Ciro Mangione, Police Lieutenant, City of Newark, Police Department, six-day suspension on charges of violation of rules regarding care of property, misuse of public property, including motor vehicles and disobedience of orders.
Recommendation of the Administrative Law Judge - Grant the appellant's motion for summary decision and reverse the six-day suspension.
ACTION: The Civil Service Commission rejected the recommendation of the Administrative Law Judge to uphold the six-day suspension.

A-11 DERRICK DUNSON
Derrick Dunson, Police Officer, City of Newark, Police Department, removal effective April 1, 2008, on charges of inability to perform duties, violation of police department rules regarding mental and physical capability, and other sufficient cause.
Recommendation of the Administrative Law Judge - Modify the removal to a resignation in good standing.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-12 PHARENTON ROLLE
Pharenton Rolle, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal effective April 16, 2007, on charges of conviction of a crime, conduct unbecoming a public employee and other sufficient cause.
Recommendation of the Administrative Law Judge - Grant appointing authority's motion for partial summary decision to sustain the charge of conviction of a criminal offense but deny summary decision as to the penalty.
ACTION: The Civil Service Commission declined to render a decision and returned the matter to the Office of Administrative Law for review at the end of the contested case pursuant to N.J.A.C. 1:1-12.5(e).
A-13 MARCO URQUIA
Marco Urquia, Juvenile Detention Officer, Morris County, Department of Human Services, removal effective February 10, 2010, on charges of failure to perform duties, chronic or excessive absenteeism and other sufficient cause.
Recommendation of the Administrative Law Judge - Dismiss the appeal for lack of prosecution and failure to appear.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-14 NEELY JOHNSON (SETTLEMENT)
Neely Johnson, Food Service Worker, Cumberland County, Cumberland Manor, removal effective June 2, 2009, on the charge of other sufficient cause, settled to a six month suspension and reinstatement.
Recommendation of the Administrative Law Judge - Acknowledge the settlement.
ACTION: The Civil Service Commission acknowledged the settlement as clarified.
SECTION B - MISCELLANEOUS MATTERS B-1 CHANGE IN THE STATE CLASSIFICATION PLAN
The Division of State and Local Operations requests the inactivation of the Librarian Garden State School District title, effective May 2010.
 ACTION: The Civil Service Commission approved the inactivation of the title.
B-2 CHANGE IN THE STATE CLASSIFICATION PLAN
The Department of Human Services (DHS) requests reactivation, work week changes, and title verbiage changes for the Disabilities Services Specialist title. The title shall be renamed Disabilities Service Specialist 2, effective May 22, 2010, remain the in the unclassified service and be assigned exclusively to DHS.
 ACTION: The Civil Service Commission approved the request.
B-3 CHANGE IN THE STATE CLASSIFICATION PLAN
The Judiciary requests the creation of new non-competitive titles, Substance Abuse Evaluator and Substance Abuse Evaluator, Bilingual in Spanish and English, to classify incumbents in the title of "Tentative Tile Professional Case," effective January 2, 2010. The Judiciary requests establishment of these titles in the non-competitive division of the career service due to the difficulty in recruitment and a limited applicant pool.
 ACTION: The Civil Service Commission approved the establishment of the new titles.

Stephen Butkus, a Highway Marker with the Department of Transportation, appeals the denial of sick leave injury (SLI) benefits.
ACTION: The Civil Service Commission directed that this appeal be denied.

Brian Cohan, a Human Services Assistant with Ancora Psychiatric Hospital, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

B-20 INVESTIGATOR, COUNTY WELFARE AGENCY (PC0836H), CAMDEN COUNTY BOARD OF SOCIAL SERVICES
The Camden County Board of Social Services requests the extension of the eligible list for Investigator, County Welfare Agency (PC0836H).
ACTION: The Civil Service Commission granted the request.
B-21 SENIOR FIELD REPRESENTATIVE, PROPERTY IMPROVEMENT (M0470K), NEWARK
Newark requests permission not to make an appointment from the October 27, 2008 certification for Senior Field Representative, Property Improvement (M0470K).
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.
B-22 TECHNICAL ASSISTANT 3 (PS0882U), DEPARTMENT OF THE TREASURY
The Division of Selection Services requests that the promotional list for Technical Assistant 3 (PS0882U), Department of the Treasury, be cancelled.
ACTION: The Civil Service Commission granted the request.
B-23 VANESSA WARREN
Vanessa Warren, a former Senior Correction Officer with Northern State Prison, Department of Corrections, appeals the determination of the Director, Equal Employment Division, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-24 JOHN CESALETTI
John Cesaletti appeals the decision of the Division of State and Local Operations that the proper classification of his position with the Board of Public Utilities is Customer Representative 1, Public Utilities. The appellant seeks an Administrative Analyst 2 classification.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-25 SABRINA CHENG
Sabrina Cheng, represented by Annmarie Pinarski, Esq., appeals the determination of the former Division of Human Resource Management (HRM) that her position with the Catastrophic Illness in Children Relief Fund was properly classified as a Medical Social Work Consultant 1. The appellant also appeals the determination of her layoff rights upon her layoff from the title of Program Support Specialist 1, Assistance Programs, effective August 29, 2008.
ACTION: The Civil Service Commission directed that the classification appeal be granted in part and the effective date of her reclassification be recorded as January 7, 2006. The Civil Service Commission directed that the appellant's layoff rights appeal be denied but her payment for unused vacation leave be recalculated.
B-26 SABRINA CHENG
The Catastrophic Illness in Children Relief Fund, represented by Nicole P. Grosvenor, Deputy Attorney General, requests interlocutory review of the order of Administrative Law Judge Ronald W. Reba in Sabrina Cheng v. Catastrophic Illness in Children Relief Fund, CSC Docket No. 2009-812, OAL docket No. CSV 6882-08, pursuant to N.J.A.C. 1:1-14.10(a).
ACTION: The Civil Service Commission granted the request for interlocutory review and directed that the appeal of the good faith of the appellant's layoff be denied.
B-27 WALTER CHRISTY
The City of Salem (Salem), represented by David J. Puma, Esq., requests relief on behalf of Walter Christy, a Police Officer with Salem.
ACTION: The Civil Service Commission directed that this matter be held over.
B-28 MILLVILLE LAYOFF
The Policemen's Benevolent Association Local 213, the Millville Police Supervisors' Association, the Firemen's Mutual Benevolent Association Local #63, and the New Jersey Civil Service Association, Cumberland Council 18 (unions), represented by Mark Belland, Esq., and Kevin Jarvis, Esq., petition the Civil Service Commission for a stay of the layoff of employees in Millville.
ACTION: The Civil Service Commission denied the request.
B-29 JOSEPH MONGIELLO
Joseph Mongiello, a Police Sergeant with Parsippany-Troy Hills, represented by Gina Mendola Longarzo, Esq., petitions the Civil Service Commission for relief, pursuant to N.J.S.A. 11A:2-24 and N.J.A.C. 4A:2-5.1 from alleged reprisal by his employer. It is noted that this matter was held over from the Civil Service Commission meeting of April 28, 2010.
ACTION: The Civil Service Commission granted a hearing.
B-30 JEFFREY SIMON
Jeffrey Simon, a former County Correction Officer with Monmouth County, represented by Robert A. Fagella, Esq., petitions the Civil Service Commission for relief regarding his layoff effective May 1, 2009. Mr. Simon also appeals the determination of the Division of State and Local Operations not to place his name on the special reemployment list for County Correction Officer.
ACTION: The Civil Service Commission directed that the petition and appeal be denied.

B-31 JOSEPH SPITALE
Joseph Spitale, a former Police Officer with the City of Long Branch, represented by David J. DeFillippo, Esq., requests that the Civil Service Commission reinstate him to his position after a determination by the Police and Firemen's Retirement System that he is no longer disabled and is fit for duty.
ACTION: The Civil Service Commission denied the request.
B-32 CHARLES TRIPP
Charles Tripp, a Senior Correction Officer with South Woods State Prison, requests reinstatement of the appeal of his 15-day suspension, which was dismissed based on his failure to appear at a scheduled hearing.
ACTION: The Civil Service Commission denied the request.
B-33 LAURIE GRAHAM AND INTERNATIONAL UNION OF OPERATING ENGINEERS V. BOROUGH OF KEYPORT (JOINT ORDER OF CONSOLIDATION)
As part of a layoff action instituted by the Borough of Keyport, Laurie Graham received a workweek reduction from full-time to part-time, effective July 15, 2009. Graham appealed the good faith of the layoff to the Civil Service Commission which transmitted the matter to the Office of Administrative Law (OAL) for a hearing. Concurrently, Graham's union, the International Union of Operating Engineers, filed an unfair practice charge regarding the layoffs of Graham and two other employees with the Public Employment Relations Commission (PERC) arguing that Keyport violated the Employer-Employee Relations Act by failing to negotiate the workweek reductions and discontinuing health insurance benefits for two of the three employees. On May 5, 2010, Administrative Law Judge Edward J. Delanoy, Jr., (ALJ) issued an order denying consolidation of these matters. Based on a review of the order and after consultation with staff from PERC, and agreement that the ALJ's order appeared to be appropriate, a Joint Order was drafted adopting the ALJ's order. This joint order is now submitted to the Commission for consideration and approval.
ACTION: The Civil Service Commission adopted the joint order.
B-34 DUMIS BARREAU
Dumis Barreau, a Senior Probation Officer with the Judiciary, Vicinage 5, Essex County, represented by Nora R. Locke, Esq., petitions the Civil Service Commission for reconsideration of the final decision, rendered on February 24, 2010, which denied his request for back pay during the period of his indefinite suspension.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-35 MATTHEW GREER
The Gloucester Township Fire District #6 (Gloucester) and Matthew Greer, represented by Jason E. Sokolowski, Esq., request reconsideration of the decision rendered on November 18, 2009, which denied the Division of State and Local Operations' request to permit Mr. Greer to intergovernmentally transfer from Gloucester to Winslow Township Fire District #1 as a Fire Fighter.
ACTION: The Civil Service Commission directed that this matter be held over.
B-36 LEGAL ANALYST (M6134J), JERSEY CITY
Jersey City, represented by Joshua I. Savitz, Esq., requests reconsideration of the decision rendered on February 11, 2009 by the Civil Service Commission in In the Matter of Legal Analyst (M6134J), Jersey City which denied its request for an appointment waiver and ordered it to properly dispose of the October 9, 2007 certification within 30 days.
ACTION: The Civil Service Commission granted in part the request for reconsideration.
B-37 PROGRAM MONITOR (M6068J), NEWARK
Newark requests reconsideration of the decision rendered on July 16, 2008 by the Civil Service Commission in In the Matter of Program Monitor (M6068J), City of Newark, which ordered it to immediately remove the provisional incumbents, Angel Colon, Sorinette Rosario and Aslee Williams, and to properly dispose of the July 9, 2007 certification within 30 days.
ACTION: The Civil Service Commission granted in part the request for reconsideration.
B-38 MARCELINO MARTINEZ
The appeal of Marcelino Martinez, a Laborer with Lakewood, of his removal, effective February 4, 2009, on charges was heard by Administrative Law Judge Patricia M. Karins (ALJ), who rendered her initial decision on April 14, 2010. At its meeting on May 26, 2010, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to uphold the removal. Rather, the Commission imposed a six-month suspension. The proposed decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the decision.
B-39 GEORGE RAMOS
The appeal of George Ramos, a Police Sergeant with the City of Newark, of his seven working day suspension beginning September 21, 2009, on charges, was heard by Administrative Law Judge James A. Geraghty (ALJ), who rendered his initial decision on April 15, 2010. At its meeting on May 26, 2010, the Civil Service Commission (Commission) adopted the ALJ's recommendation to modify the seven working day suspension to a four working day suspension. The proposed final decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the final decision.
B-40 EVA ADEDAYO AND LESLIE DOMINGUEZ-RODRIGUEZ
Eva Adedayo and Leslie Dominguez-Rodriguesz appeal the determinations of the Division of Selection Services which found that they were below the minimum requirements in experience for the promotional examination for Supervising Clerk (PC0250L), Middlesex County Board of Social Services.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-41 DENISE BUCHANAN AND DEBORAH POSSUMATO
Denise Buchanan and Deborah Possumato appeal the determinations of the Division of Selection Services which found that they did not meet the minimum requirements for the promotional examination for Supervising Clerk (PC0914L), Atlantic County.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-42 FRANK HIGNUTT
Frank Hignutt appeals the determination of the Division of Selection Services that he did not meet the experience requirements for the promotional examination for the dual title of Supervising Sewage Plant Operator/Supervisor, Sewers (PM1053L), Millville.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-43 SANDRA MACKIEWICZ
Sandra Mackiewicz appeals the determination of the Division of Selection Services, which found that she did not meet the experience requirements for the promotional examination the dual title of Sheriff's Officer Sergeant/Training Officer (PC2676K), Middlesex.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-44 PHYLLIS STUBBS
Phyllis Stubbs appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Payroll Supervisor/Pension Fund Supervisor (PM1112L), Lakewood.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-45 PAMELA WARREN
Pamela Warren appeals the determination of the Division of Selection Services which found that she did not meet the minimum experience requirements for the promotional examination for Supervising Clerk (PC0914L), Atlantic County.
ACTION: The Civil Service Commission directed that this appeal be granted.
