           A regular meeting of the Civil Service Commission was held on Wednesday, June 17, 2020, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 13, 2019, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Barbara Carey, County Correctional Police Officer, Mercer County, Department of Public Safety, 15 working day suspension.

 

Charles Lamin, Police Officer, City of Trenton, Police Department, 30 working day suspension.

 

ACTION: The Civil Service Commission noted the withdrawal of appeals without prejudice.

Davenport, Esq., appeals his rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that the appellant be referred for an independent psychological evaluation.

 

B-2    G.F.H. – CSC DOCKET NO. 2020-476

 

          G.F.H., represented by Nicholas J. DePalma, Esq., appeals his rejection as a County Correction Officer candidate by Essex County and its request to remove his name from the eligible list for County Correction Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    G.F.H. – CSC DOCKET NO. 2020-60

 

          G.F.H., represented by Nicholas J. DePalma, Esq., appeals his rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-4    M.S.P. – CSC DOCKET NO. 2020-419

 

          M.S.P. appeals his rejection as a Police Officer candidate by the Deptford Township Police Department and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-5    D.M.S. – CSC DOCKET NO. 22019-3090

 

          D.M.S., represented by Michael P. DeRose, Esq., appeals his rejection as a Police Officer candidate by the Hamilton Township Police Department and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    J.J.W. – CSC DOCKET NO. 2019-2783

 

          J.J.W., represented by Paul N. Mirabelli, Esq., appeals his rejection as a Police Officer Recruit candidate by the New Jersey State Parole Board and it request to remove his name from the eligible list for Parole Officer Recruit (S1000U) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    S.A. – CSC DOCKET NO. 2020-2048

 

          S.A., represented by Michael Garcia, Esq., appeals the removal of her name from the Correctional Police Officer (S9988A), Department of Corrections eligible list on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    J.L. – CSC DOCKET NO. 2020-2042

 

          J.L. appeals the removal of his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list on the basis of falsification of the employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    BRIAN LIESS – CSC DOCKET NO. 2020-1704

 

          Brian Liess appeals the removal of his name from the eligible list for Police Officer (S9999U), Wildwood Crest on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10  BARBARA MCCORMICK – CSC DOCKET NO. 2020-1652

 

          Barbara McCormick appeals the removal of her name from the eligible list for Public Health Consultant 2, Nursing (S0032W), Statewide on the basis that she failed to respond to a certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11  J.S. – CSC DOCKET NO. 2020-2227

 

          J.S. appeals the removal of his name from the Correctional Police Officer (S9988A), Department of Corrections eligible list on the bases of an unsatisfactory criminal record and an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-12  HARRY TISCH – CSC DOCKET NO. 2020-1347

 

          Harry Tisch appeals the County of Mercer’s request to remove his name from the eligible list for Economic Development Representative 1 (C0964W), on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-13  SPENCER TREJO – CSC DOCKET NO. 2020-1308

 

          Spencer Trejo appeals the removal of his name from the County Police Officer (S9999U), Camden County eligible list for failure to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-14  CHARLES MCGOVERN – CSC DOCKET NO. 2020-902

 

          Charles McGovern appeals the determination of the Division of Agency Services that his position with the Department of the Treasury was properly classified as Special Agent 2.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-15  CODE ENFORCEMENT OFFICER (M0624W), BOROUGH OF LAVALETTE – CSC DOCET NO. 2020-2245

 

          The Borough of Lavallette requests permission not to make an appointment from the January 28, 2019 certification for Code Enforcement Officer (M0624W), Lavallette Borough.

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-16  JOHN ARRINGTON – CSC DOCKET NO. 2020-2549

 

          John Arrington, a Senior Correctional Police Officer at Edna Mahan Correctional Facility for Women, Department of Corrections, represented by Luretha Stribling Esq., petitions the Civil Service Commission for interim relief regarding his pending disciplinary action.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-17  CAROL CARMAN – CSC DOCKET NO. 2020-1744

 

          Carol Carman requests relief regarding the promotional examination for Environmental Specialist 2 (PS7940G), Department of Environmental Protection.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-18  MALIKAH SPENCER – CSC DOCKET NO. 2020-2548

 

          Malikah Spencer, a County Correctional Police Officer with Essex County, represented by Luretha Stribling, Esq., petitions the Civil Service Commission for interim relief regarding her pending disciplinary action.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-19  ERIK BLOUNT – CSC DOCKET NO. 2020-2360

 

          Erik Blount, a Police Officer with Newark, represented by Giovanna Giampa, Esq., petitions the Civil Service Commission for interim relief regarding his indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-20  MICHAEL CHIRICO – CSC DOCKET NO. 2020-2363

 

          Michael Chirico, a Police Officer with Newark, represented by Giovanna Giampa, Esq., petitions the Civil Service Commission for interim relief regarding his indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-21  TASHIA JONES – CSC DOCKET NO. 2020-2361

 

          Tashia Jones, a Police Officer with Newark, represented by Giovanna Giampa, Esq., petitions the Civil Service Commission for interim relief regarding his indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-22  NORBERTO SOARES – CSC DOCKET NO. 2020-2362

 

          Norberto Soares, a Police Lieutenant with Newark, represented by Giovanna Giampa, Esq., petitions the Civil Service Commission for interim relief regarding his indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-23  ERNESTINE JONES-BOOKER – CSC DOCKET NO. 2019-1994

 

          Ernestine Jones-Booker appeals the determination of the Division of Agency Services which found that she did not meet the requirements for the examination for Administrative Analyst 3 (S0322W).

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-24  ANDREW GLODOWSKI – CSC DOCKET NO. 2020-2367

 

          Andrew Glodowski requests to file a late application for the promotional examination for Administrative Analyst 3 (PS0134T), Department of Transportation.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-25  WILFREDO GUZMAN – CSC DOCKET NOS. 2020-135 AND 2020-2615

 

          Wilfredo Guzman, a former Police Officer with Rockaway Township (Rockaway), represented by Paul W. Tyshchenko, Esq., requests enforcement of In the Matter of Wilfredo Guzman (CSC, decided January 15, 2020). Rockaway, represented by Thomas N. Ryan, Esq., requests a stay of the order in the matter to reimburse Guzman for his accrued leave time pending its appeal to the Appellate Division.

 

ACTION:     The Civil Service Commission directed that Guzman’s request be granted and Rockway Township’s request be denied.

 

B-26  Y.A. – CSC DOCKET NO. 2019-3717

 

          Y.A., an Administrative Analyst 4, Fiscal Management with the Department of Health (DOH), appeals the determination of the Chief of Staff, DOH, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-27  D.M. – CSC DOCKET NO. 2020-1831

 

          D.M., a former Personnel Assistant 2 with the Office of Information Technology, appeals the decision of the Special Assistant to the State Chief Technology Officer which determined that she violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-28  R.P. -CSC DOCKET NO. 2020-240

 

          R.P. appeals his removal from the Correctional Police Officer (S9988U),     Department of Corrections eligible list on the basis of an unsatisfactory        criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

          The Division of Agency Services (Agency Services) requests that the provisions of N.J.A.C. 4A:4-7.6(a)1 be relaxed to allow the movement of employees in the Field Representative Housing, Code Enforcement title series to the Inspector, Multiple Dwellings title series as lateral title changes as part of a title consolidation action.

 

ACTION:     The Civil Service Commission directed that this request be granted.

          Proposed Notice of Adoption for Temporary Rule Relaxations and Modifications to various provisions of N.J.A.C. 4A in accordance with Section 6 of Executive Order 103, issued in response to the COVID-19 pandemic.

 

ACTION:     The Civil Service Commission approved the proposed temporary rule relaxations for public notice and comment.
