          A regular meeting of the Civil Service Commission was held on Tuesday, July 9, 2019, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca (via telephone) and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on May 23, 2019, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of June 26, 2019.

 

ACTION:     The Civil Service Commission adopted the minutes of its meeting on June 26, 2019.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Philip Davis, Police Officer, East Orange, Police Department, suspension.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    L.D. (Consolidated)

 

L.D., Human Service Assistant, New Lisbon Developmental Center, Department of Human Services, removal effective March 3, 2016, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    KIMBERLY HAYES

 

Kimberly Hayes, Human Service Assistant, New Jersey Veterans Memorial Home -Vineland, Department of Military and Veterans Affairs, removal effective December 6, 2016 on charges of falsification, intentional misstatement of material fact, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    M.D. KHAN

 

M.D. Khan, Police Officer, Jersey City, Police Department, removal effective September 11, 2017 on charges of violation of rules, regulations, policies and procedures.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    RYAN LOPEZ

 

Ryan Lopez, Senior Medical Security Officer, Ann Klein Forensic Center, Department of Health, removal effective April 10, 2017, on charges of conduct unbecoming a public employee, physical or mental abuse of a patient and or inappropriate contact or mistreatment of a patient, client, resident or employee.

 

Recommendation of the Administrative Law Judge – Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    FRANKIE WALLS

 

Frankie Walls, Custodial Worker, Newark School District, 30 working day suspension, on charges of chronic or excessive absenteeism or lateness, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the 30 working day suspension to a 25 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    PATRICK KERNEY, JR. – CSC DOCKET NO. 2019-1396

 

          Patrick Kerney, Jr., represented by Nicholas P. Milewski, Esq., appeals his removal from the eligible list for Police Officer (S9999U), Bayonne on the basis that he falsified his application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    STEVE ZATKO, JR. – CSC DOCKET NO. 2019-2558

 

          Steve Zatko, Jr., represented by Patrick P. Toscano, Jr., Esq., appeals his removal from the list for Fire Captain (PM1111S), Elizabeth Fire Department eligible list due to his failure to respond to the certification.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    DANIELLE BENNETT – CSC DOCKET NO. 2019-3147

 

          Danielle Bennett appeals the decision of the Division of Agency Services that the proper classification of her position with the Department of Corrections is Social Work Supervisor 2, Secured Facilities. The appellant seeks a Social Work Supervisor 1, Secured Facilities job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    CLAIMS ADJUDICATOR SUPERVISOR, DISABILITY DETERMINATIONS – CSC DOCKET NO. 2019-3745

 

          The Department of Labor and Workforce Development requests that the promotional eligible list for Claims Adjudicator Supervisor, Disability Determinations (PS3520N), Department of Labor and Workforce Development, be revived to allow it to make appointments.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-5    CLERK 3 (M0573U), LAKEWOOD – CSC DOCKET NO. 2018-813

 

          Lakewood Township requests permission not to make an appointment from the August 7, 2017 certification for Clerk 3 (M0573U).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-6    SH-KEER MILBOURNE – CSC DOCKET NO. 2019-3289

 

          Sh-Keer Milbourne appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Administrative Analyst 4, Fiscal Management (S0654W), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    DERWIN MIRANDA – CSC DOCKET NO. 2019-3243

 

          Derwin Miranda appeals the determination of the Division of Agency Services that he did not meet the experience requirement for the promotional examination for Program Specialist 2, Social Human Services (PS7822H), Department of Health.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    MARIE SANTA – CSC DOCKET NO. 2019-3189

 

          Marie Santa appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Manager 2, Human Resources (S0763W), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    LISA STAFFORD – CSC DOCKET NO. 2019-3244

 

          Lisa Stafford appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements, per the substitution clause for education, for the promotional examination for Management Assistant (PC2389W), Camden County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10  JEFFREY TELEP – CSC DOCKET NO. 2019-3302

 

          Jeffrey Telep appeals the determination of the Division of Agency Services that he did not meet the experience requirement for the open competitive examination for Environmental Health Specialist (C2027W), Bergen County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11  DEVIN BONIFAZI AND MARC MANFREDI – CSC DOCKET NOS. 2019-3378 AND 2019-3387

 

          Devin Bonifazi and Marc Manfredi appeal the promotional examination for Sheriff’s Officer Sergeant (PC2956W), Mercer County.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-12  ROSEMARIE KRAWIECKI – CSC DOCKET NO. 2019-3605

 

          Rosemarie Krawiecki appeals the promotional examination for Supervising Family Service Specialist 1 (PS4823K), Department of Children and Families.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-13  JOHN REED – CSC DOCKET NO. 2019-3518

 

          John Reed appeals the administration of the oral portion of the examination for Battalion Fire Chief (PM2163W), Plainfield.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14  ROBERT BOSCARINO – CSC DOCKET NO. 2019-3349

 

          Bergen County requests that Robert Boscarino be provided with a retroactive permanent appointment to the title of Public Safety Telecommunicator.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-15  KEVIN MURRAY – CSC DOCKET NO. 2019-3036

 

          Kevin Murray requests that his residency be changed after the closing date for the eligible lists produced from the examination for Fire Fighter (M9999W).

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-16  NAEEM SYED – CSC DOCKET NO. 2019-1910

 

          Naeem Syed requests to be permitted to submit a late application for the Code Enforcement Officer (M0054A), West New York examination.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-17  RONNIE BELIN, JR. – CSC DOCKET NO. 2019-2372

 

          Ronnie Belin, Jr., a Fire Fighter with Plainfield, appeals his suspension without pay, effective May 5, 2016.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

PUBLIC PORTION

 

          No comment.
