed that these appeals be denied.

B-8 CUSTOMER SERVICE REPRESENTATIVE (M0926G), TOWNSHIP OF VERNON

The Township of Vernon requests permission not to make an appointment from the November 4, 2005 certification for Customer Service Representative (M0926G).

ACTION: The Merit System Board granted the request for an appointment waiver but assessed costs.

Atlantic County requests permission not to make an appointment from a certification for Investigator, Consumer Protection (C0885F), Atlantic County.

B-10 MAINTENANCE REPAIRER (M6029G), BERKELEY TOWNSHIP SCHOOL DISTRICT

The Berkeley Township School District requests permission not to make an appointment from the September 13, 2005 certification for Maintenance Repairer (M6029G).

ACTION: The Merit System Board granted the request for an appointment waiver, but assessed costs.

B-11 MARK CORNELL

Mark Cornell, a Grounds Worker with New Lisbon Developmental Center, Department of Human Services, requests that the Merit System Board set aside Settlement Agreements he entered into with New Lisbon to resolve disciplinary matters and grant him a hearing at the Office of Administrative Law on those matters.

ACTION: The Merit System Board denied the request.

B-12 JONATHAN WHEELER

Jonathan Wheeler, a Battalion Fire Chief with the City of Newark, petitions the Merit System Board for enforcement of the settlement agreement, which was acknowledged by the Board on January 24, 1989.

ACTION: The Merit System Board dismissed the appeal as untimely.

B-13 RUSSELL BOUFFARD AND RICHARD LASCO

Russell Bouffard and Richard Lasco, Police Officers with the City of Atlantic City, represented by Erika A. Appenzeller, Esq., petition the Merit System Board for interim relief of their immediate suspensions, effective April 9, 2006.

ACTION: The Merit System Board granted the petitions in part and directed that the petitioners be awarded back pay for the period from May 10, 2006 through the date of commencement of the departmental hearing.

B-14 THOMAS CONDENTO

Thomas Condento, a Police Lieutenant with the City of Newark, represented by Anthony J. Fusco, Jr., Esq., appeals his immediate suspension, effective April 25, 2006.

ACTION: The Merit System Board directed that this appeal be granted.

B-15 GEORGE HERRIOTT

George Herriott, a County Correction Officer with Essex County, represented by Timothy R. Smith, Esq., petitions the Merit System Board for interim relief of this immediate suspension, effective September 25, 2004.

ACTION: The Merit System Board directed that that the petitioner be granted back pay from March 2, 2006 through the date of commencement of the departmental hearing.

Michael Larino, a Fire Fighter with the City of Bayonne, represented by Craig S. Gumpel, Esq., requests a hearing on his suspension.

ACTION: The Merit System Board granted a hearing.

Christine Zayas, a School Clerk with the Newark School District, represented by Sidney H. Lehmann, Esq., petitions the Merit System Board for a determination of her entitlement to permanent status.

ACTION: The Merit System Board granted the request.
B-18 CHAD S. BATIUK

Chad Batiuk, represented by Sidney Lehmann, Esq., requests reconsideration of the Merit System Board decision, In the Matter of Chad Batiuk (MSB, decided February 22, 2006), which removed his name from the eligible list after an updated background check for a position as a Police Officer (S9999D), Woodbridge Township.

ACTION: The Merit System Board denied the request for reconsideration.

B-19 CHIEF CLERK (C8005F), ESSEX COUNTY SHERIFF’S OFFICE

The Essex County Sheriff’s Office requests reconsideration of the decision rendered on February 8, 2006 by the Merit System Board in In the Matter of Chief Clerk (C8005F), Essex County Sheriff’s Office, which ordered it to immediately remove the provisional incumbent Julius Coltre, and to properly dispose of the April 25, 2005 certification within 30 days.

ACTION: The Merit System Board granted the request for reconsideration and an appointment waiver, but assessed costs.

B-20 DORIAN COOPER

Dorian Cooper, a Security Officer with the Newark Housing Authority, represented by Benjamin A. Spivack, Esq., petitions the Merit System Board for reconsideration of that part of the final decision, rendered on March 8, 2006, which upheld his removal.

ACTION: The Merit System Board denied the request for reconsideration.

B-21 JOHN MALESKI

John Maleski requests reconsideration of the Merit System Board’s decision rendered on February 22, 2006 in which appellant’s challenge of his score and the validity of the examination for Operations Shift Superintendent OIT (PS1449U), Department of Treasury was denied.

ACTION: The Merit System Board denied the request for reconsideration.

B-22 MATTHEW GREEN

The appeal of Matthew Green, a Cottage Training Technician at Vineland Developmental Center, Department of Human Services, of his removal, effective May 12, 2003, on charges, was heard by Administrative Law Judge (ALJ) Joseph F. Martone, who rendered his initial decision on May 2, 2006. At its meeting on June 7, 2006, the Merit System Board did not adopt the ALJ’s recommendation to uphold the removal. Rather, the Board modified the removal to a six-month suspension. The proposed decision is now submitted for the Board’s review.

ACTION: The Merit System Board adopted the decision.

B-23 RAQUEL MORTON

The appeal of Raquel Morton, a Police Officer with the City of Camden, of her removal effective December 17, 2003, on charges, was heard by Administrative Law Judge Joseph Paone (ALJ), who rendered his initial decision on May 2, 2006, upholding the removal. At its meeting on June 7, 2006, the Merit System Board adopted the ALJ’s recommendation to uphold the removal. The proposed final decision is now submitted for the Board’s review.

ACTION: The Merit System Board adopted the final decision.

B-24 THOMAS RICIGLIANO

The appeal of Thomas Ricigliano, a County Correction Officer with the Mercer County Department of Public Safety, of his 15-day suspension on charges, was heard by Administrative Law Judge (ALJ) Joseph F. Martone, who rendered his initial decision on April 12, 2006. At its meeting on June 7, 2006, the Merit System Board adopted the ALJ’s recommendation to uphold the 15-day suspension. The proposed final decision is now submitted for the Board’s review.

ACTION: The Merit System Board adopted the final decision.

B-25 DAVID WRIGHT

The appeal of David Wright, a Fire Fighter with the City of Trenton of his 10-day and 60-day suspensions and removal, effective April 8, 2002, on charges, was before Administrative Law Judge Solomon A. Metzger (ALJ), who rendered his initial decision on April 24, 2006. At its meeting on June 7, 2006, the Merit System Board did not adopt the ALJ’s recommendation to remove the appellant. Rather, the Board modified the removal to a resignation in good standing. The proposed final decision is now submitted for the Board’s review.

ACTION: The Merit System Board adopted the final decision.

B-26 LISA BICKELL

The Division of Human Resource Management requests that the Merit System Board order Jackson Township to comply with a classification review of Lisa Bickell’s position.

ACTION: The Merit System Board granted the request.

B-27 NANCY CIARUFFOLI

Richard M. Shaw, Director, Operations Support, Department of Transportation, on behalf of Nancy Ciaruffoli, appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for a prospective provisional appointment to the title of Program Development Specialist 2, Department of Transportation.

ACTION: The Merit System Board directed that this appeal be denied.

B-28 SUSAN DANLEY

Susan Danley appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Senior Clerk Typist (PS8035P), Election Law Enforcement Commission.

ACTION: The Merit System Board directed that this appeal be granted.

The City of Jersey City, represented by Anthony DeSalvo, Assistant Corporation Counsel, requests relaxation of N.J.A.C. 4A:4-7.1A(c) so as to permit the intergovernmental transfers of Jeffrey Hennessey, Thomas Mitchell, Anthony Vlachos and Gregory Yurchak from the title of Sheriff’s Officer, Hudson County Sheriff’s Office, to the title of Police Officer, City of Jersey City.

ACTION: The Merit System Board granted the request.

B-67 RESOURCE INTERPRETIVE SPECIALIST 1 (NATURAL RESOURCES), DEPARTMENT OF ENVIRONMENTAL PROTECTION AND NATURAL RESOURCE INTERPRETATION TECHNICIAN, DEPARTMENT OF ENVIRONMENTAL PROTECTION

The Director, Division of Human Resource Management (HRM), requests the reallocation of the Resource Interpretive Specialist 1 (Natural Resources), Department of Environmental Protection and Natural Resource Interpretation Technician, DEP titles to the noncompetitive division of the career service for one pay period.

ACTION: The Merit System Board granted the request.

The Commissioner, Department of Personnel, recommends relaxation of eligibility criteria to extend the voluntary furlough program up to the end of fiscal year 2007.

Susan Miller appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for a prospective provisional appointment to the title of Administrative Analyst 1, Motor Vehicle Commission.

ACTION: The Merit System Board directed that this appeal be denied.

B-71 MATTHEW TRAIGER

Matthew Traiger appeals the decision of the Division of Selection Services denying his request for a make-up examination for Police Sergeant (PM2521G), Fort Lee.

ACTION: The Merit System Board granted the request.

B-72 ASSISTANT ENGINEER, CITY OF CLIFTON

The Division of Human Resource Management requests that the provisions of N.J.A.C. 4A:4-3.2(a), which govern the ordering of names on open competitive eligible lists, be relaxed to permit it to open the Assistant Engineer, City of Clifton examination with equal preference to residents of Essex, Passaic, and Hudson Counties.

ACTION: The Merit System Board granted the request.

B-73 PROPOSED AMENDMENTS TO N.J.A.C. 4A:2-1.6, 1.7, 2.1, 2.2, 2.7, 2.9 AND 2.10 (APPEALS, DISCIPLINE AND SEPARATIONS).

Submitted for the Merit System Board’s adoption are proposed amendments to N.J.A.C. 4A:2-1.6, 1.7, 2.1, 2.2, 2.7, 2.9, and 2.10 (Appeals, Discipline and Separations).

ACTION: The Merit System Board adopted the proposed amendments with the exception of N.J.A.C. 4A:2-2.10
