A regular meeting of the Merit System Board was held on Wednesday November 15, 2006, in Trenton, New Jersey.
PRESENT: Margaret E. L. Howard, Presiding Merit System Board Member; Board Members Flavella Branham, and Robert J. Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Margaret E. L. Howard, Presiding Board Member, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 12, 2005, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
It is noted that, because of the need for the Board to enter into executive session, Item A-7, Maizeline Dotts, was heard out of order and considered as the last agenda item.
All actions were by unanimous vote unless otherwise specified.

DEPARTMENT OF CHILDREN AND FAMILIES
The Department of Children and Families requests the creation of a new title to comply with the terms of an agreement between the Office of Employee Relations, the Department of Personnel, the Department of Children and Families, and the Communication Workers of America.
The agreement facilitates the hiring of staff currently working as contracted employees through Children and Family Services performing paralegal functions for the Department of Children and Families. The new title is needed to properly classify paralegal staff, who do not meet the requirements for existing Paralegal Technician titles. The title will be assigned to the non-competitive service, restricted to the Department of Children and Families, and will be only used to transition a targeted group of workers into the system, pursuant to this agreement.
Workers assigned to the new transitional title will be afforded twenty-four (24) months to pursue the education required to meet the eligibility requirements for the entry level title in the series, Paralegal Technical Assistant or Paralegal Technician 2. Failure to meet the requirements for the Paralegal Technical Assistant title will be cause for separation. The title will be eliminated after the twenty-four month transition period.
Transitional Paralegals are required to submit proof to the Department of Personnel that they have met the necessary requirements for appointment to the Paralegal Technical Assistant title. Those who do so will be promoted provisionally to the Paralegal Technical Assistant title series as appropriate.

ACTION: The Merit System Board did not adopt the recommendation of the Administrative Law Judge, but dismissed the appeal for lack of jurisdiction.

Recommendation of the Administrative Law Judge – Modify the 45-day suspension to a 20-day suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of legal advice on the matter of A-7 Maizeline Dotts. The Board subsequently reconvened the public meeting.

The Salem County Sheriff’s Department appeals the March 13, 2006 Salary Disapproval Order for the October 27, 2005 certification (PL051754) of the County Correction Sergeant (PC2656F) eligible list and requests that Alan Nobles, Jr., receive a retroactive permanent appointment date.
ACTION: The Merit System Board directed that the October 27, 2005 certification (PL051754) be canceled and granted the request for retroactive permanent appointment for Alan Nobels, Jr.

Frank Osnato, Jr., requests that the appointments of Brian Burke and Russell Zadlock from the April 1, 2005 certification of the eligible list for Fire Captain (PM3587A), City of Elizabeth, be rescinded.
ACTION: The Merit System Board directed that this appeal be denied but directed that the classification matter of Brian Burke’s position be referred to the Division of Human Resource Management.
B-27 COMMUNITY SERVICE WORKER, BILINGUAL IN SPANISH AND ENGLISH (M0464E), CITY OF HOBOKEN
The City of Hoboken requests permission not to make an appointment from the certification for Community Service Worker, Bilingual in Spanish and English (M0464E).
ACTION: The Merit System Board granted the request for appointment waiver but assessed $1,024 in selection costs.
B-28 PURCHASING ASSISTANT (M1000G), BOROUGH OF FORT LEE
The Borough of Fort Lee requests permission not to make an appointment from the January 31, 2006 certification for Purchasing Assistant (M1000G).
ACTION: The Merit System Board granted the request for appointment waiver but assessed $2,048 in selection costs.
B-29 CHRISTIAN MERZEAU
Christian Merzeau, a Senior Correction Officer at Edna Mahan Correctional Facility, Department of Corrections, represented by Joseph A. Carmen, Esq., requests that the Merit System Board reinstate his appeal of his removal effective December 15, 2005, on charges, which was dismissed based on his failure to appear at his scheduled settlement conference.
ACTION: The Merit System Board granted the request and directed that the matter be transmitted to the Office of Administrative Law for further proceedings.
B-30 RICHARD POLUNAS
The City of Plainfield (City) petitions the Merit System Board for acknowledgement of the settlement agreement between Richard Polunas and the City.
ACTION: The Merit System Board acknowledged the settlement.
B-31 JANET ARMAND
The City of Newark, represented by Debra Kradjian Stephans, Esq., petitions the Merit System Board for reconsideration of the final decision, rendered on October 4, 2006, which ordered that Janet Armand be reinstated to her title of Systems Analyst and granted back pay, benefits, and seniority for the period of her separation from employment. The City also requests a stay of the Board’s decision, pending a final determination regarding its request for reconsideration. Armand requests enforcement of the Board’s October 4, 2006 decision.
ACTION: The Merit System Board directed that this matter be held over.
B-32 CYNTHIA MCSWEENEY
Cynthia McSweeney petitions the Merit System Board for reconsideration of its decision rendered on November 22, 2005 in which the Board determined that appellant failed the promotional examination for Assistant Chief Forensic Scientist, Department of Law and Public Safety (PS1706P), Division of State Police.
ACTION: The Merit System Board directed that this appeal be denied.
B-33 ERNEST JUBILEE AND HENRY M. WHITE, JR.
Ernest Jubilee and Henry M. White, Jr., Deputy Police Chiefs, challenge the eligibility of John J. Mooney, III, a provisional Police Chief, for the examination for Police Chief (PM3594H), City of Atlantic City, and request that a waiver of the competitive examination be denied.
ACTION: The Merit System Board ordered that John J. Mooney, III, be eligible for the examination for Police Chief (PM3594H), City of Atlantic City, but denied the request for a waiver of the examination and ordered that an assembled examination be administered.
B-34 TABIRAH BENTON
The appeal of Tabirah Benton, a Juvenile Detention Officer with Bergen County, of her removal, effective April 5, 2004, on charges, was heard by Administrative Law Judge Carol I. Cohen (ALJ), who rendered her initial decision on September 22, 2006. At its meeting on November 1, 2006, the Merit System Board did not adopt the ALJ’s recommendation to modify the removal to a three-month suspension. Rather, the Board upheld the removal. The proposed final decision is now submitted for the Board’s review.
ACTION: The Merit System Board adopted the final decision.
B-35 GREGORY CHIERCHIA
The appeal of Greogry Chierchia, a former Lieutenant with the Division of State Police, Department of Law and Public Safety, of the determination of the Executive Assistant Attorney General, stating that there was probable cause to substantiate a finding that he violated the New Jersey State Policy Prohibiting Discrimination, Harassment and Hostile Environments in the Workplace, was heard by Administrative Law Judge Ana C. Viscomi, (ALJ) who rendered her initial decision on June 9, 2006. At its meeting on November 1, 2006, the Merit System Board adopted the recommendation of the ALJ. The proposed final decision is now submitted for the Board’s review.
ACTION: The Merit System Board adopted the final decision.

Ongeri Aminga appeals the determination of the Division of Selection Services which found that he was not eligible for the promotional examination for Investigator 1 Child Protection (PS0170K), Division of Youth and Family Services, Department of Children and Families.
ACTION: The Merit System Board directed that this appeal be granted.
B-37 ADEYOYIN H. ASIMOLOWO AND LISSY J. KURIAN
Adeyoyin H. Asimolowo and Lissy J. Kurian, represented by Benjamin Benson, Esq., request reconsideration and a stay of the Merit System Board decision, In the Matter of Adeyoyin H. Asimolowo, et al. (MSB, decided September 6, 2006), which stated that they did not meet the requirements for the promotional examination for Quality Assurance Specialist, Health Services (PS7896K), Greystone Park Psychiatric Hospital, Department of Human Services.
ACTION: The Merit System Board denied the request.

Darrell Bomeisler appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Sanitation Driver (PM0078H), Little Egg Harbor Township.
ACTION: The Merit System Board directed that this appeal be denied.

Theodore Cirz and Michael Konfederak appeal the determinations of the Division of Selection Services which found them ineligible for the promotional examination for Police Sergeant (PM2616H), Borough of Seaside Park due to untimely applications.

Cynthia A. Flagg and Deborah M.
