    A regular meeting of the Civil Service Commission was held on Wednesday, June 29, 2022, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2021, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

A-2    BRANDON DURANT – CSC DOCKET NO. 2020-2736

 

Brandon Durant, Stable Worker, Union County, Department of Parks and Recreation, removal, effective January 21, 2020, on charges of violation of County policy related to drug and alcohol abuse.

 

Recommendation of the Administrative Law JudgeDismiss the appeal for failure to appear.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

A-3    PETER FRATTICCIOLI – CSC DOCKET NO. 2022-1337

 

Peter Fratticcioli, County Police Officer, Camden County Police Department, removal, effective November 30, 2021, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4    JEREMY KACZOROSKI – CSC DOCKET NOS. 2019-314 AND 2019-315 (CONSOLIDATED)

 

Jeremy Kaczoroski, Electrician, Trenton Psychiatric Hospital, Department of Health, two removals, effective December 11, 2017, on charges of insubordination, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5    DENNIS TURNER – CSC DOCKET NO. 2022-1444

 

Dennis Turner, Senior Correctional Police Officer, Bayside State Prison, Department of Corrections, removal, effective December 14, 2021, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Modify the removal to a 30 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    D.J.Q. – DOCKET NO. 2022-546      D.J.Q., represented by Michael L. Prigoff, Esq., appeals his rejection as a Fire Fighter candidate by New Brunswick and its request to remove his name from the eligible list for Fire Fighter (M1855W) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    EMILY DEMAIO - CSC DOCKET NO. 2022-1761

 

Emily DeMaio requests to be permitted to submit a late application for the Environmental Specialist 2 (PS7817G), Department of Environmental Protection, examination.

 

ACTION:     The Civil Service Commission directed that this request be     granted.

 

B-3    HARRY BACK, JR - CSC DOCKET NO. 2022-1720

 

Harry Back, Jr., appeals the determination of the Division of Agency Services that he did not meet the experience requirement for the open competitive examination for Beach Supervisor (M0601C), City of Cape May.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-4    MARK BARRY - CSC DOCKET NO. 2022-1389

 

Mark Barry appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Electrician (S0395C), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-5    PHILIP DEMOLA, JR. - CSC DOCKET NO. 2022-1746

 

Philip DeMola appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Supervising Maintenance Repairer/Supervisor Landscape (M0424C), Trenton.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-6    ANDIE HANSELL - CSC DOCKET NO. 2022-2777

 

Andie Hansell appeals the decision of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Customer Service Information Specialist 3 (PS6970K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied, and the matter of the appellant’s position classification be referred to the Division of Agency Services.

 

B-7    BHARTI SWAMINARAYAN - CSC DOCKET NO. 2022-1880

 

Bharti Swaminarayan appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Clerk 2 (PC4790C), Middlesex County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    A.P. - CSC DOCKET NO. 2022-2987

 

A.P. appeals the determination of the Division of Administration and Employee Services denying her request for a make-up examination for the open-competitive examination for Human Services Specialist 2 (C0552C), Warren County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-9    NIKKO VRISIOTIS - CSC DOCKET NO. 2022-1414

 

Nikko Vrisiotis appeals the determination of the Division of Agency Services which found that he was not employed in the announced unit scope for the promotional examination for Police Sergeant (PM4569C), Jersey City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10   M.E. - CSC DOCKET NO. 2022-2454

 

M.E., a Police Officer with Lawrence, represented by Ben Weathers, Esq., petitions the Civil Service Commission for interim relief in relation to his immediate suspension without pay, effective January 9, 2022.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-11   FERNANDO NOBLECILLA - CSC DOCKET NO. 2022-2455

 

Fernando Noblecilla, a Police Officer with Hillside, represented by Ben Weathers, Esq., petitions the Civil Service Commission for interim relief in relation to his immediate suspension without pay, effective March 11, 2022.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-12   SOCIAL WORKER (C1163A), BERGEN COUNTY - CSC DOCKET NO. 2022-2665

 

Bergen County requests permission not to make an appointment from the February 6, 2020 certification for Social Worker (C1163A), Bergen County.

 

ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.

 

B-13   ROBERTO NEGRON - CSC DOCKET NO. 2022-3148

 

Roberto Negron requests that his salary step be retroactively advanced, and he be retroactively appointed as a Senior Police Officer, Human Services effective 12 months after his appointment as a Police Officer Recruit, Human Services on September 15, 2007.

 

ACTION:     The Civil Service Commission directed that these requests be denied.

 

B-14   JEFFREY PEREZ - CSC DOCKET NO. 2022-573

 

Jeffrey Perez appeals his appointment date to the Police Lieutenant title and seeks his eligibility for the promotional examination for Police Captain (PM4072C), Willingboro.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-15   EMERGENCY RESPONSE SPECIALIST TRAINEE - CSC DOCKET NO. 2022-3163

 

The Division of Agency Services, on behalf of the Department of Environmental Protection, requests the creation of the non-competitive title of Emergency Response Specialist Trainee. It also requests the inactivation of the Inspector, Bulkheads and Dredging title.

 

ACTION:     The Civil Service Commission directed that this request be     granted.

  

B-16   AMANDA BASSO - CSC DOCKET NO. 2022-2050

 

Amanda Basso requests that she be permitted to submit an application for the open competitive examination for Police Officer (M0017D), Brick, after the application filing deadline.      

 

          ACTION:     The Civil Service Commission directed that this request be denied.

 

B-17   JOHN CLARK - CSC DOCKET NO. 2022-2440

 

John Clark appeals the determination of the Division of Agency Services, which found that he was ineligible for the promotional examination for Road Repair Supervisor (PC4893C), Morris County on the basis that he was below the minimum requirements in experience.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-18   DAMIAN DALEY - CSC DOCKET NO. 2022-1231

 

Damian Daley, represented by Thomas M. Rogers, Esq., appeals the removal of his name from the Police Officer (S9999A), Perth Amboy, eligible list on the basis of falsification of the employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19   JARED ROBINSON - CSC DOCKET NO. 2022-2889

 

Jared Robinson appeals the determination of the Division of Agency Services that the promotional examination for Paralegal Specialist (PC4881C), Mercer County Board of Social Services was not a promotion.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-20   JEFFREY PASCUAL - CSC DOCKET NO. 2022-760

 

            Jeffrey Pascual represented by Michael C. Mormando, Esq., appeals his appointment date to the Police Sergeant title and requests to be permitted to submit an application for the promotional examination for Police Lieutenant (PM4143C), Moorestown, after the application filing deadline.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

 

B-21   HAROLD ROBINSON - CSC DOCKET NO. 2022-556

 

            Harold Robinson, a Police Officer with the City of Passaic, represented by Charles J. Sciarra, Esq., petitions the Civil Service Commission for interim relief concerning a Preliminary Notice of Disciplinary Action.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-22   GARY BRIZEUS - CSC DOCKET NO. 2022-2708

 

Ancora Psychiatric Hospital, Department of Health, requests that Garry Brizeus be provided with a retroactive date of permanent appointment to the title of Human Services Technician.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-23   MICHAEL RANDOLPH, ET AL. - CSC DOCKET NOS. 2022-1760, ET AL.

 

            Michael Randolph requests a retroactive effective date of the reclassification of his position as Fire Lieutenant. Paul Atkinson and Tyrone Brown appeal the decisions of the Division of Agency Service which found that their positions with Irvington are properly classified as Fire Fighter. They seek Fire Lieutenant job classifications in these proceedings.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-24   SOUTH ESSEX SERVICES REGIONAL AGENCY - CSC DOCKET NO. 2022-3283

 

            The Division of Agency Services recommends the reallocation of several titles to the non-competitive division of the careen service in accordance with N.J.A.C. 4A:3-1.2(c)3 for the purpose of facilitating the establishment of a Joint Meeting.

 

ACTION:     The Civil Service Commission directed that this request be granted.
